Approve Minutes September 28. 1995 (Agenda Item II) Chairman Fulk read the agenda item into the record as follows: "Approve minutes of September 28, 1995, Regular Meeting." MOTION: Upon a motion by Commissioner Bartlemay and a second by Commissioner Heller, the Commission voted 7 FOR and 0 OPPOSED to approve the minutes of September 28, 1995 PLANNING & ZONING COMMISSION PAGE 2 OCTOBER 12, 1995 Approve Minutes October 5. 1995 Chainnan Fulk read the agenda item into the record as follow: "Approve minutes of October 5, 1995, Workshop Meeting. MOTION: Upon a motion by Commissioner Heller and a second by Commissioner Bartlemay, the Commission voted 7 FOR and 0 OPPOSED to approve the minutes of October 5, 1995 as corrected. Update (Agenda Item V) Chairman Folk read the agenda item into the record as follows: "Update City Council/AISD Board Meeting Related to Ordinance Changes." Mr. Bill Petty presented information to the Commission regarding the recent Allen Independent School District (AISD) and City Council Joint Communication Plan with regard to the need to assist the AISD to secure future school sites. He discussed the three ordinances that will be amended by the City Council at their October 19th meeting: 1) Comprehensive Plan, 2) Comprehensive Zoning Ordinance; and 3) Subdivision Ordinance. Final Plat Wood Addition (Agenda Item VI) Chairman Fulk read the agenda item into the record as follows: "Final Plat - Consider final plat approval for Wood Addition, a replat of Lot 1 and all of Lot 2, Block A, Original Town of Allen, Collin County, Texas, being a 47,290 -square foot tract of land recorded in Volume 6, pages 152 and 153 of the Collin County Deed Records; further described as being located north of the northwest corner of Allen Drive and Coats Drive." Mr. Tom Keener presented the final plat to the Commission. He stated that it represents a replat of property lines in the Central Business District The Technical Review Committee (TRC) has reviewed and approved this plat, and staff recommends approval as submitted MOTION: Upon a motion by Commissioner Biggs and a second by Commissioner Banlemay, the Commission voted 7 FOR and 0 OPPOSED to approve the final plat for the Wood Addition 1, PLANNING & ZONING COMMISSION PAGE 3 OCTOBER 12,1995 Preliminary Plat Momingside Addition (Agenda Item VIII Chairman Fulk read the agenda item into the record as follows: "Preliminary Plat - Consider preliminary plat for Morningside Addition, being a 139.1 -acre tract of land in the Peter Fisher Survey. Abstract No 324. Collin County, City of Allen, Texas; further described as being located at the northwest comer of Main Street and Malone Road " Mr. Keener presented the preliminary plat to the Commission. The Technical Review Committee has reviewed and approved this request, and staff recommends approval as submitted. Commissioner Biggs questioned whether sidewalks would be constructed along F.M. 2170 and Mr. Keener advised that they would be. Commissioner Biggs further questioned the treatment of the cul-de-sacs at F.M. 2170 and if alternative transportation access would be provided through these cul-de-sacs to F.M. 2170. Mr Sam Wyse, P.O. Box 836252, Richardson, TX 75083, advised that there is a 15 -foot landscape easement provided along F.M. 2170, along with the necessary right-of-way dedication for the expansion of F.M. 2170. This 15 -foot landscape easement is intended to deny access to F.M. 2170 from the cul-de-sacs. Commissioner Biggs clarified the fact that his concern related to the recently reviewed Alternative Transportation Report, which has not yet been adopted by the City Commissioner Kelley questioned the possibility of access to the existing Curtis Middle School. Mr. Wyse suggested that access through Malone Road was appropriate and in conformance with the AISD's desires during the zoning process. Commissioner Crume wanted access to the middle school from this subdivision. Mr. George Conner advised that the proponent will be required to construct 24 feet of pavement on Malone Road with a sidewalk. He added that the school administration had requested that their property be restricted from access. He indicated that they had in fact requested that the property be fenced. Commissioner Crume further requested a 5 -foot easement be provided for access to the school site. Mr. Wyse stated that he felt it inappropriate to answer this request since he had been advised by the school that they did not want access from this subdivision directly to the school site. It was discussed that this issue should be discussed with the AISD. Chairman Fulk questioned whether the AISD representative on the TRC has addressed this issue. Mr. Keener advised that the AISD representative was not present at the meetings when this preliminary plat was discussed, but had received an agenda and minutes of those meetings. PLANNING & ZONING COMMISSION PAGE 4 OCTOBER 12, 1995 Preliminary Plat Mornineside Addition (Cont.) (ABenda Item VIII Commissioner Kelley requested that some of the opposing alleys be rearranged, especially on Summertree between Surridge and Windsong. Mr. Wyse discussed this issue and indicated that the proposed design is the most desired by sanitation departments. Chairman Fulk suggested that some of the alleys have multiple access points, and he feels that some of these could be eliminated. Mr. Keener advised that a traffic study was completed on this property during the most recent zoning request. The two boundaries of the middle school site do not have alleys, which is in accordance with the zoning on the property Commissioner Heller questioned whether the landscape easement was required to be irrigated, and Mr. Keener stated it was not required by zoning. Specific concerns of the Commission were: 1. Access to Curtis Middle School either along Leameadow or Autmmmnist, or both. 2. Opposing alleyways. Too many access points at the alleys. Mr. Wyse indicated that he feels it inappropriate to design access to Curtis Middle School since the AISD has indicated that they do not want access provided. Even if they do desire access, it might be difficult to provide it and still provide lots that conform to the zoning. Chairman Folk suggested that confirmation from the AISD should be obtained on this issue. Commissioner