Approve Minutes November 15. 1994 Chairman Clay read the agenda item into the record as follows: "Approve minutes of July 5, 1994, Regular Meeting." MOTION: Upon a motion by Board member Roberge and a second by Board member Lewis, the Board voted 5 FOR and 0 OPPOSED to approve the minutes of July 5, 1994, as presented. A BOARD OF ADJUSTMENT November 15, 1994 PAGE 2 Approve Resolution 1003 Be] Air Dr. (Agenda item III) Chairman Clay read the agenda item into the record as follows: "Consider approval of Resolution No. BOA7-5-94-2, Approving a Request for Variance on a Residential Structure at 1003 Bel Air Drive, Allen, Texas." MOTION: Upon a motion by Board Member Roberge and a second by Board Member Rich, the Board voted 5 FOR and 0 OPPOSED to approve Resolution No BOA7-7-94-2, approving a request for variance at 1003 Bel Air Dr. Public Hearing 103 W Belmont (Agenda Item TVl Chairman Clay read the agenda item into the record as follows: "Public Hearing - Consider a request from Ms. Barbara Lee for a variance to the requirement for masonry exterior on a structure located at 103 W Belmont, Allen, Texas. The request is for a special exception to Section 3.01(AA) Central Business District Regulations of the City of Allen Comprehensive Zoning Ordinance and Consider Resolution No. BOA11-15-94-3 effecting this action." Ms. Sally Leeper, Secretary, administered the following oath to persons listed below who intended to testify during the hearing. "Each of you do solemnly swear or affirm that the testimony you shall present in this proceeding shall be the truth and nothing but the tmth, so help you God." Butler Allen, TX 75002 Mr. Bret McCullough, Building Official, presented the request to the Board. He indicated that the request is for a special exception to the masonry requirement for a commercial establishment in the Central Business District. He reviewed the portions of the Zoning Ordinance that refer to this request, and indicated that the Board of Adjustment is allowed to grant an exception for alternate building materials in the Central Business District where preservation is indicated based on age and design. Chairman Clay opened the public hems. Ms. Barbara Lee provided historical data regarding the property She stated that the property was purchased on September 20, 1904, by H. T Jordan. The house was originally built of local products and cypress siding from East Texas. �n Ms Marie Hefner spoke in favor of the request. She stated that she was born in the house in 1913 and was in favor of its preservation. Mr. Joe Barton King spoke in favor of the request. He added that the architecture of this house is the best example in Allen of early architecture. The Cypress siding is one of only three in this area. He added that the lightening rods are an example of the protection used years ago and could be the reason that the structure is still in tact. Mr. King added that the outside porch design is one of the nicest in the community With no one else wishing to speak for or against the request, Chairman Clay closed the pudic hearing. MOTION: Upon a motion by Board Member Roberge and a second by Board Member Prall, the Board voted 5 FOR and 0 OPPOSED to approve the request for special exception for the property located at 103 W Belmont, and approve Resolution No BOA 11-15-94-3 with the inclusion of the names of the additional speakers that spoke in regard to the request. Ms. Sally Leeper advised the Board that a request for special exception to masonry exterior has been received by City staff for the property located at 201 E. Main Since the Board's regular meeting date in December conflicts with the Annual Appreciation Dinner hosted by the City Council, the 1 Board concluded that they would hold this public hearing on Monday, December 5, 1994 BOARD OF ADJUSTMENT November 15, 1994 PAGE 4 ADJOURN MOTION. Upon a motion by Board Member Roberge and a second by Board Member Lewis, the Board voted 5 FOR and 0 OPPOSED to adjourn the November 15, 1994, meeting at 7'51 p.m. These minutes approved this day � of ' 1994.
