Min - Planning and Zoning Commission - 1987 - 03/26 - RegularALLEN PLANNING & ZONING COMMISSION an REGULAR MEETING MARCH 26, 1987 ATTENDANCE: Commissioners Present: Ken Browning, Chairman Wayne Armand, Vice -Chairman Eileen Karlsruher, Secretary Charles Lee Commissioners Absent: Carolyn Latimer John Garcia City Staff Present: Sally Leeper, Secretary Tom Keener, Development Coordinator CALL TO ORDER: The Allen Planning & Zoning Commission was called to order at 7:30 p.m. on March 26, 1987, by Chairman Browning at the City Council Chambers, Allen Municipal Annex, One Butler Circle, Allen, Texas. Approve Minutes March 12. 1987 (Agenda Item II) Chairman Browning read the agenda item into the record as follows: "Approve minutes of March 12, 1987, Regular meeting." MOTION: Upon a motion by Commissioner Armand and a second by Commissioner Lee, the Commission voted 4 FOR and 0 OPPOSED to approve the minutes of March 12, 1987, as presented. The motion carried. 11 LIr I ALLEN PLANNING & ZONING COMMISSION MARCH 26, 1987 PAGE TWO Public Hearing Allen Church of Christ (Agenda Item III) Chairman Browning read the agenda item into the record as follows: "Public Hearing - Consider a request by Allen Church of Christ for a Specific Use Permit to allow a church facility in the existing Bethany Plaza Shopping Center building. This tract of land is known as the Bethany Plaza Addition to the City of Allen in the William Perrin and R. Sewell Survey, Abstract No. 708, and Abstract No. 875, Collin County, Texas, further described as being located at 717 S. Greenville, Allen, Texas. This property is currently zoned "SC" Shopping Center." Mr. Don Webb, representing the Allen Church of Christ, presented the request to the Commission. He stated their services would be held on Sundays from approximately 9 - 11:00 a.m., and 5 - 6 p.m., Wednesdays from 7:30 - 8:30 p.m. They are requesting a specific use permit that would apply only for the length of time they are occupying the property and expire with their tenancy. He stated that they recognized the need of adjacent businesses to maintain parking for their customers. Chairman Browning opened the public hearing. Mr. Roderick Rabideaux, owner of Party Plus, Suite 118 at Bethany Plaza Shopping Center, questioned the procedures involved in obtaining a Specific Use Permit, and the time limit that would accompany the Specific Use Permit. Be mentioned his concerns for parking for his customers if he should remain open on Sundays or late on Wednesdays. Mr. Elliott Kruitzfield, representing Ultimate Look, also a tenant in the Bethany Plaza Shopping Center, questioned the parking situation. Mr. James Nelson, representing the Allen Church of Christ, stated that the church would propose that the parking spaces in the front of the businesses in question would be left open during church services. He added that this is a temporary location for the church. Mr. Tom Keener added that there is a maximum occupancy of 285 for this lease space placed by the fire marshal, which would limit the number of vehicles. (Agenda Item III) Chairman Browning read into the record a letter from Mickey Christakos, and it is attached hereto and made a part hereof. She indicated she is in favor of the request. Chairman Browning closed the public hearing. The Commission discussed the parking question. Mr. Keener noted that the Specific Use Permit has been requested to end with the tenancy of the church. The fire marshal has made recommendations which will be controlled through the permitting process at the time the permit is issued for the remodeling of the lease space. He added that a church is an allowed use in a shopping center with a Specific Use Permit, and the question is whether this particular church is compatible with this particular shopping center. Commissioner Armand stated that he did not feel the parking would be a significant problem, especially considering that the proponent has volunteered to keep the first line of parking open for the retail businesses. Commissioner Karlsruher stated she has no problem with the parking; but feels that the traffic from the church will be beneficial to the center. Commissioner Lee stated he feels the occupancy will be good for the center and added that the proponent has stated that this is a temporary situation. MOTION: Upon a motion by Commissioner Armand and a second by Commissioner Karlsruher, the Commission voted 9 FOR and 0 OPPOSED to approve the request with the modifi- cation that the church will request their parishioners not to park in the first line of parking spaces to the abutting property owners, and to include that this Specific Use Permit will terminate when this Allen Church of Christ vacates the property. The motion carried. Findings: 1. Due to some questions being raised by other tenants, the church will request their parishioners not to park in the first line of parking spaces. 