AN ORDINANCE OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS,
AMENDING THE SOLID WASTE ORDINANCE, NO. 468-10-83, OF THE
CITY, PROVIDING A REVISED SCHEDULE OF RATES AND CHARGES FOR
SOLID WASTE DISPOSAL AND COLLECTION, PROVIDING A SCHEDULE OF
RATES AND CHARGES FOR ON-PRENaSES RECYCLING SERVICES,
AUTHORIZING THE CITY MANAGER TO PROVIDE REBATES TO UTILITY
CUSTOMERS WHO RECYCLE, AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Texas Legislature increased the State Landfill Permit Fee from fifty cents
per ton to $1.50 per ton, effective October 1, 1991 for all landfill operators; and
WHEREAS, the City of Allen, as a member of the North Texas Municipal Water District
(NTMWD) solid waste disposal system, is now paying the increased fee to the NTMWD;
and,
WHEREAS, the City Council increased rates to commercial customers, but not residential
customers, effective March 1, 1992, in order to collect the increased landfill fee; and,
WHEREAS, the Council wishes to charge all customers fairly by distributing the landfill
increase among all rate payers; and,
WHEREAS, the City Council desires to contribute to a healthy -and safe environment by
providing on -premises collection of recyclable materials to Allen businesses and
residents; and,
WHEREAS, the Council believes everyone, including those who do not recycle, will
benefit from a recycling program and, therefore, all residential customers should pay
for the service;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ALLEN, COLLIN COUNTY, TEXAS:
SECTION 1: That from and after the effective date of this Ordinance, Ordinance No.
468-10-83, Section 2. 05, "Residential Collection Fees," as amended, is hereby amended
to read as follows:
"The collection and removal of garbage, rubbish and brush in disposable
bags from residential premises, two times per week, shall be made for a fee
charge of $7.40 per residential unit for each calendar month. Multi -family
dwellings (4 or more unit) shall use commercial containers provided by
Contractor. For partial months, said charges shall be prorated for each
and every day of the month during which such service is available and
provided to the customers. There shall be a fee charged for extra
collections necessary for the collection of unusual accumulations. An
increase in monthly fees may be made upon approval of the City Council.
The charges for collection service shall be included on the monthly utility
bill of the occupant. All utility customers shall receive solid waste
collection service. Rates and charges shall be due and payable on the date
so indicated on the utility and solid waste bill. Should the `amount due on
the date so indicated not be paid in full, a ten percent (10%) penalty shall
be added to the amount due and unpaid."
SECTION 2: That Ordinance No. 468-10-83 be further amended by amending the fee
schedule "Exhibit A" as shown on the schedule attached hereto and made a part hereof
for all purposes.
SECTION 3: That the City of Allen shall designate a contractor -agent to regularly
collect and remove recyclable materials from all residential premises and other
establishments subscribing to the service. The City Manager shall take action to see
that the terms of this contract are fulfilled and is authorized to act for and on behalf of
the City as its representative. Recycling services shall be made for a fee charge. A
schedule of all recycling fees is contained in "Exhibit All to this Ordinance.
SECTION 4: That the City Manager is hereby authorized to rebate, pay or credit an
equal amount of money to all residential customers who participate in the City's
recycling program. The City Manager shall determine the qualifying requirements
necessary to receive such a rebate, payment or credit and the amount of such rebate,
payment or credit.
SECTION 5: That all ordinances of the City of Allen in conflict with the provisions of
this ordinance shall be, and the same are hereby, repealed: provided, however, all
other provisions of said ordinance not in conflict herewith shall remain in full force and
effect.
SECTION 6: That this Ordinance shall take effect May 1, 1992.
