Motion: Upon a motion by Commissioner Harvey, and a second by Commissioner Grimes, the Commission voted 6 IN FAVOR, and 0 OPPOSED to approve the Consent Agenda. The motion carried. Reeular Aeenda Item Number 2 Public Hearing — Conduct a Public Hearing and consider a request for Specific Use Permit (SUP) No. 96 for a RestauranUPrivate Club. The property is a 1.2623± acre tract of land being Lot 2, Block A, Lowe's - Allen Addition, City of Allen, Collin County, Texas, located at 1008 W McDermott Drive, Suite 600, being the northeast comer of W McDermott Drive and Benton Drive. Mr. Hoover presented the request to the Commission. Commissioner Grimes asked about the special conditions that normally accompany this type of request. Mr. Hoover stated the ordinance lists the special conditions in Section 2. Commissioner Harvey asked if the property could handle two (2) restaurants at this location. Mr. Hoover stated that there is an agreement in place with Lowe's Home Improvement (the adjacent property owner) for the use of their parking lot for overflow puking. Chairman Caplinger opened the Public Hearing. No one spoke for or against the request. Chairman Caplinger closed the Public Hearing. Motion: Upon a motion by Commissioner Grimes, and a second by Commissioner Sedlacek, the Commission voted 6 IN FAVOR, and 0 OPPOSED to approve the request for Specific Use Permit No. 96. The motion carried. Item Number 3 Public Hearing - Consider a request for Specific Use Permit (SUP) No. 97 for a Restaurant/Private Club. The property is a 1.9196± acre tract of land being a Portion of Block 1, Lots 3, 4B, & 5 , Allen Tech Center Addition, City of Allen, Collin County, Texas, located at 604 W. Bethany Drive, Suite 107, being the northeast comer of Bethany Drive and US 75. Mr. Hoover presented the request to the Commission. Chairman Caplinger opened the Public Hearing. No one spoke for or against the request. Chairman Caplinger closed the Public Hearing. The motion carried. Item Number 4. Public Hearing - Continued — Conduct a Public Hearing and consider an ordinance granting a change in zoning on 15.459± acres of land to change the zoning from "PD" Planned Development No. 54 for Multi -family to "PD" Planned Development No. 54 to "TH" Townhome. The property is situated in the Catherine Parsons Survey, Abstract No. 711, City of Allen, Collin County, Texas, located north of McDermott Drive between Alma Drive and Watters Drive. Commissioner Harvey announced that he had a conflict of interest in this portion of the agenda and left the bench. Mr. Hoover presented the Plan to the Commission. He explained this request is unique because Of the common area in the front of the homes. Mr. Hoover stated that staff still had concerns with this request; therefore staffs recommendation was for denial. The applicant had made some changes to the plan; however they were not submitted to staff until Tuesday afternoon. Issues of concern: ➢ Parking for non-residents ➢ Maintenance of the area between the walls in the back of the homes and the right-of-way Mr. Art Anderson addressed the Commission on behalf of the applicant. Mr. Anderson presented a front elevation of the townhomes of a similar project in Lewisville. There is an HOA on the property that is responsible for maintaining the streets and general upkeep. Mr. Anderson reminded the Commission of how this request is better than it was in the existing Planned Development (PD). ➢ The PD allows 16-24 units per acre, which would allow 370± units. This request is for 158 units. ➢ The PD allows for a 20' rear yard setback — this request is for 30' rear yard setback. Mr. Anderson provided an aerial view of how the project would look with townhomes, and then presented a possible view if it were developed as multi -family. He also presented a landscape plan and a parking plan. The parking plan provides 80 spaces, plus 2 -car garages for each unit. Mr. Anderson stated this plan was a concept plan only and that details of the layout could be addressed at detailed site plan review and approval. Chairman Caplinger continued the Public Hearing. �, The following individuals spoke in opposition to the request: PLANNING & ZONING COMMISSION PAGE 4 FEBRUARY 3, 2004 Kirk Wilson L 1216 Greenway Stan McClellan 1102 Rainforest David Robinson 1223 Shadetree Lane Tom Apligian 6 Parkside Circle Ritchie Criese Issues of concern were: ➢ Impact on schools ➢ Increase traffic on McDermott ➢ Lack of Parking — no internal parking to the north of the development ➢ Units in Lewisville did not show sprinkler systems in the landscape areas ➢ Will need a strict HOA ➢ Townhomes are encroaching into our neighborhood ➢ Wants any approval to be very specific ➢ Need