PLANNING & ZONING COMMISSION SEPTEMBER 11, 1997 PAGE 2 Consent Agenda (Agenda Item 1Il Acting Chairman Obermeyer read the consent agenda into the record as follows: "Consent Agenda A. Approve Minutes of August 28, 1997, Regular Meeting. B. Final Plat - Consider a Final Plat of Twin Creeks IVB for Twin Creeks Partners, L.P., being 60.232 acres out of the Catherine Parsons Survey, Abstract No. 711, City of Allen, Collin County, Texas, further described as being east of Alma Drive and north of Twin Creeks IVA C. Final Plat - Consider a Final Plat of Allen Office Center Addition for Cardinal Allen Enterprise, Inc. being 8.747 acres situated in the William Perrin Survey, Abstract No. 708 and the Michael See Survey, Abstract No. 543, City of Allen, Collin County, Texas; further described as being located at the southeast comer of Bethany Drive and U.S. 75." MOTION: Upon a motion by Commission Member Bartlemay, and a second by Commission Member McGregor, the Board voted 5 FOR and 0 OPPOSED to approve the Consent Agenda as presented. Tabled Item Allen Central. Ltd (Agenda Item III) Acting Chairman Obermeyer read the agenda item into the record as follows: "Tabled Item - Consider request from Allen Central, Ltd. to amend Planned Development No. 55 to include an additional 12.8898 acres in Tract 4 (Commercial/Office) and to incorporate the existing 0.65 acres of Tract 5 (Linear Park) into Tract 4 (Commercial/Office), being 13 5488 acres of land out of the Catherine Parsons Survey, Abstract No. 711, and the Michael See Survey, Abstract No. 543; further described as being located south of McDermott Drive and west of Angel Drive." MOTION: Upon a motion by Commission Member Bartlemay and a second by Commission Member Smith, the Commission voted 5 FOR and 0 OPPOSED to remove Agenda Item III from the table. Ms. Diamond presented the request to the Commission. It should be noted that the public hearing on this request was held at the August 28, 1997, meeting, and the proponent requested the item be tabled. The property was zoned in 1994, combining portions of PD 8 and PD 26 into PD 55 This 13.6 -acre property was a leaveout at that time as it was under different ownership. The requested zoning is consistent with the existing requirements of PD 55 except that a modification is being requested to allow a florist and garden (outdoor) in Tract 4 only A new traffic study was completed and the proponent has agreed to all of the consultant's recommendations. The request is in accordance with the Comprehensive Plan. PLANNING & ZONING COMMISSION SEPTEMBER 11, 1997 PAGE 3 Acting Chairman Obermeyer asked if anyone in the audience was interested in addressing this request. Mr. Dave Dennison, Allen Central Joint Venture, 8100 Lomo Alto, Dallas, spoke in favor of the request. This property has been acquired recently by Allen Central Joint Venture and they are requesting to be included in the planned development. Commission Member McGregor questioned the timing of the traffic signal at Angel and McDermott. Mr. Dennison and Ms. Diamond indicated it will be constructed prior to issuance of a certificate of occupancy on the occupancy which exceeds 200,000 square feet. He provided the Commission with a proposed concept plan of the center. The proponent is requesting that City Council abandon Angel Drive, which will then become a private drive to the center. All utilities will be retained within easements. Commission Members discussed the number of traffic lights planned for this area of McDermott. MOTION: Upon a motion by Commission Member McGregor and a second by Commission Member Smith, the Commission voted 5 FOR and 0 OPPOSED to approve the request by Allen Central, Ltd. as presented. C FINDINGS. 1 The use is consistent with the Comprehensive Plan. 2. Traffic recommendations have been agreed to. 3 The proponent has provided for optimum traffic flow 4 The traffic signal at Angel and McDermott will be provided at the appropriate time. Vacation Plat Lots 4-7, Block A. and alley. Suncreek I, Tract 3 (Agenda Item IV) Acting Chairman Obermeyer read the agenda item into the record as follows: "Vacation Plat - Consider a vacation plat for Lots 4 through 7, Block A, and adjacent alley right-of-way in Suncreek I, Tract 3, for Bon Terre -B, Ltd , being 0.868 acres out of the Joseph H. Wilcox Survey, Abstract No. 1017, City of Allen, Collin County, Texas; further described as being located south of McDermott and east of Suncreek Drive." I I PLANNING & ZONING COMMISSION SEPTEMBER 11, 1997 PAGE 4 Public Hearing Replat - Portion of Suncreek I Tract 3 (Aeenda Item Vl Acting Chairman Obermeyer read the agenda item into the record as follows: "Public Hearing - Consider a replat of a portion of Suncreek 1, Tract 3, being lots 34R -36R and 45R -49R, Block A, for Bon Terre -B, Ltd., being 1.971 acres out of the Joseph H. Wilcox Survey, Abstract No. 1017, City of Allen, Collin County, Texas; further described as being located south of McDermott