ORDINANCE NO. 912-3-89 Ry CCS y Tt t'��; S AN ORDINANCE OF THE CITY OF ALLEN, COLLIN COUNW, TEXAS, ACCEPTING THE IMPROVEMENTS ON A PORTION OF F.M. 2170, FURTHER DESCRIBED AS BEING PORTIONS OF F.M. 21709 CONTAINING PORTIONS OF MCDERMOTT DRIVE FROM A POINT 221 FEET WEST OF ALLEN DRIVE TO ALLEN DRIVE, ALONG ALLEN DRIVE TO MAIN STREET, AND ALONG MAIN STREET TO 83 FEET WEST OF DOGWOOD STREET, SAID PORTIONS BEING HEREINAFTER DESCRIBED AND IN THE CITY OF ALLEN, COLLIN COUNTY, TEXAS; PROVIDING FOR THE ATTACHMENT OF EXHIBIT "A" CORRECTING THE ROLLS AND ESTIMATES THEREOF; AMENDING CITY OF ALLEN ORDINANCE NO. 635-9-85, SECTION 3(d), ORDINANCE NO. 623-8-85, SECTION 5(d), AND ORDIANCE NO. 646-10-85, SECTION 7, BY ALTERING THE TIME AND MANNER FOR PAYMENTS OF SUCH ASSESSMENTS; DECLARING AN EMERGENCY; AND PROVIDING THAT THIS ORDINANCE SHALL TAKE EFFECT IMMEDIATELY UPON ITS PASSAGE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN, TEXAS: SECTION 1. That a portion of F.M. 2170, further described as being portions of F.M. 2170, containing portions of McDermott Drive from a point 221 feet west of Allen Drive to Allen Drive, along Allen Drive to Main Street, and along Main Street to 83 feet west of Dogwood Street, has been improved in accordance with the plans and specifications thereof and as required by contract. The Department of Engineering has examined and inspected the completed improvements and it is hereby found that said work and improvements have been performed and completed in compliance with the terms of said contract and are hereby accepted and approved by said City Council. SECTION 2. That the City of Allen hereby approves the corrected Engineer's Roll and completes the levying of assessments as described in Schedule "A" attached hereto and made a part hereof. SECTION 3. That from and after the effective date of this ordinance, a necessity exists to amend City Ordinance No. 623-8-85, Section 5(d), Ordinance No. 635-9-85, Section 3(d), and Ordinance No. 646-10-85, Section 7, by amending the time and manner proposed for payments of such costs, to wit: Ordinance No. 912-3-89 - Page 1 304�I 291 When the improvements herein ordered have been completed and accepted by the City of Allen, the amount of the assessment against each property abutting thereon, and the real and true owners thereof, shall be and become payable in five (5) equal annual installments due respectively one year, two years, three years, four years, and five years from the date of acceptance by the City of Allen, together with interest* on the unpaid balance that accrues beginning one year after the date of acceptance until paid at the rate of eight (8) percent per annum, payable annually; provided, however, that the owners of any said property shall have the privilege of paying all or any of said installment at any time before maturity thereof by paying the total amount of such installment together with the interest accrued thereon to the date of payment. Further, if default be made on the payment of any of said installment of principal or interest promptly as the same matures, then at the option of the City of Allen the entire amount of the assessment upon which default is made, together with reasonable attorney's fees, and all collection costs incurred, shall be and become immediately due and payable. SECTION 4. That the City Manager is hereby authorized and directed to initiate or cause to be initiated procedures to collect the first and subsequent installments in accordance with the amended terms of Ordinance No. 623-8-85, Section 5, Ordinance No. 635-9-85, Section 3, and Ordinance No. 646-10-85, Section 7, with regard to the prescribed assessments. SECTION 5. That in order to protect the public interest, comfort, and general welfare of the City of Allen, the adoption of this ordinance creates an emergency for the preservation of the public health, safety, and welfare, and requires that this ordinance shall take effect immediately from and after its passage and the publication of the caption of said ordinance as the law in such cases provides.
