O-1488-4-97ORDINANCE NO. 1488-4-97 ' AN ORDINANCE OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, ESTABLISHING A 'BEEP ALIEN BEAUTIFUL BOARD" FOR THE PURPOSE OF ASSISTING THE CITY COUNCIL AND THE CITY STAFF IN ESTABLISHING A CITY-WIDE POLICY FOR DECREASING THE AMOUNT OF LOOSE REFUSE IN THE CITY AND TO ASSIST IN THE DEVELOPMENT OF BEAUTIFICATION PROGRAMS FOR THE COMMUNITY AS NEEDED; PROVIDING THE MEMBERSHIP AT SEVEN (7� PROVIDING THE QUALIFICATIONS OF THE MEMBERS; PROVIDING THE OFFICERS OF THE BOARD; ESTABLISHING THE POWERS AND DUTIES OF THE BOARD; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Allen, Texas, has the authority under the City Charter to appoint citizens to various boards and commissions; and, WHEREAS, the City Council of the City of Allen has determined the need of a board to assist in the beautification of the City; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN, TEXAS, THAT: SECTION 1: A "Keep Allen Beautiful Board" (the "Board") is hereby created for the purpose of assisting the City Council in establishing a city-wide policy for decreasing the amount of loose refuse in the City. ' SECTION2: The Board Provided for herein shall be comprised of seven (7) members to be appointed by the City Council. Board members shall be residents and qualified voters of the City of Allen. The City Manager, or designee, will serve as Coordinator of and support to the Board. Board members shall be appointed for a term of two (2) years. No Board member shall serve a term of more than two (2) successive full terms. The City Manager, or designee, will serve in a non-voting ex officio capacity. Four (4) members of the Board shall constitute a quorum for the conduct of business. The members of the Board shall regularly attend meetings of the Board and shall serve without compensation. The Board will hold one (1) meeting per month and will can special meetings as required to conduct their duties. All stated meetings will be open to the public, and the Board will establish the date, time and place of their meetings. The Board shall adopt its own rules of procedure and keep a record of its proceedings in accordance with the provisions of this ordinance and the Charter of the City of Allen. Newly appointed members shall be installed at the first regular meeting after their appointment. The Board shall hold an organizational meeting each year in October to elect a Chair, Vice -Chair and Secretary. The initial Board shall be appointed in June with the Chair, Vice -Chair and Secretary being elected thereafter. Chair. The Chair shall preside over meetings and shall be entitled to vote upon each issue. ' In the event a question over procedure arises, Roberts' Rules of Order shall prevail. Vice -Char: The Vice -Chair shall assist the Chair in directing the affairs of the Board. In the absence of the Chair, the Vice -Chair shall assume all duties of the Chair. Secretary: The Secretary shall keep the minutes of all meetings and in the Secretary's absence, the Chair shall designate another member to act as Secretary. The Secretary shall read ' once a year, at the first regular meeting following the appointment of officers, the Keep Allen Beautiful Ordinance. The Secretary may accept, when available, the assistance of City personnel in taking and transcribing minutes but shall sign the minutes officially before presenting them to the Board for approval. SECTION 3: The Board shall recommend refuse and environmental management policies to the City Council so all city -refuse and clean -city activities may follow a common purpose. The Board shall have the following responsibilities: 1. Assist City Administration and City Council in reducing litter and associated problems. 2. Assist in development of further beautification programs for the community as may be needed 3. Assist in the development of city-wide refuse and environmental policy plan(s) for review and adoption. 4. Assist City Administration in evaluating the effectiveness of the policies developed. 5. Determine and recommend to the City Council and the City Administration program priorities on a city-wide basis. 6. Recommend enforcement and additional program alternatives. 7. Carry out such other tasks as the City Council may designate. To accomplish these responsibilities, the Board may establish subcommittees, including, but not limited to, the areas of business and industry, communications, community organizations, municipal operations, schools, recycling, finance/fund raising, and cleanup. SEMON4. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable; and if any phrase, clause, sentence or section of this ordinance shall be declared unconstitutional or invalid by any judgment or decree of a court of competent jurisdiction, such unconstitutionality or invalidity shall not affect any other remaining phrase, clause, sentence, paragraph or section of this ordinance; and the City Council hereby declares it would have passed the remaining portions even though it had known the affected parts would be held unconstitutional. SECTION 5: This ordinance shall take effect immediately from and after its passage and publication in accordance with the provisions of the Charter of the City of Allen, and it is accordingly so ordained.