masonry walls to north and west of development. ➢ We don't need more multi -family — there are 3,500 units built or planned for this area ➢ Homes in the area are not selling because of the existing multi -family ➢ Wants medical offices or executive suites ➢ Drainage is already a problem in this area ➢ Change zoning which that would allow for development that would be a positive impact on the area. ➢ Units to the northeast cannot be built because of a large sewer line that is already there Chairman Caplinger closed the Public Hearing. Art Anderson approached the Commission to address the concerns. He stated that this request follows the guidelines of the Comprehensive Plan — medium density This development would have less impact than a multi -family development — more children would come from a multi- family development. He agreed with the request for a wall as a buffer from the existing commercial development to the west. Mr. Anderson was not aware of the problem with sewer lines, however should it be determined during the site plan process that the sewer line exists and cannot be moved, the flexibility is there to remove those buildings from the plan. Mr. Hoover re -addressed the Commission. He wanted to remind everyone that the property is currently zoned multi -family. This request is for an amendment to the PD. If someone came in and wanted townhomes as they are allowed in the Development Code with no special requests, it would be allowed. The current request still has issues that need to be resolved, and Mr. Hoover PLANNING & ZONING COMMISSION FEBRUARY 3, 2004 PAGES doesn't feel they can be addressed without changing the Concept Plan. To address the parking issues, some of the proposed buildings may need to be deleted. Staff at this point is not comfortable with the request, and is recommending denial. Chairman Caplinger asked for comments or questions from the Commissioners. Commissioner Grimes ➢ The Concept has merits, but he doesn't like the parking situation ➢ If there isn't sufficient parking, guests will be parking in neighbors' lots or in the grass ➢ The development would be confusing to guests or delivery people ➢ The streets look like alleys — too congested ➢ Impact on schools — however, no one from the school district was present to oppose the development ➢ Fewer units is better ➢ Medical offices — Commissioner Grimes feels this would create more traffic from patients all day long. Commissioner Wendland ➢ Good Concept —but problem with parking ➢ Not opposed to townhomes — prefer over garden office or retail ➢ Support adding the wall to the west of the development Commissioner Sedlacek ➢ Problem with parking ➢ Residents are concerned about the quality of the product — Feels the City's Building and Code Division will monitor during the construction phase ➢ Likes townhomes in this area Chairman Caplinger ➢ Disappointed applicant did not come back with something that addressed the concerns from the last Commission meeting. ➢ This product could work on this site — the request needs a major overhaul Mr. Anderson addressed the Commission and withdrew the request. The Commission took a ten (10) minute break at 8:25 p.m. The Commission reconvened at 8:35 p.m. I PLANNING & ZONING COMMISSION PAGE 6 FEBRUARY 3, 2004 Item Number 5: Public Hearing — Conduct a Public Hearing and consider an ordinance granting a change in zoning on 29.1741 acres of land from SC -Shopping Center and TH-Townhome to 22.17± acres for R7 -Residential, S.00± acres for TH-Townhome, and 2.00± acres for LR -Local Retail. The property is situated in the J. W Parsons Survey, Abstract No. 705, City of Allen, Collin County, Texas, located at the southwest comer of Ridgeview Drive and Alma Drive. Mr. Hoover presented the Plan to the Commission. The Plan provides two exits from the development — at Alma Drive and Twin Creeks Dr. The Townhome zoning was moved from the southern border of the property adjacent to Glendover Park to the east adjacent to Alma Drive. The proposal includes 30 units of townhomes. Jerry Sylo from Jones & Boyd, representing the applicant, addressed the Commission. Mr. Sylo stated that this proposal includes 106 single family lots, 30 townhome lots, and 3.75 acres of open space. There will be a landscape buffer along Alma Drive, with 175 feet from the garage of the townhomes to the east right-of-way line of Alma Drive. This second proposal removed a second opening onto Alma Drive that had been shown on the first proposal. The front of the townhomes face open space. The current density as proposed is 5 units per acre. Commissioner Harvey asked if the lot size would allow the residents to install a pool. Mr. Sylo responded yes. Commissioner Harvey