1 ALLEN PLANNING & ZONING COMMISSION MARCH 26, 1987 PAGE FOUR Public Hearing Allen Church of Christ (Cont.) (Agenda Item III) 2. Notwithstanding the compromise on the parking, there should not be any overlap on parking times between businesses unless tenants start opening on Sunday morning. 3. The lease could ease the tax burden of all tenants. Final Plat Folsom -English R.O.W. (Agenda Item IV) Chairman Browning read the agenda item into the record as follows: "Final Plat - Consider final plat approval for Folsom -English for .095 acres of land for right-of- way dedication on a strip of land out of a 6.82 acre tract of land as shown on a Replat of Cottonwood Creek Village Shopping Center, prepared by Ferguson Deere, Inc. and recorded in Cabinet D/105 of the Deed Records of Collin County, Texas, said tract being situated in the Peter Wetsel Survey, Abstract No. 990 in the City of Allen, Collin County, Texas; further described as being north of F.M. 2170 and west of S.H. 5." Mr. Keener advised the Commission that this plat reflects right-of-way which is needed for the reconstruction of S.H. 5. MOTION: Upon a motion by Commissioner Karlsruher and a second by Commissioner Lee, Commission voted 4 FOR and 0 OPPOSED to approve agenda item IV. The motion carried. Final Plat Folsom -English R.O.W. (Agenda Item V) Chairman Browning read the agenda item into the record as follows: "Final Plat - Consider final plat approval for Folsom -English for .069 acres of land for right-of- way dedication on a strip of land out of a 6.444 acre tract of land as shown on a Plat of Cottonwood Creek Village Phase 2, prepared by Ferguson Deere, Inc. and recorded in Cabinet C/82 of the Deed Records of Collin County, Texas, said tract being situated in the Peter Wetsel Survey, Abstract No. 990, in the City of Allen, Collin County, Texas; further described as being north of F.M. 2170 and west of S.H. 5." MOTION: Upon a motion by Commissioner Armand and a second by Commissioner Karlsruher, the Commission voted 4 FOR and 0 OPPOSED to forward the Schedule of Uses to City Council for review with the modification that Fitness Center and Health Studio be cross-referenced. The motion carried. Mr. Keener advised that Bill Petty will take this item to the City Council at their next meeting and request a joint workshop meeting date. The Commission suggested the following dates: April 13, April 14, April 20, April 30, 1987. Mr. Keener advised the Commission of the upcoming agenda. (Agenda Item V) Mr. Keener advised the Commission that this plat reflects right-of-way which is needed for the reconstruction of S.H. 5 MOTION: Upon a motion by Commissioner Lee and a second by Commissioner Armand, the Commission voted 4 FOR and 0 OPPOSED to approve Agenda Item V. The motion carried. Discussion Item Comprehensive Zoning Ordinance (Agenda Item VI) Chairman Browning read the agenda item into the record as follows: "Discussion of recommended changes to the Comprehensive Zoning Ordinance." In reviewing the Schedule of Uses, the Commission suggested that the uses of "Fitness Center" and "Health Studio" be cross-referenced to clarify the terminology. They further discussed making the uses of Fitness Center and Health Studio allowable in the same districts as Incidental Uses and Retail Uses. MOTION: Upon a motion by Commissioner Armand and a second by Commissioner Karlsruher, the Commission voted 4 FOR and 0 OPPOSED to forward the Schedule of Uses to City Council for review with the modification that Fitness Center and Health Studio be cross-referenced. The motion carried. Mr. Keener advised that Bill Petty will take this item to the City Council at their next meeting and request a joint workshop meeting date. I own a business in Bethany Plaza Shopping Center. I regret that I could not attent the public hearing tonight to express my interest in the special use permit for the Allen Church of Christ. Please accept this letter in my absence. It is my hopes that you will grant this permit to this congregation as it is acceptible for a Special Use Permit in a Shopping Center space. It is also my opinion that the Church would be a compatible tenant with the other businesses in the center. Four of the five businesses are service oriented. I am concerned about signs of a failed business in our center. I believe the Allen Church of Christ will bring health activity which we are all in need of. I know they will make efforts to allow for adequate parking for the other businesses open on Sundays and Wednesday evenings. Lastly I would like to say; in a growing community such as Allen we will all be asked to make special concession from time to time. Please take this one under careful consideration. For the members of the commission that do not know, I am a member of the Allen Church of Christ. Thank you for allowing me to be heard.