Drive and east of Suncreek Drive." Preliminary Plat Suncreek 11, Tract 3. Phase 2 (Agenda Item VI) Acting Chairman Obermeyer read the agenda item into the record as follows' "Preliminary Plat - Consider a preliminary plat for Suncreek II, Tract 3, Phase 2, for Bon Terre - B, Ltd., being 20.409 acres located in the J H. Wilcox Survey, Abstract No. 1017, City of Allen, Collin County, Texas; further described as being located south of McDermott Drive and east of Suncreek Drive." Final Plat Suncreek II, Tract 3, Phase A LAgenda Item VII) Acting Chairman Obermeyer read the agenda item into the record as follows: "Final Plat - Consider a final plat for Suncreek II, Tract 3, Phase A for Bon Terre - B, Ltd . being 2.696 acres of land located in the Joseph H Wilcox Survey, Abstract No. 1017, City of Allen, Collin County, Texas; further described as being located south of McDermott Drive and east of Suncreek Drive " Ms. Diamond presented the above four agenda items to the Commission. The purpose of these actions is to accommodate boundary adjustments for the Allen Independent School District (AISD) property Four lots and the adjacent alley right-of-way is being requested to be vacated. The second action is a replat to accommodate the removal of the existing cul-de-sacs and replace with loop street system. The third action is a preliminary plat including the replatted area, as well as additional property. The fourth action is a final plat on additional lots to accommodate the looped street system. The Commission discussed these four agenda items Commission Member Pacheco questioned the 5 - foot TU Electric easement on the vacation plat. Mr. Joel Robuck, Bon Terre -B, indicated that it includes a street light circuit which will be abandoned. All utility companies have consented to the vacation plat. Acting Chairman Obermeyer opened the public hearing for the replat, Agenda Item V. With no one wishing to speak for or against the replat, Acting Chairman Obermeyer closed the public hearing. I E PLANNING & ZONING COMMISSION SEPTEMBER 11, 1997 PAGE 5 Commission Member McGregor discussed the Home Owner Association lots and the fact that rear access is not needed on these lots. Commission Member Pacheco questioned the fact that Virginia Drive is shown as a dead-end street into the AND property Mr. Robuck advised that this street is intended to provide access to a parking lot and the gymnasium area for the school. The main school entrance, however, will be from Tatum Drive. Commission Member Pacheco discussed the irregular shape of the lot at the northwest comer and Mr. Robuck indicated it will be a specially -designed lot and is buildable. Commission Member Pacheco discussed Lots 22 and 15. HOA lots. He questioned the plans for these lots. Mr. Robuck indicated that they will be used for an entry feature. Mr Robuck stated that any fencing along the HOA lot on Alma will be as required by ordinance. MOTION Upon a motion by Commission Member Smith and a second by Commission Member Pacheco, the Commission voted 5 FOR and 0 OPPOSED to approve the vacation plat for Suncreek I, Tract 3. MOTION: Upon a motion by Commission Member Bartlemay and a second by Commission Member Smith, the Commission voted 5 FOR and 0 OPPOSED to approve the replat for Suncreek I, Tract 3, Lots 34-36, and 45-49. MOTION Upon a motion by Commission Member Pacheco and a second by Commission Member McGregor, the Commission voted 5 FOR and 0 OPPOSED to approve the preliminary plat for Suncreek It, Tract 3, Phase 2. MOTION: Upon a motion by Commission Member McGregor and a second by Commission Member Smith, the Commission voted 5 FOR and 0 OPPOSED to approve the final plat for Suncreek 11, Tract 3, Phase A. Mr. Robuck expressed appreciation to City staff for their assistance in this complicated issue. Mr. Petty indicated that the steps followed in this process were based on legal opinion. PLANNING & ZONING COMMISSION SEPTEMBER 11, 1997 PAGE 6 Preliminary Plat Custer Hill Estates Phase B and C (Agenda Item Vlll) Acting Chairman Obermeyer read the agenda item into the record as follows: "Preliminary Plat - Consider a preliminary plat of Custer Hill Estates Phase B and C for Custer/Hedgcoxe, L.L.C., being 94.141 acres of land located in the John Huffman Survey, Abstract No. 416, City of Allen, Collin County, Texas; further described as being located north of Hedgcoxe Road and east of Custer Road." Ms. Diamond presented the preliminary plat to the Commission. There is an existing approved plat for the majority of this property This new preliminary plat represents the addition of 25 acres in PD 62. The lot widths are very close to the required zoning of 50' and approval should be contingent upon lots being 50' at the building line on the final plat. The zoning required open space of 7.6 acres; the lot count requires 7.58 acres, the original submission represented 7.3653 acres; and the current submission indicates 7 6568 acres, which is consistent