ORDINANCE NO. 1585-3-98
AN ORDINANCE OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS,
ABANDONING A TEMPORARY DRAINAGE EASEMENT AND TEMPORARY
EASEMENT LOCATED ON A TRACT OF LAND SITUATED
IN THE JAMES W. PARSONS SURVEY, ABSTRACT NO. 704, AND FURTHER
BEING A 148.244 ACRE TRACT OF LAND DEEDED TO JOHN T. GREEN,
JOAN GREEN, JEFFERY GREEN AND MIKE BYRN GREEN IN THE CITY
OF ALLEN, SAID EASEMENTS RECORDED BY SEPARATE INSTRUMENT
UNDER CLERK'S FILE NUMBER 96-0097412 IN THE LAND RECORDS OF
COLLIN COUNTY, TEXAS; PROVIDING FOR EXHIBIT 'A;' PROVIDING
FOR A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, provision was made for realignment of a portion of the storm water system; and
WHEREAS, the temperary drainage and temporary construction easements are no longer necessary in
accordance with the City of Allen engineering designs; and,
WHEREAS, the City Engineer, at the request of the landowner, has recommended that these easements
be abandoned; and,
WHEREAS, the City Council is in agreement with the City Engineer and has stated their intent to
abandon such easements as described herein.
NOW, THEREFORE, BE rr ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN,
TEXAS, THAT:
SECTION 1: The temporary drainage and temporary construction easements described in Exhibit "A"
and recorded in Collin County Clerk's file number 96-0097412 are hereby forever abandoned.
SECTION 2: Exhibit "A" is attached hereto and made a part hereof for all purposes and further
describes the portion of the temporary drainage and temporary construction easements to be abandoned.
SECTION 3: All ordinances of the City of Allen in conflict with the provisions of this ordinance be,
and the same are hereby repealed; provided, however, that all other provisions of said ordinances not
in conflict herewith shall remain in full force and effect.
SECTION 4: It appears the future development of the property requires abandonment of said
easements described herein in order to permit its proper development and, in order to protect the public
interest, comfort and general welfare of the City of Allen, creates an urgency and an emergency for the
preservation of the public health, safety and welfare, and requires that this ordinance shall take effect
immediately from and after its passage and the publication of the caption of said ordinance as the law
in such cases provides.

WHEREAS, John T. Green, Joan Green Jeffrey and Mike Byrn Green conveyed to the City
of Allen, Collin County, Texas (the "City's a certain Temporary Drainage Easement for Right -of -
Way, City of Allen FM 2170, West (the "Easement') affecting the property described in Exl+ibit
.tj!attached hereto (Parcel 29) by instrument filed November 12, 1996, recorded in Clerk's File No.
96-0097412, Land Records of Collin County, Texas; and
WHEREAS, the City has determined that it no longer needs the Easement and desires to
release, terminate and abandon same.
NOW, THEREFORE, the City hereby releases, terminates and abandons the Easement.
Executed effective this'Ah day of March, 1998.
