E, Ottaway, Absent : Aldermen-Jimmy Gantt and B, J . Enloe . Motion made by Phil Pringle that we continue with the condemnation proceedings on the Moulden Property, subject to the City Attorney's advise. Seconded by C. E. Ottaway, Motion Passed--Ayes 3, Noes none, Resolution in regard to condemnation proceedings was read by Mayor Gentry T. Jones to the Councilmen. Motion made by Phil Pringle to sign resolution, Seconded by R. B. Whisenant, Motion Passed--Ayes 3, Noes none. Water and Sewer school is being held at Arlington State College, June 2, 3 and 4. Motion made by R. B. Whisenant to send Mr, Ereckson to this school with expenses paid by the City of Allen. Seconded by C.E. Ottaway. Motion Passed--Ayes 3, Noes none. Motion made by R. B. These minutes read and approved this the 11 day of June 1964. RESOLUTION THAT WHEREAS, the Town of Allen, Texas, in the exercise of its govermental function, owns and operates a sanitary sewer system, and WHEREAS, the present facilities for the treatment of sewerage are inadequate and are dangerously overloaded and the Council of the Town of Allen finds it necessary to acquire a new site and acquire real estate for expanded sewerage treatment facilities, and WHEREAS, the following described real estate has been found to be the best and most suited land available, and WHEREAS, the Council of the Town of Allen has made a sincere and bonified effort to purchase such property but have been unable to agree upon a price to be paid for such property; BE IT RESOLVED BY THE COUNCIL OF THE TOWN OF ALLEN, TEXAS, that condemnation proceedings be instituted to acquire the fee simple title to the following described real estate, to-wit : SITUATED in Collin County, Texas, and being part of the R, C. Whisenant Survey, Abstract No. 1012 and the J . D. Straughan Survey, and being 50 acres off the east end of the second and third tracts described in Volume 112, Page 490 of the Deed Records of Collin County, Texas, and being more particularly described as follows : BEGINNING in the north line of said second tract , 1530.30 feet east of its northwest corner ; THENCE EAST, alone the north line of said second tract, 1160.69 feet to the center of Cottonwood Creek; THENCE DOWN the center of Cottonwood Creak as follows : SOUTH 35 degrees 26 minutes East, 511.73 feet ; SOUTH 07 degrees 08 minutes East, 212.0 feet ; SOUTH 23 degrees 16 minutes rest, 172.50 feet ; SOUTH 20 degrees 09 minutes 'Fest, 262.00 feet; SOUTH 27 degrees 16 minutes East, 278.0 feet ; SOUTH 08 degrees 39 minutes West, 409.50 feet ; SOUTH 02 degrees 39 minutes West, 333.71 feet ; SOUTH 36 degrees 20 minutes Nest, 363.03 feet ; THENCE WEST, along the south line of said third tract, 895.62 feet to a point that is 1571.83 feet east of the southwest corner of said third tract ; THENCE NORTH, 1349.70 feet to the north line of the J. D. Straughan Survey and the south line of the R. C. Whisenant Survey and in all 1937.10 feet to the place of beginning and CONTAINING 50.00 acres of land, and that Abernathy & Orr, Attorneys at Law, McKinney, Texas, are hereby authorized and directed to institute such condemnation proceedings against the true owners thereof and to execute any instruments necessary in order to prosecute said cause. BE IT FURTHER RESOLVED that if necessary, condemnation proceedings be instituted in order to secure easements for the construction and maintenance of outfall lines from the present sewerage treatment plant to the location of the new plant to be constructed on the above described premises.