asked if the open space was purposely placed near the townhomes only Mr. Sylo responded that yes it was, using the open space to buffer against the townhomes, but still being available for the entire development. Chairman Caplinger opened the public hearing. Chairman Caplinger explained that he had a number of a -mails and speaker cards. He went through each speaker card, and allowed the resident to stand and address the Commission or just have their comments read into record. Mr. Larry Johnson asked if approving the zoning automatically approved the site plan. Mr. Hoover addressed his concerns by stating the site plan will be reviewed by staff, and the plats will go before the Commission for approval. However, the site plan should resemble the adopted Concept Plan. Mr. Johnson asked if the residents can come and oppose the site plan if necessary. Mr. Hoover explained that the site plan and plats are not public hearings; however the Planning and Zoning meetings are open meetings. The Chairman of the Commission can choose to allow comments from the audience if he so chooses. Some residents who were present stated they did not receive notification of the request. Mr. Hoover explained the administrative process, stating that the City follows the State law of notifying property owners within 200 feet of all directions. The City takes the extra step by using door hangers if it looks like most of the names are builders. This information is received by records of the Central Appraisal District. Mr. Hoover referred to the Land Development Code and read into record some of the uses allowed in the LR Zoning. He wanted the residents to also understand that should the applicant increase the lot sizes, it would reduce the amount of open space. Commissioner Sedlacek asked if the townhomes would have an HOA. Mr. Hoover answered yes. Mr. Sylo re -addressed the Commission to answer questions. He stated it was the applicant's opinion that the townhomes would have a lesser impact if placed along Alma Drive. They do not object to moving them closer to Ridgeview The local retail will not be moved. It was placed at this location because it was where two (2) future six -lane thoroughfares will intersect. Mr. Sylo was not definite on the price of the townhomes, but assured the Commission that the price will be comparable to the surrounding homes. Chairman Caplinger asked for questions from the Commissioners. PLANNING & ZONING COMMISSION PAGE 9 FEBRUARY 3, 2004 Commissioner Grimes likes the concept of the open areas in the development allowing for closer parks. However, he did not support reducing the size of the lots to 40 feet. Commissioner Harvey prefers moving the townhomes to Ridgeview, but had no objection to the smaller lot size. Commissioner Stocker inquired about the regulations that were included in their packet. The regulations list detached garages. Commissioner Stocker does not like this portion of the request, and would like to see larger streets. Commissioner Wendland stated he liked the proposal as is. He did commend Mr. Sylo for offering to move the townhomes to Ridgeview Commissioner Wendland did state that he did not want the new configuration at the expense of the open space. Commissioner Sedlacek also supported the plan as it was. She would support moving the townhomes, only of the ratio did not change. Commissioner Sedlacek added that this proposal included a product that is needed here in Allen. Chairman Caplinger liked the proposal as submitted. The Commissioners asked Mr. Sylo about the detached garages. Mr. Sylo stated that the applicant would like flexibility on the type of garage to install. Commissioner Wendland stated that when the PD is amended, he wants a stipulation that a breezeway is to be included with any detached garage. Motion: Upon a motion by Commissioner Wendland, and a second by Commissioner Grimes, the Commission voted 6 IN FAVOR, and 0 OPPOSED to re -open the Public Hearing. The motion carried. According to the city, planning document, the town homes are suppose to act as a buffer between the single family residential areas and the commercial areas north of Ridgeview Drive. The proposed layout is contradicting this city planning goal. In order to act as a buffer, it should be running East-West along Ridgeview Drive instead. The proposed plan also will have the backside of the town homes facing Alma Drive. The backside tends to have the least masonry and is the least attractive. The visibility of town homes has direct impact on our current and future property values in Waterford Crossing. I hereby request the Planning Committee and City Council to redesign the layout such that the town homes will not be visible from Alma Drive. 