Approve Minutes June 8, 1993 Workshop (Agenda Item 11) Acting Chairman Hall read the agenda item into the record as follows "Approve minutes of June 8, 1993, Workshop Meeting." MOTION: Upon a motion by Board Member Smyser and a second by Board Member Leverett, the Board voted 3 FOR and 0 OPPOSED to approve the minutes of June 8, 1993, workshop meeting, as presented. Approve Minutes June 8. 1993 Regular (Agenda Item III) Acting Chairman Hall read the agenda item into the record as follows "Approve minutes of June 8, 1993, Regular Meeting." MOTION: Upon a motion by Board Member Leverett and a second by Board Member Smyser, the Board voted 3 FOR and 0 OPPOSED to approve the minutes of June 8, 1993, regular meeting, as presented. SIGN CONTROL BOARD JULY 13, 1993 PAGE 2 Renewal Goodman Homes (Agenda Item IV) Acting Chairman Hall read the agenda item into the record as follows: "Renewal - consider 10th renewal for Goodman Homes for off-site sign located at the northwest corner of Fountain Gate Drive and Main Street." Mr. Del Ferro advised that the sign is in good repair. MOTION: Upon a motion by Board Member Leverett and a second by Board Member Smyser, the Board voted 3 FOR and 0 OPPOSED to approve the renewal for Goodman Homes. Renewal Highland Homes (Agenda Item V) Acting Chairman Hall read the agenda item into the record as follows: "Renewal - Consider 2nd renewal for Highland Homes for on-site sign located at Rockcrossing Lane and Jupiter Road." MOTION: Upon a motion by Board Member Leverett and a second by Board Member Smyser, the Board voted 3 FOR and 0 OPPOSED to approve the renewal for Highland Homes. Renewal Doyle Wilson Homes (Agenda Item VI) Acting Chairman Hall read the agenda item into the record as follows: "Renewal - Consider 2nd renewal for Doyle Wilson Homes for on-site sign located at 606 Ridgemont Drive." Renewal Legacy Homes (Agenda Item IX) Acting Chairman Hall read the agenda item into the record as follows: "Renewal - Consider 2nd renewal for Legacy Homes for on-site sign located at the northwest corner of Whitman Drive and Bethany Drive." MOTION: Upon a motion by Board Member Smyser and a second by Board Member Leverett, the Board voted 3 FOR and 0 OPPOSED to approve the renewal for Legacy Homes. Approval Pacific American Homes (Agenda Item X) Acting Chairman Hall read the agenda item into the record as follows: "Consider request for Class 4 off-site sign for Pacific American Homes by Texas Advertising to be located at the northeast corner of Alma Drive and McDermott Drive." MOTION: Upon a motion by Board Member Smyser and a second by Board Member Leverett, the Board voted 3 FOR and 0 OPPOSED to approve the off-site sign for Pacific American Homes. SIGN CONTROL BOARD JULY 13, 1993 PAGE 4 Other Business: The Board continued the workshop discussion of the revisions to the Sign Ordinance. The following 12 items and additional text were discussed as possible inclusions for revision. 1. Banners - leave as is, enforce, even if it means additional staff. 2. Zoning Signs - Add text to notice of posting indicating that the City has the authority to enter the property in order to remove the sign if property owner has not removed it in the required number of days. A bill will be sent to the property owner to cover the cost of removal; if not paid, a lien placed on the property. 3. Class 4 Signs - Add text to application indicating that the City has the authority to enter the property in order to remove the sign if property owner has not removed it in the required number of days. Renewals, Class 4: Change to annual renewals with a fee double that of the E6 -month renewal. 6. Removal - Enhance criteria for removal, add aesthetic and cosmetic ma- sons. 7. Absenteeism - add clause to ordinance regarding number of absences allowed. (Staff will provide a draft of by-laws to cover this item rather than includ- ing it in the ordinance.) 8. Garage Sale signs - Prohibit in median. (Staff recommends a blanket statement in the prohibited section disallowing any and all signs in the median). 9. Political Signs - prohibit in median. (Staff recommends a blanket statement in the prohibited section disallowing any and all signs in the median). 10. Page 9, paragraph 4 - add requirement for 25' corner clip. 11. Balloons - allow same as Class 4, eliminate reference under prohibited signs. Allow for promotional events same as banners. Maximum height subject to setback requirement, nonilluminated, and tethered to ground or structure. SIGN CONTROL BOARD JULY 13, 1993 PAGE 5 12. Staff recommends clarification be added to freeway signs section to indicate that future right-of-way of thoroughfares where freeway signs are allowed must be in place. SECTION 131, NOTICE TO REMOVE That in the event the owner of the sign, land or structure, or person in charge of erecting, altering, replacing, relocating, or repairing the sign or structure fails to comply with the provisions of this ordinance. The Building Official or his representative shall be authorized to issue notice to such owner or person in charge, and directing the abatement of violations of this ordinance within a ten- day (10) period. This notice shall be in writing and may be served to the owner or person in charge by regular mail addressed to his post office address or address from other official record of the city or county, or by publication two (2) times within ten (10) days in the official newspaper of the City of Allen. It shall be further provided that in the event the owner or person in charge, as stated in this ordinance, fails to comply with the provisions of this ordinance within ten (10) days after proper notice, as provided above, the Building Official, or his representative, shall be authorized to abate all violations of this ordinance and shall charge all expenses to the owner of such property. The expenses assessed to the owner shall be actual removal expenses, not less than twenty-five dollars ($25), plus a special fee of fifty dollars ($50) to cover administrative costs. Payment is due and is considered delinquent if not received by the City within thirty (30) days. In the event the owner fails or refuses to pay such expenses within thirty (30) days, the City shall file with the County Clerk of Collin County, Texas, a statement of said costs. The City of Allen, Texas, shall have a privileged lien on the premises, second only to tax liens and liens for street improvements, to receive the costs so made and ten percent (10%) interest per annum on the amount from the date the City incurs the expense. For any such costs, and interest, suit may be instituted in the name of the City of Allen, Texas, and the statement of costs, as provided in this ordinance, shall be prima facie proof of the costs expended in such work. SECTION 14 INJUNCTIVE RELIEF In addition to and cumulative of all other penalties, the City shall have the right to seek injunctive relief for any and all violations under this ordinance. TEXT TO BE ADDED TO APPLICATION FOR CLASS 4 PERMITS AND VERIFICA- TION FORM FOR ZONING SIGNS I, , owner of the above property, do hereby authorize the City of Allen to enter said property to abate any violation pertaining to the sign or its structure [in accordance with Ordinance No. 374-10-81. SIGN CONTROL BOARD JULY 13, 1993 PAGE 9 MOTION: Upon a motion by Board Member Smyser and a second by Board Member Leverett, the Board voted 3 FOR and 0 OPPOSED to include all 12 above recommendations and additional text in the proposed revised ordinance to be sent to City Council. Staff was requested to prepare a final draft of the new ordinance for review by the Board at their next meeting. The Board reviewed the Class 4 signs issued during the previous month. Workshop Review of Sign Regulations Ordinance Mr. Danny Thompson, Sky Signs Balloons, presented information to the Board regarding cold air, hot air, and helium balloons. He discussed their construction and method of securing to structures. He was in favor of allowing balloons in the Sign Ordinance with the conditions that have been proposed. The Board requested staff to consider a new fee structure based on an average of surrounding communities.
