R-1788-12-99RESOLUTION NO. 1788-12-"(R) A RESOLUTION OF THIN CITY COUNCIL OF TIRE CITY OF ALLEN, COLLIN COUNTY, TEXAS, ADOPTING AN ANNEXATION PLAN FOR THIN CITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the 76th Texas Legislature, 1999, adopted Senate Bill 89, extensively amending the Municipal Annexation Act, Chapter 43, Texas Local Government Code; and WHEREAS, Section 17(b) of Senate Bill 89, requires that each city adopt an annexation plan on or before December 31, 1999, that includes territory that the City plans to annex within three (3) years from the date the territory is placed in the plan in accordance with Section 43.052, Texas Local Government Code; and WHEREAS, there are a number of exceptions that authorize annexation of territory without the territory having been placed in an annexation plan; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS: SECTION 1. That for the purposes of Section 17(b) of Senate Bill 89, adopted by the 76th Texas Legislature, and Section 43.052, Texas Local Government Code, the City Council of the City of Allen, Collin County, Texas, adopts the following annexation plan: "CITY OF ALLEN ANNEXATION PLAN The City Council has reviewed the future expansion needs of the City and the prospects of development within the City's extraterritorial jurisdiction. After studying the effects of amendments to the Municipal Annexation Act, by Senate Bill 89, 76th Texas Legislature, the City Council has determined that at this time, the City does not intend to annex any territory that in order to be annexed, is required to be in an annexation plan. The City Council reserves the right to amend this annexation plan in the future to add territory for annexation should circumstances change." SECTION 2. That this Resolution shall become effective immediately from and after its passage.
