Rodenbaugh, Mayor City Staff: Jon McCarty, City Manager The called - special session of the Allen City Council was called to order by Mayor Pro Tem Farmer at 7:18 p.m. on Thursday, August 28, 1986, in the Council Chambers of the Allen Municipal Annex, One Butler Circle, Allen, Texas. Public Hearing: FY 1986 - 87 Operating Budget for the City of Allen (Agenda Item II) City Manager Jon McCarty provided a brief summary of the highlights of the FY 1986 - 87 operating budget for the City of Allen. Mayor Pro Tem Farmer opened the public hearing. With no one wishing to speak either for or against the proposed budget for FY 1986 - 87, Mayor Pro Tem Farmer closed the public hearing. Adjournment (Agenda Item III) MOTION: Upon a motion made by Councilman Pendleton and seconded by Councilman Wolfe, the Council voted 6 - 0 to adjourn the called - special session at 7:28 p.m. on Thursday, August 28, 1986. Rodenbaugh, Mayor City Staff: Jon McCarty, City Manager The called - special session and workshop of the Allen City Council was called order by Mayor Pro Tem Farmer at 7:29 p.m. on Thursday, August 28, 1986, in the Council Chambers of the Allen Municipal Annex, One Butler Circle, Allen, Texas. Workshop on the Proposed Fiscal Year 1986 - 87 Budget (Agenda Item II) At this time, Mayor Pro Tem Farmer adjourned the called - special session into Executive Session. Executive Session (Agenda Item III) In accordance with Article 6252-17, V.A.T.C.S. (Open Meetings Law), Section 2(g), the Allen City Council convened into Executive Session at 7:30 p.m. on Thursday, August 28, 1986, in the Conference Room of the Allen Municipal Annex, in order to discuss matters pertaining to personnel and salaries related to the FY 1986 - 87 Budget. The Executive Session was adjourned at 10:35 p.m. Workshop on Proposed Solid Waste Contract and Rates (Agenda Item IV) City Manager Jon McCarty advised the Council of the various meetings held with representatives of Moore Industrial Disposal and the Council -appointed committee and city staff in order to negotiate various aspects of the rate increase request and the contents of the contract document. Mr. McCarty advised that Don Hamon, with Moore Industrial Disposal, was present to answer any questions posed by the Council. Councilman Jim Pendleton and Councilman Jim Wolfe were members of the Council -appointed committee involved in the negotiations of this rate increase request and Councilman Pendleton advised the Council of the recommendation by the committee. Councilman Pendleton stated to the Council that the recommendation was to hold the residential collection rate at $6.00 per month and the commercial rate would be increased not more than 14.28 overall. However, Moore Industrial had not been agreeable to those terms. Councilman Pendleton advised that if those rates could not be resolved then it was the recommendation of the committee that the Council go out for bids for a new solid waste agent and also consider hiring a consultant during that process to help clarify some of the operating costs factors and provide information during the solicitation and receipt of bids. A41 ALLEN CITY COUNCIL CALLED - SPECIAL SESSION & WORKSHOP AUGUST 28, 1986 Page 2 Workshop on Proposed Solid Waste Contract and Rates (cont'd) (Agenda Item IV) Councilman Wolfe and Councilman Pendleton also advised the Council that with their recommendation they are also suggesting that a 60 -day extension of the notification period be granted in order to have ample time to work through the bidding process. There was considerable discussion by the City Council on the 60 -day extension period and how it was to be used, what decisions had been made on the contract document and what the recommendations were on that, the need for a consultant and what the city hoped to gain from the consultant. Don Hamon, with Moore Industrial Disposal, spoke before the Council on some handout information he had provided regarding the rates. Mr. Hamon explained to the Council that the $6.00 charge for residential could be done if there was an approx- imate 31% increase in the commercial rates. There was considerable discussion with Mr. Hamon to see if there were any other variations to the proposal he made. The Council also discussed the collection of the commercial accounts by Moore Industrial rather than the city and the city losing the 5% service fee. There was further discussion by the City Council on the Council -appointed committee's recommendation to go out for bids on solid waste collection, the use of a consultant to determine the appropriate rate structure, resolving matters on the contents of the contract document, and granting a 60 -day extension of notification period of the present contract in order to work out further negotiations with Moore Inudstrial Disposal. There was discussions by the Council with city staff regarding the use of the consultant in this rate increase request or using those services during the bidding process. There was further discussion on the amount of rate increase request that was requested by Moore Industrial and what the city was agreeable to granting, and what the Council -appointed committee's recommendation actually meant. Consider Action Regarding City of Allen Contract for Solid Waste Collection and Disposal (Agenda Item V) There was further discussion by the Council on the meaning of the city's current contract regarding two more years of the contract with Moore Industrial Disposal, and with the City Manager on the extension of the notification period and what he plans to accomplish with further negotiations and getting a legal opinion on the two-year extension of the contract. At this time, Don Hamon, with Moore Industrial Disposal, made an official statement to the City Council as follows: "As a representative of Moore Industrial Disposal and on behalf of the President, Steve Moore, Moore Industrial Disposal, Inc., will grant a 60 -day extension of the notification period." SIS ALLEN CITY COUNCIL CALLED - SPECIAL SESSION & WORKSHOP AUGUST 28, 1986 Page 3 Consider Action Regarding City of Allen Contract for Solid Waste Collection and Disposal (cont'd) (Agenda Item V) MOTION: Upon a motion made by Councilman Wilson and seconded by Councilman Womack, the Council voted 6 - 0 in favor of authorizing the extension of the notification period in the contract with Moore Industrial Disposal, Inc., for a period of 60 days; and to authorize the City Manager to continue with negotiations regarding rates and contract terms. The motion carried. Items of Interest to the Council This item was passed over at this time as there were no items of interest. Adjournment MOTION: Upon a motion made by Councilman Womack and seconded by Councilman Wilson, the Council voted 6 - 0 to adjourn the called - special session and workshop of the Allen City Council at 11:52 p.m, on Thursday, August 28, 1986.
