CALL TO ORDER AND ANNOUNCE A QUORUM:
With a quorum of the Commissioners present, the Allen Planning & Zoning Com-
mission was called to order at 7:32 p.m. by Chairman Garcia at the Allen Municipal
Annex, City Council Chambers, One Butler Circle, Allen, Texas.
Approve Minutes
August 28, 1992 (Agenda Item II)
Chairman Garcia read the agenda item into the record as follows:
"Approve minutes of August 28, 1992, Regular Meeting."
MOTION: Upon a motion by Commissioner Gallagher and a second by Commis-
sioner Crume, the Commission voted 7 FOR and 0 OPPOSED to ap-
prove the minutes of August 28, 1992, as presented.

Tabled Item
Request for Senior Citizen Day Care (Agenda Item III)
Chairman Garcia read the agenda item into the record as follows:
"Tabled Item - Consider recommendation of subcommittee regarding request
for New and Unlisted Use of 'Senior Citizen Day Care'."
MOTION: Upon a motion by Commissioner Biggs and a second by Commissioner
Kelley, the Commission voted 7 FOR and 0 OPPOSED to remove
Agenda Item III from the table.
Commissioner Biggs stated that he had requested Fire Marshal Gillis to provide
information regarding this issue. Mr. Gillis provided information regarding the
Life Safety Code of the National Fire Protection Association for senior day care in
the home. He stated that the Association makes no difference between the adult
and the child regarding day care. The Department of Human Resources (DHR)
has no requirements for adult day care. He stated that he would review the same
types of safety items for adult day care as he would for child care.
Commissioner Biggs questioned whether children were more difficult to take care
of than children. Mr. Gillis stated that the occupants would need to be able to
+ exit the house on their own, and that they could not be confined to a bed as in a
nursing home situation. He stated that there are a number of homes registered
with DHR as home care givers for children; however, they do not register adult
home care givers. He provided information that DHR uses for inspection of child
home care givers.
Commissioner Biggs stated that he feels that adults are no different from chil-
dren, and should not be discriminated against. He suggested an inspection
should be required to be certain that the facilities are appropriate.
Commissioner Kelley discussed the need for the Fire Department to be aware of
any homes that are taking care of adults and inspections should be made.
Mr. Gillis stated that removal of adults from a burning house would be about the
same as for a child, except for body size. He would suggest that the home
conduct regular fire drills, and that if a home or nursing home keeps adults
overnight, then it should be sprinklered.
Discussion was held regarding the differences between fire codes and zoning
codes regarding home occupations.
Commissioner Biggs suggested that the issue be returned to the subcommittee for
additional recommendations.
MOTION: A motion was made by Commissioner Crume to table this item. With
' no second to the motion, Commissioner Crume withdrew the motion.

Further discussion was held regarding the following issues:
1. DHR has no information to offer regarding this issue.
2. Zoning and life safety are different issues.
3. Should the use be allowed by right or by Specific Use Permit.
4. There are set requirements for home care for children; none for adults.
5. Life Safety Code addresses the safety issue.
6. Possibly the guidelines for child home care could be used with revisions to
cover adult day care.
7. The Commission requested copies of the regulations for home care for
children.
8. It was suggested that staff request that the State develop guidelines in this
regard.
9. The DHR does not police these home.
MOTION: Upon a motion by Commissioner Gallagher and a second by Commis-
sioner Crume, the Commission voted 6 FOR and 1 OPPOSED to table
the agenda item for further consideration by the subcommittee.
Preliminary Plat
Heritage Heights Addition (Agenda Item IV)
Chairman Garcia read the agenda item into the record as follows:
"Preliminary Plat - Consider Preliminary Plat approval for Heritage Heights
Addition for Intermandeco, Inc., being 14.78 acres out of the R. C.
Whisenant Survey, Abstract No. 1012, City of Allen, Collin County,
Texas."
Mr. Warren Corwin, Corwin Engineering, presented the plat to the Commission.
Mr. Keener stated that staff recommends approval of the plat. Engineering has
been approved. Mr. Corwin stated that Heritage Circle as shown on the prelimi-
nary plat will be renamed because staff has advised that the City already has a
street by this name.
MOTION: Upon a motion by Commissioner Biggs and a second by Commissioner
Fulk, the Commission voted 7 FOR and 0 OPPOSED to approve the
preliminary plat for Heritage Heights Addition with the stipulation
that the street names be corrected subject to staff approval.

Other Business
Mr. Keener reviewed the zoning analysis that the Commission will be using in the
upcoming zoning cases.
Subdivision Ordinance Review
Consideration of the Subdivision Ordinance was delayed until the next meeting.

MOTION: Upon a motion by Commissioner Crume and a second by Commissioner
Fulk, the Commission voted 7 FOR and 0 OPPOSED to adjourn the
September 10, 1992, meeting of the Planning & Zoning Commissioner
at 9:10 p.m.
