' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN
COUNTY, TEXAS, AUTHORIZING A REIMBURSEMENT AGREEMENT (PRO -
RATA) FOR OFF-SITE IMPROVEMENTS TO THE VILLAGES AT MAXWELL
CREEK SUBDIVISION; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, a developer sometimes needs to cross property of others to install water or sanitary sewer
facilities to a new development; and,
WHEREAS, a developer needs to recover his costs for these off-site facilities that must be in place for the
owner of the off-site land to develop his property in the future; and,
WHEREAS, the City will agree to collect the funds from other developers at the time of platting to
reimburse the developer that installed the off-site improvements;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALLEN,
COLLIN COUNTY, TEXAS:
SECTION 1: That the City Manager is hereby authorized to enter into a reimbursement agreement for
off-site improvements to the Villages at Maxwell Creek Subdivision which will include $54,744.70 for a
twelve -inch water line in Malone Road, $84,648.50 for a sanitary sewer metering station on Malone Road,
$80,137.47 for a sanitary sewer force main from the lift station to the metering station on Malone Road,
. $61,643.38 for a twelve -inch water main on Bethany Road, all of which are shown in Exhibit "A" attached
hereto.
SECTION 2. This Resolution shall become effective immediately from and after its passage
DULY PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN
COUNTY, TEXAS, ON THIS THE 6TH DAY OF MAY, 1999.
