AN ORDINANCE CREATING A CORPORATION COURT IN THE TOW14 OF
ALLEN, COLLIN COUNTY, PROVIDING FOR THE JURISDICTION OF SAID
COURT, PROVIDING FOR THE APPOINTMENT OF A RECORDER OF SAID
COURT, PROVIDING FOR THE TERM OF OFFICE OF SAID RECORDER,
PROVIDING FOR THE COMPENSATION TO BE PAID SAID RECORDER, AND
DECLARING AN EMERGENCY AND EFFECTIVE DATE OF THIS ORDINANCE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE TOWN OF ALLEN
Section 1: There is hereby created in the town of Allen,
Collin County, Texas, a Corporation Court, which shall have
jurisdiction within the territorial limits of said town in
all criminal cases arising under the ordinances of said town
and shall also have concurrent jurisdiction with any justice
of the peace in the precinct in which said town is situated
in all criminal cases arising under the criminal laws of this
state, in which punishment is by fine only, and where the
maximum of such fine may not exceed $200.00, and arising with-
in such territorial limits of the town of Allen.
Section 2: The City Secretary of the town of Allen shall be
exofficio clerk of the corporation court and shall hold said
office during his or her tenure as City Secretary. The clerk
shall keep minutes of the proceedings of said court, issue
all process, and generally perform all the duties of the
clerk of a court as prescribed by law for a county clerk in so
far as the same may be applicable.
Section 3: The recorder of the corporation court shall be the
duly elected mayor of the town of Allen and shall hold such
office during his tenure as mayor unless otherwise provided
by ordinances of the town of Allen. Such recorder shall re-
ceive additional compensation as shall be determined by the
City Council.
Section 4: The fact that at present, there is no corporation
court in the town of Allen, and such deficiency creates a
grave public need and public necessity and creates an emer-
gency, this ordinance to take effect immediately upon its
passage.
Duly passed and approved by the Council of the town of
Allen, on the a -to day of July, 1962.
