Min - Planning and Zoning Commission - 2001 - 09/27 - RegularALLEN PLANNING & ZONING COMMISSION E SEPTEMBER 27, 2001 ATTENDANCE Commissioners Present Ross Oberneyer, Chairman Jeff McGregor, I" Vice Chair Alan Grimes Gary Caplinger Kenneth Harvey Commissioners Absent: Lauri Blake, 2"a Vice Chair City Staff Present: Marina Sukup, Director of Planning Pam Conway, Administrative Secretary Sally Leepeq Project Coordinator Dennis Abraham, Civil Engineer David Dodd, City Attorney's Office REGULAR AGENDA Call to Order and Announce a Quorum is Present: With a quorum of the Commissioners present, the Allen Planning & Zoning Commission was called to order at 7:00 p.m. by Chairman Obermeyer, at the Allen City Hall Council Chambers, 305 Century Parkway, Allen, Texas. Update on Council Action: Ms. Sukup, Director of Planning, updated the Commission on the Council discussion of the majority vote of the Commission, noting that absent a concurring vote of at least four Commissioners on any recommendation to Council, then the matter will be referred without a recommendation. Ms. Sukup stated that it underscores the importance of having all Commissioners present. Ms. Sukup reminded the Commission of the Boards and Commission dinner on November 27, 2001. She also asked that the Commission look at the Goals and Objectives of the adopted Comprehensive Plan, for purposes of updating these in the near future. Ms. Sukup announced the appointment of Robin Sedlacek to the Commission and that she would be sworn -in and present at the next meeting. Ms. Sedlacek was present in the audience and was introduced to the Commissioners. Open Commission Discussion: None PLANNING & ZONING COMMISSION SEPTEMBER 27, 2001 PAGE 2 CONSENT AGENDA I. Approve Minutes of September 13, 2001, Regular Meeting. 2. Consider a Final Plat for Summerfield Phase Two, being 50.469± acres in the John Miller Survey, Abstract No. 609, City of Allen, Collin County, Texas located east of Malone Road and north of the future extension of Exchange Parkway. 3. Consider approval of a Preliminary and Final Plat for Lot 3, Block A, of the Allen Watters L.P Addition, City of Allen, Collin County, Texas located at the southwest comer of McDermott Drive and Watters Road. Motion: Upon a motion by Commissioner McGregor, and a second by Commissioner Caplinger, the Commission voted 5 I FAVOR and 0 OPPOSED to approve the Consent Agenda. The motion carried. REGULAR AGENDA 4. Public Hearing — and consideration of an ordinance amending the Allen Land Development Code and Zoning Map, from the previous zoning of Planned Development No. 54 -Neighborhood Recreation -Private, to GO -Garden Office, for a 6.038±tract of land situated in the Alfred Slack Survey, Abstract No. 854, City of Allen, Collin County, Texas located on the north side of McDermott Drive, between Twin Creeks Drive and Wooded Lane. Ms. Sukup presented the item to the Commission and stated the property is presently part of PD 54 and adjacent to PD 88. She stated that it is a difficult site and presents some challenges due to the topography. Staff does agree with the applicant that the site is more appropriately used for something other than residential or neighborhood recreational. Ms. Sukup stated that the applicant is requesting straight zoning because there are no specific development plans at this time. Staff would support GO -Garden Office use, but only if it's done as a part of a PD and with a specific development plan in mind. Mark Donaldson, Carter & Burgess, 7950 Elmbrook Drive, Dallas, on behalf of Briar Ridge, stated that he does in fact agree with most of staff s comments. He is pleased that staff would support a Garden Office use. He presented an exhibit of the property, surrounding development, tree cover and flood plain. Their desire is to develop this property as office. They do not have enough information to develop a concept plan for a PD. He feels the Garden Office is a very compatible use with residential, and it would also serve as a buffer for residential from the road. Charles Nies, 813 Glen Rose, Allen, Briar Ridge Investments, (Twin Creeks), stated that a high-end Garden Office complex on this property overlooking the golf course would be appropriate. He stated that the elevation of the property and the slope is so great that not that much of the office would be visible from the golf course. Straight zoning versus PD 88 is not a problem for Twin Creeks Chairman Obermeyer stated that they need to work with staff and come up with some regulations so that what they want to develop is what is developed. Straight zoning does not give that guarantee. Chairman Obermeyer Opened the Public Hearing. PLANNING & ZONING COMMISSION SEPTEMBER 27, 2001 PAGE Wilma Smith, representing Mrs. Eugene McDermott, read a letter from Mrs. McDermott in opposition to the request. The letter is attached. 407 East Watson Dr., Allen, - Mrs. Smith 4701 Drexel, Dallas — Mrs. McDermott With no one else wishing to speak, the Public Hearing was closed. The consensus of the Commission was that straight zoning would not be appropriate here, and directed Mr. Nies and Mr. Donaldson to work with staff to amend the PD. David Dodd, City Attorney's Office, stated it would be better to withdraw the request and resubmit at a later date. Mr. Charles Nies requested to withdraw this case and resubmit at a later time. Other Business • Review Upcoming Agenda Items • Committee Reports Ms. Sukup and Ms. Leeper distributed the 2002-2006 CIP to the Commission. Adioum Motion: Upon a motion by Commissioner Harvey, and a second by Commissioner Caplinger, the Commission voted 5 I FAVOR and 0 OPPOSED to Adjourn the September 27, 2001 meeting at 7:55 p.m. The motion carried. EUGENE McDERMOTT NOI DREXEL DALLAS, TEXAS 15205 September 27, 2001 Planning & Zoning Commission City of Allen One Allen Civic Plaza Allen, Texas 75013 Reference: Proposed Zoning Action Zoning Case Z 4/30/01-33 (Twin Creeks GO) Dear Commissioners, I would like to strongly urge the members of this Commission to deny this change to the zoning ordinance along this stretch of McDermott Road. At present, there are already Areas at Sun Creek Drive and Custer Road intersections that provide for development such as the proposed garden office area. Adjacent areas are currently zoned for single family dwellings. This commercial area would be incompatible with a neighborhood of homes. It could also open all the frontage land along McDermott road to rezoning for commercial development in the future. It is my understanding the City is recommending denial of this rezoning as there was no use plat accompanying this request and it is my hope that your commission will concur with this denial.
