O-1578-2-98ORDINANCE NO. 1-978-2-98 AN ORDINANCE OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AMENDING CHAPTER 13, "STREETS AND SIDEWALKS,' OF THE ALLEN CODE OF ORDINANCES BY PROVIDING FOR NEW SIDEWALK CONSTRUCTION WITHIN THE CITY USING HOMEOWNERS' PARTICIPATION IN COSTS; PROVIDING FOR A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Allen desires to enhance public safety by any means available; and, WHEREAS, the City of Allen has no official policy of new sidewalk construction; and, WHEREAS, the City Council has received from the Community Development Corporation (CDC) funds to allow new sidewalks to be installed in streets where no sidewalks have existed. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN, TEXAS, THAT: SECTION 1: From and after the effective date of this ordinance, Chapter 13, "Streets and Sidewalks," of the Allen Code of Ordinances is hereby amended as set forth hereinafter. SECTION2: The City of Allen will participate with 80% of the cost of the new sidewalks, and the homeowners with 20%. SECTION 3: Funds for this project are from the Community Development Corporation (CDC), and this ' policy is in effect only when funds me available. SECTION 4: The staff is authorized to develop administrative guidelines to implement this ordinance within single-family residential zoning districts of the city. SECTIONS: It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable; and if any phrase, clause, sentence or section of this ordinance shall be declared unconstitutional or invalid by any judgment or decree of a court of competent jurisdiction, such unconstitutionality or invalidity shall not affect any other remaining phrase, clause, sentence, paragraph or section of this ordinance; and the City Council hereby declares it would have passed the remaining portions even though it had known the affected parts would be held unconstitutional. SECTION 6: This ordinance shall take effect immediately from and after its passage.