Heller requested that staff verify this issue with the AISD as a condition of the plat. Mr. Wyse stated that he could not commit to providing this access at the expense of the development. Mr. Bill Dahlstrom, 4000 Fountain Place, Dallas, stated that he does not feel that this access question is a requirement of the Subdivision Ordinance; however, they me willing to discuss the issue with the AISD. He stated that the access would be provided by final plat if the school needs it. Mr. Rick Feller, P O. Box 93330, Anchorage, Alaska 99509, stated he had no problem with attempting to reach agreement with the AISD. He stated that they would endeavor to do this; however, he is hesitant to have this mandated because this would affect the value of at least two lots. Mr. Feller added that his concern is that the AND might request something beyond the point of reason, and that this would hold the approval of the final plat. PLANNING & ZONING COMMISSION PAGE 5 OCTOBER 12, 1995 Preliminary Plat Morningside Addition (Cont.) (Agenda Item VITT Mr. Petty suggested that staff will need clarification of the desires of the Commission at the time of final plat. He suggested that minimum criteria be established for such access. Mr. Feller stated that he agrees to access being located upon mutual agreement; it be a maximum 5 feet in width, and that the AISD would build it. Commissioner Crume requested that access points be considered on both the west and south sides of Curtis Middle School. Mr. Feller stated he would agree to this. Mr. Wyse stated that if an alley access point can be eliminated, they would agree to that. As to opposing alleys, this would be difficult to determine until final calculations are made. He indicated that they will attempt to address these issues. MOTION: Upon a motion by Commissioner Crume and a second by Commissioner Obemneyer, the Commission voted 7 FOR and 0 OPPOSED to approve the request with the agreement that the proponent will provide access to Curtis Middle School from Autuainmist Drive and Leameadow Drive, if the Allen Independent School District indicates a desire for this access within 30 days from the date the proposal is presented to them, to a maximum of 5 feet in width at each point, constructed by the AISD; the proponent will attempt to reduce the number of alley access points to the residential streets and reduce as many opposing alleys as possible at the time of final plat, recognizing that traffic safety must be preeminent, and allowing staff flexibility to work with the proponent. I PLANNING & ZONING COMMISSION PAGE 6 OCTOBER 12, 1995 Preliminary Plat Twin Creeks 3A 3B 2D Chairman Fulk read the agenda item into the record as follows: (Agenda Item VIII) "Preliminary Plat - Consider preliminary plat for Twin Creeks 3A, 3B, 21), being 25.38 acres out of the lames W Parsons Survey, Abstract No. 704 in the City of Allen, Collin County, Texas, further described as being located west of Alma Drive and north of Twin Creeks Phase 2C." Mr. Keener presented the preliminary plat to the Commission The TRC has reviewed and approved the proposal and staff recommends approval. The length of the cul-de-sacs was confirmed to be in accordance with the zoning requirements. It was indicated that Granger is a 60 -foot collector street. MOTION: Upon a motion by Commissioner Biggs and a second by Commissioner Bartlemay, the Commission voted 7 FOR and 0 OPPOSED to approve the preliminary plat for Twin Creeks 3A, 3B, and 2D. Final Plat Twin Creeks 3B Chairman Fulk read the agenda item into the record as follows: (Agenda Item IX) "Final Plat - Consider final plat for Twin Creeks 313, being a 6.641 -acre tract of land situated in the lames W Parsons Survey, Abstract No. 704, in the City of Allen, Collin County, Texas: further described as being located west of Alma Drive in the Twin Creeks Addition." Mr. Keener presented the final plat to the Commission. The TRC has reviewed and approved the request, and staff recommends approval. MOTION: Upon a motion by Commissioner Heller and a second by Commissioner Crume, the Commission voted 7 FOR and 0 OPPOSED to approve the final plat for Twin Creeks Phase 3B. PLANNING & ZONING COMMISSION PAGE 7 OCTOBER 12, 1995 Final Plat Beacon Hill Phase 1 (Agenda Item IX) Chairman Falk read the agenda item into the record as follows: "FInal Plat - Consider final plat for Beacon Hill Phase 1, being a 56.759 -acre tract of land out of the James W Parsons Survey, Abstract No. 704, City of Allen, Collin County, Texas, further described as being northwest of the northwest corner of McDermott Drive and Alma Drive." Mr. Keener presented the final plat to the Commission. The right-of-way dedication for Alma Drive to the south of this property to F.M. 2170 will be dedicated. The Alternative Transportation path to facilitate bicycling access to the Green Elementary School and park is included on this final plat. Commissioner Crume questioned the parking situation on Am's Way This was addressed at the time of zoning, and the decision was that it would be appropriate for the City to act upon this issue. Ann's Way is shown as a 60 -foot right-of-way (not a collector street) in order to facilitate parking along this roadway Commissioner Kelley mentioned that the redesign of opposing alleys is noted and appropriate. Commissioner Crume questioned the disposition of the trees in the area of Mystic Cove and the proponent indicated that these trees are being provided for by using mulch, retaining walls, wells, etc. Commissioner Heller questioned whether a sidewalk would be provided on the east side of Beacon Hill Drive north of F.M 2170 and adjacent to the Mutli-family tract, and staff indicated that there will not be a sidewalk in this area. MOTION. Upon a motion by Commissioner Biggs and a second by Commissioner Heller, the Commission voted 7 For and 0 OPPOSED to approve the request for Beacon Hill Phase 1. I Zoning Ordinance (Agenda Item XI) Chairman Fulk read the agenda item into the record as follows: "Review of Comprehensive Zoning Ordinance." The Commission indicated that they would continue this item at a workshop meeting set for Tuesday, October 17, 1995, at 7:00 p.m. The agenda will include completion of the review of definitions, and a general cleanup of the full ordinance.
