R-1758-9-991758-9-99(R) ' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, ENCOURAGING THIN UNITED STATES CONGRESS TO REINSTATE FLEXIBILITY PROVISIONS FOR THE ENVIRONMENTAL PROTECTION AGENCY TRANSPORTATION CONFORMITY RULES. WHEREAS, the Texas Natural Resource Conservation Commission (TNRCC) and the Texas Department of Transportation (TxDOT) have closely monitored issues that have arisen as a result of litigation against the Environmental Protection Agency (EPA) by environmental groups; and, WHEREAS, federal court pilings have removed authority from the EPA to provide flexibility to allow transportation projects to continue receiving federal funds at a future date although such projects had previously been `grandfathered' under air-quality conformity analysis accepted prior to commencement of the project; and, WIIBREAS, a number of projects in Texas and the Dallas area could be negatively impacted if action is not taken to restore previously accepted EPA mles; and, WHEREAS, continuation of these projects impacts the ability of this region to maintain and enhance mobility, economic development, and quality of life for all citizens; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALLEN, ' COLLIN COUNTY, TEXAS, THAT: SECTION 1: The United States Congress, through the Texas Congressional Delegation, is encouraged to pursue action to reinstate the flexibility concerning EPA's transportation conformity rules, which were in effect prior to recent court mlings. SECTION 2: The Dallas Regional Mobility Coalition (DRMC) shall provide support in this effort through contact with appropriate local, state, and federal officials. SECTION 3: The City Council directs the City Secretary to forward certified copies of this Resolution to the Texas Congressional Delegation from the Dallas area, TxDOT, TNRCC, and other state/federal officials.