with the zoning. Staff recommends approval subject to lot widths being 50' at the building line and 7.6568 acres of open space, consistent with the current lotting pattern. Ms. Diamond indicated that staff recommends approval of the preliminary plat subject to the changes reflected on the next agenda item, the final plat. Mr. Pat Atkins, Tipton Engineering, provided a revised preliminary plat showing the net open space of 7.6568 acres. Commission Member Pacheco discussed the possibility of saving the Elm trees that are located in the added open space. Mr Atkins indicated that they will be saved. Commission Member Pacheco discussed the requirements for length of alleys. The maximum is 1200 feet. He questioned the need for utility easements, and was advised that they will be added before the plat is filed of record. Mr. Atkins stated that improvements in the open space will include hike and bike trail, and the collector streets around the school will be constructed with Phase B. Mr. Conner indicated that a temporary access to Custer will need to be provided until the next phase is built. MOTION: Upon a motion by Commission Member Bartlemay and a second by Commission Member McGregor, the Commission voted 5 FOR and 0 OPPOSED to approve the preliminary plat for Custer Hill Estates Phases B and C as presented by the proponent (revised), making sure that the lot widths meet the minimum requirements at the time of final plat. PLANNING & ZONING COMMISSION SEPTEMBER 11, 1997 PAGE 7 Final Plat Custer Hill Estates Phase B (Agenda Item IXl Acting Chairman Obermeyer read the agenda item into the record as follows: "Final Plat - Consider a final plat of Custer Hill Estates Phase B for Custer/Hedgcoxe, L.L.C., being 23.9886 acres out of the John Huffman Survey, Abstract No. 416. City of Allen, Collin County, Texas; further described as being located north of Hedgcoxe Road and east of Custer Road." Ms. Diamond presented the final plat to the Commission. The final plat is consistent with zoning and the preliminary plat approved as Agenda Item VIII. Commission Member Pacheco questioned whether a temporary turn -around would be provided at the northwest and northeast corners. Mr. Conner stated that they are included on the construction plans. MOTION: Upon a motion by Commission Member Pacheco and a second by Commission Member Smith, the Commission voted 5 FOR and 0 OPPOSED to approve the final plat for Custer Hill Estates Phase B. Void Suncreek Crossing (Agenda Item X) Acting Chairman Obermever read the agenda item into the record as follows: "Consider the voiding of approved final plat of Suncreek Crossing, being 6.3064 acres of land in the Josh Butler Survey, Abstract No. 47, and the J H. Wilcox Survey, Abstract No. 1017, City of Allen, Collin County, Texas; further described as being located south of McDermott Drive between Suncreek Drive and Tatum Drive." Ms. Diamond presented the request to void Suncreek Crossing to the Commission. This is an existing final plat representing 7 lots. The proponent is requesting that this plat, which has not been filed at the County, be marked void by staff in favor of Agenda Item XI. MOTION: Upon a motion by Commission Member Smith and a second by Commission Member Bartlemay, the Commission voted 5 FOR and 0 OPPOSED to void the prior approval of Suncreek Crossing. L I PLANNING & ZONING COMMISSION SEPTEMBER 11, 1997 PAGE 8 Final Plat Suncreek Crossing Phase I [Agenda Item XIl Acting Chairman Obermeyer read the agenda item into the record as follows: "FSnal Plat - Consider a final plat of Suncreek Crossing Phase 1 for Tatum Othel, Ltd., being 2.641 acres out of the Josh Butler Survey, Abstract No. 47, City of Allen, Collin County, Texas, further described as being located south of McDermott Drive and west of Tamm Drive." Ms. Diamond presented the final plat for Suncreek Crossing Phase I to the Commission. The plat is consistent with approved zoning and staff recommends approval The Commission discussed the mutual access provided between Lots 2 and 3. Ms Diamond indicated that lot 3 will have its own driveway, but a drive will be shared between lots 1 and 2. Mr. Bill Petry indicated that this is accomplished in order to reduce the number of drives onto Tamm Drive, which is a collector street. MOTION: Upon a motion by Commission Member Smith and a second by Commission Member Pacheco, the Commission voted 5 FOR and 0 OPPOSED to approve the final plat for Suncreek Crossing Phase 1. OTHER BUSINESS. Acting Chairman Obermeyer expressed appreciation to the Commission Members for attending the joint workshop on September 6 Ms. Diamond reviewed the tentative agenda for September 25, 1997, and reminded the Commission that a joint workshop is scheduled on that date at 6'00 p.m. prior to their regular meeting. Commission Member Pacheco requested that staff review the process for amending the Subdivision Ordinance to include a requirement for distances between street intersections.
