City Council
City of Allen, Allen, Texas
Present : Mayor Frank Dugger
Councilmen: Bob Lowman, Roy Ewen, Mack Holloway, Dan
Strong and C.D. Whitaker.
Motion Dan Strong Second Bob Lowman that minutes of
previous meeting be approved as read. Motion Carried 5 For 0
Against.
James Caton appeared before Council, as Legal Counsel,
representing Mrs Nancy Brandon and Mrs Reba Adams, in regard to
the shooting of their dogs by one of the City Police Officers.
Mr Caton stated that Mrs Brandons dog was a Registered Weimeriner
valued at $150.00, Mrs Adams dog recovered from the shooting and
she asked payment of a Veterinariain Bill for $22.00. Mr Caton
asked that City pay these two items as damages to Mrs Brandon
and Mrs Adams as the result of the shooting of the dogs. Upon
the admittance by Mr Caton that both parties knew that they were
in violation of the Animal Ordinance Law and since there had been
requests by the Police Department that these dogs be kept up and
also in finding that these dogs were shot on private property;
Council voted to ask City Attorney Alex Orr to write a letter of
apology to Mrs Brandon and Mrs Adams, but to reject their claims
for damages.
Motion Dan Strong Second C.D. Whitaker that Ordinance No. 92
be approved. Motion Carried 5 For 0 Against,
Motion Bob Lowman Second Dan Strong that no adjustment
be made on water bills if leak occurs between City's Water Meter
and property Owners house. Motion Carried 5 For 0 Against.
Motion C.D. Whitaker Second Mack Holloway that City call
an Election for a Mayor and 2 City Councilmen. The date of the
Election to be April 4th, 1970. Motion Carried 5 For 0 Against.
Motion C.D. Whitaker Second Dan Strong that bills Pre-
sented be approved. Motion Carried 5 For 0 Against.
Jack Parsons and W.A. Eubanks appeared before Council
in regard to the drainage situation along the County Road on the
East end of the Hillside Village Addition. Walter Hicks, City
Engineer, proposed to Council that the water be carried by an
open ditch from the South Side of Wandering Way on Southward
along the East Side of Mr Parsons Property. Mr Hicks presented
a copy of his proposal to Council. After some discussion Council
agreed to accept Engineer's reccommendation as shown on plans
presented.
Motion Bob Lowman Second Dan Strong that meeting adjourn.
Motion Carried 5 For 0 Against .
