Final Plat — Consider a Final Plat for Glendover Park Phase VII. The request is 87 residential lots on 23.3701 acres of land out of the J W Parsons Survey, Abstract No. 705, City of Allen, Collin County, Texas; located south of Kingsley between City Road 146 and Scottsman Drive. Commissioner Grimes requested that Item 2, Final Plat for Glendover Park Phase VII, be removed from the consent agenda. Motion: Upon a motion by Commissioner McGregor, and a second by Commissioner Grimes, the Commission voted 6 I FAVOR and 0 OPPOSED to approve the Consent Agenda. The motion carried. REGULAR AGENDA 2. Final Plat — Consider a Final Plat for Glendover Park Phase VII The request is 87 residential lots on 23.3701 acres of land out of the J. W Parsons Survey, Abstract No. 705, City of Allen, Collin County, Texas; located south of Kingsley between City Road 146 and Scottsman Drive. The Commission discussed the larger tract of land on the west portion of this property that is not being platted and questioned the plans for this property Ms. Sukup indicated that this tract will be used as a detention pond for this development until the property to the west is developed, at which time the detention pond area will be platted into the remaining lots of Glendover VII Mr. Warren Corwin, Corwin Engineering, stated that D.R. Horton Homes will continue to own and maintain this area. Staff is assured the property will be maintained and that this is the appropriate action to take. Enforcement of maintenance would be through the Code Enforcement Division. Motion: Upon a motion by Commissioner Grimes and a second by Commissioner McGregor, the Commission voted 6 I FAVOR and 0 OPPOSED to approve the final plat for Glendover VII. The motion carried. 3. Presentation by Dr. Joe Farmer - overview of the Collin County Bond Proposition for Outdoor Education Center. Dr. Joe Farmer spoke as a citizen of Collin County and of the City of Allen regarding the 2001 bond election His presentation described the Outdoor Education Center being proposed in the election 4. Floodplain Reclamation — Consider a request by Fairview Baptist Church for Floodplain Reclamation. Mr Dennis Abraham, Civil Engineer, and Mr. Brian Bristow, Landscape Architect, presented information regarding issues related to floodplain reclamation. Mr. Abraham indicated that specific issues to be considered in any floodplain reclamation are: wetlands, channelization, rise in upstream and downstream elevations, ensuring sufficient open space, and allowing no erosive velocities. Mr. Bristow discussed issues relating to open space and trail/recreation opportunities, both planned and possible future needs. PLANNING & ZONING COMMISSION OCTOBER 25, 2001 PAGE Mr Abraham then reviewed the specific request from Fairview Baptist Church. He stated that the staff recommendation is to approve this particular request, subject to TxDOT permits. The Commission reviewed the information and noted that it was important to realize that floodplain reclamation requests must be considered on a case-by-case basis. Mr. Russell Grimes, 885 S Hwy 5, Fairview, representing Fairview Baptist Church, advised that much of the land belongs to TxDOT which will be involved in road improvements. The downstream property owners have been advised and have given them approval for this reclamation. It represents a zero impact on the downstream properties The reclamation area is intended to be maintained as passive land with no buildings to be built on it. Existing trees will be trimmed and the City's tree ordinance requirements will be met He added that there will be no reclamation on the northern side of the floodplain Mr Russell Killeen, 6217 Roaring Sprigs Drive, North Richland Hills, stated that there is no reclamation requested to the north. All reclamation is to the south of the floodplain It was noted that the detention pond will take the runoff water and channel it back to the creek. Mr. Bristow noted that the request is an isolated incident and is internal to the subject property. It does not extend to the downstream property line. There is a very small impact on trees within the reclaimed area. He added that any potential open space being lost could be replaced in the area to the north. Discussion was held regarding the method to be used to fill the reclamation area and the proponent indicated it would be clean 611 MOTIONUpon a motion by Commissioner McGregor and a second by Commissioner Caplinger, the Commission voted 6 IN FAVOR and 0 OPPOSED to approved the request for floodplain reclamation by Fairview Baptist Church subject to TxDOT permit. The motion carried. Impact Fee Study — Consider recommendation to the City Council of an ordinance amending Ordinance No. 1783-11-99 as codified in Article 11 of the Allen Land Development Code to conform to the requirements of SB 243 adopted by the 77' Legislature relating to the Capital Improvement Plan, Land Use Assumptions and Impact Fees for Capital Improvements for Water, Wastewater and Roadway Facilities. The Commission, acting as the Capital Improvement Plan Advisory Committee, is being requested to review a recommendation to the City Council regarding amendments to the impact fees pursuant to changes in State law Until a complete study is done, the maximum fees allowed are being reduced to 50% and will be payable at the time of building permit, rather than at the time of development. The maximum roadway service areas has been extended from three miles to six miles. The City's share of TxDOT projects is now recoverable through impact fees Refund provisions have been repealed. Staff s recommendation is a. Approve proposed ordinance as an mtenm measure. b Update land use assumptions and Capital Improvement Plan. c. Reduce the number of roadway service areas. d. Chairman Obermeyer questioned the need to include outside citizens in the Advisory Committee, �1 and Ms Sukup indicated that the Commission has a sufficient makeup of members to satisfy the requirements of the Allen Land Development Code MOTION: Upon a motion by Commissioner McGregor and a second by Commissioner Blake, the Commission voted 6 FOR and 0 OPPOSED to recommend approval of the ordinance and to adopt the following findings: Findings: a. Ordinance should be approved as an interim measure b Land use assumptions and Capital Improvement Plan should be updated. c. The number of roadway service areas should be reduced. d. Update fees to include TxDOT projects. e Evaluate effect of recalculation activities of other communities. Amendment to the Comprehensive Plan — Consider recommendation to the City Council of an ordinance amending the 1998 Comprehensive Plan to adopt the Consolidated Alternative Transportation and Recreational Trail Plan, and to consider amending the Allen Land Development Code to add Appendix I, Standard Construction Details — Trails. This item is information at this time. A public hearing will be noticed for the November 20, 2001, meeting E Mr. Michael Honey and Mr. Kevin Pierce, were in the audience as representatives of the Bicycle ` Plan committee. Mr. Tom Keener, Development Coordinator, and Mr. Brian Bristow, Landscape Architect, presented details of the Consolidated Alternative Transportation and Recreational Trail Plan to the Commission. Other Business • Review Upcoming Agenda Items The next agenda will include a General Development Plan for Tutor Time and a Final Plat for Fairview Baptist Church. • Committee Reports • Commissioner McGregor attended ajoint meeting with Allen Economic Development Corporation and developers regarding the property north of Stacy Road and east of the Fairview Baptist Church property along the SH 121 corridor. The committee is attempting to determine future plans for this area The consensus at this time is for the land north of Ridgeview to develop as Corridor Commercial, but consideration remains regarding the land south of Ridgeview I PLANNING & ZONING COMMISSION OCTOBER 25, 2001 PAGE 5 Adtourn Motion: Upon a motion by Commissioner Grimes, and a second by Commissioner Blake, the Commission voted 6 I FAVOR and 0 OPPOSED to Adjourn the October 25, 2001 meeting at 8:35 p.m. The motion carried.
