Min - Board of Adjustment - 1992 - 07/06 - Special CalledALLEN ZONING BOARD OF ADJUSTMENT CALLED SPECIAL MEETING JULY 6, 1992 ATTENDANCE: Board Members Present: Galen Clay, Chairman Bill Roberge Ray Lewis Ed Terrell Jeff Cocking Board Members Absent: City Staff Present: Bill Petty, Director of Community Development Sally Leeper, Secretary El CALL TO ORDER AND ANNOUNCE A QUORUM: With a quorum of the Allen Zoning Board of Adjustment present, the meeting was called to order at 7:30 p.m. by Chairman Clay at the Allen Municipal Annex, City Council Chambers, One Butler Circle, Allen, Texas. Approve Minutes June 2, 1992 (Agenda Item II) Chairman Clay read the agenda item into the record as follows: "Approve minutes of June 2, 1992, Called Special Meeting." MOTION: Upon a motion by Board Member Roberge and a second by Board Member Terrell, the Board voted 5 FOR and 0 OPPOSED to approve the minutes of June 2, 1992, as presented. Zoning Board of Adjustment July 6, 1992 Page 2 Public Hearing Shadow Ridge Apartments (Agenda Item III) Chairman Clay read the agenda item into the record as follows: "Public Hearing - Consider a request by Liddell, Sapp, Sivley, Hill & LaBoon, L.L.P., representing Shadow Ridge Apartments, for a variance to an encroachment of a building line for Building No. 3 of Shadow Ridge Apartments. This property is part of the Bethany Park Addition to the City of Allen, Collin County, Texas; further described as being located at 550 Bethany Drive." Mrs. Sally Leeper, Secretary, administered the following oath to persons listed below who intended to testify during the hearing: "Each of you do solemnly swear or affirm that the testimony you shall present in this proceeding shall be the truth and nothing but the truth, so help you God." Mr. Robert Miller 3200 Texas Commerce Tower Houston. TX 77002 Mr. Bill Petty One Butler Circle Allen, TX 75002 Mr. Miller, attorney representing the First Gibraltar Bank, owner of the apart- ment complex, presented the request to the Board. He stated that the encroach- ment to the 20 -foot building line was discovered at the time the property was being sold. This encroachment does not appear to be a problem, and they are requesting a variance to the encroachment so that they might be in a position to market and sell the property. Mr. Petty stated that the property was constructed in 1979 with a 20 -foot building line along the southern border. Between the property Has and the adjacent single family development there is an additional 20 -foot easement. All property owners within 200 feet have been notified of this request for variance and although numerous calls were received by city staff, each of the callers have been satisfied with the explanation of the request. Staff is of the opinion that there has been no adverse effect on adjacent property owners. Mr. Petty added that this building has been in this location for 13 years. Chairman Clay opened the public hearing. With no one wishing to speak for or against the request, Chairman Clay closed the public hearing. The Board discussed the request, and the consensus was that there was no adverse effect on adjacent property owners, and since this building has been in { this location for 13 years, it would be appropriate the grant the variance. (Agenda Item III) Chairman Clay reviewed the fact that the zoning ordinance allows the Board to grant this type of variance. MOTION: Upon a motion by Board Member Roberge and a second by Board Member Terrell, the Board voted 5 FOR and 0 OPPOSED to adopt a resolution granting the 10 -foot building line variance.