2. 1 oppose the proposed plan to decrease the lot size from 45 to 40 feet. This is below what we consider the acceptable community standard and the current city-wide practice. There is no precedence whatsoever in the entire City Of Allen for such downgrading of lot size. 3. 1 request this proposed subdivision to be remapped such that all roads are in east -west configuration, in contrary to the proposed north -south configuration. It is because all subdivisions surrounding this plat of land are configured in this manner. 4. 1 request the installation of a Stop Sign Oust like the intersection of Alma Drive and Commanche) on the intersection of Alma Drive and Waterford Way, should there be an entrance to the proposed subdivision directly across from our entrance on Waterford Way. With the rapid growth in our area and the area north of Alma/Hwy121, the traffic on Alma Drive is increasingly heavy. Adding this proposed subdivision will definitely worsen the traffic. Therefore, to insure the safety of the residents in the area, a Stop Sign to break the traffic Flow is sorely needed. 5. 1 request to add the following restriction to the proposed local retail at the comer of Alma Drive and Ridgeview Drive: a. No gas station be allowed -- Underground gasoline tanks can create environmental problem that is hazardous to the nearby residential areas. b. No 24 -hours business be allowed — 24 -hours businesses create traffic, loitering, and potential crime in the area. Furthermore, with the development at Hwy 121 and Alma Drive, there will certainly be gas stations, convenience stores, and other 24 -hours businesses at that intersection. With that development on the northern, end, and the existing retail strip at the southern end at Alma and McDermott, there is no reason whatsoever to add any 24 -hours business in between, particularly right in front of our community. My suggestion for the proposed local retail are: daycare center, bakery or dry cleaner Thank you very much. The biggest concern about the property being rezoned to townhomes is about the future tenants of these homes. In many areas where there are townhomes, they are purchased for investments and are rented out to cover the cost of the payments and at some point the owners sell them to make a profit and the cycle goes on and on. Renters do not tend to keep up the property and landlords many times only do what is necessary to get by, no matter how bad it looks. The same is true with apartments. This type of housing can certainly have an affect on our home values and would have an affect on the city of Allen. Another question is in regard to the quality and price of townhome that will be built there. There are no other townhomes or apartments located on Alma between McDermott and Highway 121 and all of the homes along that corridor would be in the $250,000 range and up. Any townhome that would be built in the area should reflect a minimum of that cost, should be high quality in the materials used and the builders should be required to fulfill all the restrictions that have been place upon builders of the homes in this area. e single entrance into the property was another question that needs to be addressed. Alma is already a major oroughfare running north and south from Plano to Highway 121 When Alma is completed to Eldorado or even Highway 380, the traffic will increase even more and trying to move people in an out of that area will be a process. Already, at certain times of the day, getting out of Waterford Crossing is a challenge. One entrance into whatever is built in that area is not enough. The final question is in regard to the corner of Alma and Ridgeview, which is zoned commercial. Apparently someone has hinted that this could be a convenience store with gas pumps. This should not be a consideration for this property. There are no other gas stations anywhere on Alma between McDermott and H]ghhway 121 in the middle of major intersections. There should not be one at this location. This property is directly across from our neighborhood's pool and recreation area. The noise, the lack of privacy and the safety that would be invoked by a business like that would be unacceptable. Keep the businesses of this nature on Highway 121 and at other major intersections in the city. Many from our neighborhood plan to be at the Planning and Zoning Meeting on February 3 and will also be at the Council Meeting when this is discussed. There must be some options out there that would allow this matter to be settled without upsetting those who already live in the area and are paying taxes to the city of Allen. We want to have a hand in the decision that will be made because it affects all of us.
