I PLANNING & ZONING COMMISSION MARCH 27, 1997 PAGE 2 Consent Agenda (Agenda Item H) Chairman Fulk read the consent agenda into the record as follows: "A Approve minutes of March 13, 1997, Regular Meeting." MOTION Upon a motion by Commissioner Obermeyer and a second by Commissioner McGregor, the Commission voted 4 FOR and 0 OPPOSED to approve the Consent Agenda. Tabled Item Custer/Hedgcoxe. L.L.C. (Agenda Item III) Chairman Falk read the agenda item into the record as follows: "Tabled Item - Consider a request by Custer/Hedgcoxe, L.L.C. to zone 25 573 acres of land located in the John Huffman Survey, Abstract no. 416, City of Allen, Collin County, Texas, from Agriculture -Open Space to Planned Development zoning with single-family residential uses." MOTION. Upon a motion by Commissioner McGregor and a second by Commissioner Kelley, the Commission voted 4 FOR and 0 OPPOSED to remove Agenda Item III from the table Ms. Marcie Diamond reviewed the request as discussed previously The request represents the same use and area requirements as assigned to Planned Development No. 57, adjacent and to the west of this property Discussion was held by the Commissioners regarding the location of the open space, and circulation and access to the school The applicant has submitted a letter from the Plano ISD stating that a collector system will be in place before opening of school. The proponent has committed to increasing the open space in Planned Development 57 to 7.6 acres Ms. Diamond presented a proposed concept plan. She explained that a preliminary plat cannot be submitted until the zoning is consummated. Open space area will have no covered structures. There will be no club house or recreation center located in this area It will include a pool, cabana, and open recreation only Chairman Falk questioned traffic issues regarding old Custer Road Mr. Pat Atkins, Tipton Engineering, discussed the proposed increase in open space in PD 57 He stated that the adopted zoning requires playground equipment, a trail system, and a basketball court. He added that the proponent also plans to include a swimming pool and cabana. No recreational facilities other than these will be included. He added that a preliminary plat including the remainder of PD 57, as well as this property, will be submitted as soon as possible following the adoption of this zoning request Mr. Atkins stated that the orientation of the school site will be to the collector system, not from Hedgcoxe. He will review this requirement with the Plano ISD Regarding Custer Road, Mr. Atkins reviewed the new roadway alignment of Custer Road, and the fact that old Custer will become a collector street. Ms. Diamond indicated that staff is satisfied with the proposal at this time. Mr. George Conner indicated 1 that Custer Road is scheduled for construction at approximately the same time as McDermott Drive. (Agenda Item IID Chairman Fulk reviewed his concerns regarding density Commissioner Smith questioned whether there would be a homeowner's association to maintain the open space and whether all citizens of Allen would have access to the pool area Mr. Atkins stated that this property will be maintained and owned by the homeowner's association; not open to the entire City He noted that he was aware that the project represents a density over that recommended by the Comprehensive Plan; however, he feels he has met the criteria established by the Commission at previous meetings. They have lost 26 lots in the existing PD 57 through the school site and the additional open space Ms. Diamond reviewed information provided in the packet regarding Neighborhood District No. 20. This district is over the Comprehensive Plan by only 15 %. MOTION: A motion was made by Commissioner Bartlemay and seconded by Commissioner Kelley to approve the request as presented. Commissioner Oberrneyer questioned information in a previous memo regarding the 1 % acres of open space that is needed. Ms. Diamond indicated that this is satisfied with the additional open space being dedicated in PD 57 as requested by the Commission. There was a concern expressed regarding not allowing curb cuts on Hedgcoxe to serve the school site The Commission voted 5 FOR and 1 OPPOSED, with Chairman Falk opposed, and the motion carried. MAJORITY FINDINGS. 1. The request conforms with the existing PD 57 2. The density is high, but appropriate in order to allow a proper Bow of the existing development. 3. The City is able to obtain open space contiguous within both developments (this request and PD 57) 4. Given the unique shape of this property, the difficulty of flow with the existing PD was an overriding factor. 5. Plano ISD has agreed to this site and purchased the property as a location for a school. 6. Access to the school will be through a collector street system. MINORITY FINDINGS. L Density is excessive compared to the Comprehensive Plan The Neighborhood District is already projected to be well in excess of the Plan and maintaining the high density in this district is contradictory to the goals of the Plan. PLANNING & ZONING COMMISSION r MARCH 27, 1997 PAGE 4 Tabled Item Tomlin Properties (Stacy/Malone) (Agenda Item VI) Chairman Fulk read the agenda item into the record as follows "Public Hearing - Consider a request by Tomlin Properties to zone 57 703 acres of land located in the J J. Miller Survey, Abstract No 609, City of Allen, Collin County, Texas, from Agriculture -Open Space to Planned Development -Shopping Center and Planned Development - Residential; further described as being located at the southeast comer of Stacy Road and Malone Road." Chairman Fulk read the attached letter from Mr. Robert Porter into the record requesting that the submission be withdrawn No action was taken and this request will be removed from the agenda. Chairman Fulk advised the Commissioners that he had visited with Mr. Porter and he had made a verbal commitment to a 3.0 dwelling units/acre request This property is located in the Lovejoy ISD He added that the property to the south includes plans for a neighborhood park, and may be included in a future submission. The Commissioners requested copies of the amended pages to the Comprehensive Plan showing elementary and middle schools OTHER BUSINESS. Ms. Diamond reviewed the tentative agenda Mr. Conner indicated he had attended a condemnation hearing on right-of-way for McDermott Drive on the Suncreek property and the right-of-way had been obtained. Commissioner McGregor requested information about allowing basketball goals in the City right-of-way Mr Conner advised that he would respond to a complaint. Commissioner Bartlemay questioned the new lights at the Winn Dixie parking lot and whether they are in conformance with the new ordinance. Staff advised that they would inquire with Code Inspections and respond. The Commissioners discussed the lighting ordinance with reference to decorative lighting such as is in Watters Crossing. Mr Conner indicated that the owners of the new Suncreek Addition are being required to use shielded fixtures, and the Commission indicated that the ordinance allows for decorative lighting under certain circumstances. Commissioner Smith apologized for being late, but explained that she had a Flat tire. Copies of the material are available for review, and Ms. Diamond is preparing a synopsis of the class.
