O-1107-6-92ORDINANCE NO. 1107-6-92 AN ORDINANCE OF THE CITY OF ALLEN, COLLIN COUNTY, TERAS, AMENDING COMPREHENSIVE ZONING ORDINANCE NO. 829-11-87, AS PREVIOUSLY AMENDED, SO AS TO AMEND ORDINANCE NO. 786-3-87, PLANNED DEVELOPMENT NO. 12 (PD #12), AND ORDINANCE NO. 891-12-88, REVISED DEVELOPMENT POLICY, ON THE FOLLOWING -DESCRIBED TRACT OF LAND: APPROXIMATELY 103.13 ACRES OF LAND, MORE OR LESS, OUT OF THE SIMON BURNS SURVEY, ABSTRACT NO. 255, COLLIN COUNTY, TEXAS; PROVIDING FOR EXHIBIT "F" LAND USE PLAN AND AREA AND USE REGULATIONS; PROVIDING FOR RESTRICTIONS; PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000.00) FOR EACH OFFENSE; PROVIDING FOR A SEVERABILITY CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE OF SAID ORDINANCE. WHEREAS, the Planning and Zoning Commission and the governing body of the City of Allen, in compliance with the laws of the State of Texas and the ordinances of the City of Allen, have given the requisite notices by publication and otherwise, and after holding due hearings and affording a full and fair hearing to all the property owners generally and to all persons interested and situated in the affected area, and in the vicinity thereof, and in the exercise of its legislative discretion, have concluded that Comprehensive Zoning Ordinance No. 829-11-87, as previously amended, and Ordinance No. 786-3-87, as previously amended by Ordinance No. 891-12-88, should be changed; TN�OXW,, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN, SECTION 1: That Comprehensive Zoning Ordinance No. 829-11-87, as previously amended, and Ordinance No. 786-3-87, Planned Development No. 12, as previously amended by Ordinance No. 891- 12-88, revised development policy, be and the same are hereby amended by changing the Zoning Map of the City of Allen, Texas. SECTION 2: That the land use plan, development policy, and area and use regulations attached hereto as Exhibit "F" and made a part hereof for all purposes shall be adhered to in its entirety for the purposes of establishing conceptual design, development policy and maximum density. SECTION 3: That the restrictions of this planned development be adhered to in their entirety and they are listed as follows: 1. Reduction in land contained within the existing boundaries of Bethany Lakes Park is subject to the approval of the State of Texas and the Allen City Council. 2. Deed restrictions regarding maintenance of screening materials will be attached to the property and filed with Collin County. 3. The lakes along Mustang Branch that traverse the subject property remain in manageable condition. SECTION 4: That all ordinances of the City of Allen in conflict with the provisions of this ordinance shall be, and the same are hereby, repealed; provided, however, that all other provisions of said ordinances not in conflict herewith shall remain in full force and effect. SECTION 5: That the property described in Exhibit "F" attached hereto shall be used in the manner and for the purposes provided for as approved herein; SECTION 6: That any person, firm or corporation violating any of the provisions or terms of this ordinance shall be subject to the same penalty as provided for in Comprehensive Zoning Ordinance No. 829-11-87 of the City of Allen, as previously amended, and upon conviction shall be punished by a fine not to exceed the sum of Two Thousand Dollars ($2,000.00) for each offense. SECTION 7: That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable; and if any phrase, clause, sentence or section of this ordinance shall be declared unconstitutional or invalid by any judgment or decree of a court of competent jurisdiction, such unconstitutionality or invalidity shall not affect any other remaining phrase, clause, sentence, paragraph or section of this ordinance; and the City Council hereby declares it would have passed the remaining portions even though it had known the affected parts would be held unconstitutional. SECTION 8: That this ordinance shall take effect immediately from and after its passage and publication in accordance with the provisions of the Charter of the City of Allen, and it is accordingly so ordained. NOTES SHADOW LAKES INTRODUCTION The Shadow Lakes is a proposed amendment to an existing planned development district that was originally part of a 145 Acre tract of land approved in September of 1983, and subsequently amended in March of 1987 to provide for single family garden office and open space use, further known as planned development No. 12 as permitted under the land development regulations of the City of Allen, Texas. The following items represent primary elements and highlights of the proposed zoning request. The details of each element are provided in the submittal package. A. Providing an innovative and marketable planned development that will be able to absorb and afford the tremendous infrastructure costs of Allen Heights Road and that will experience pleasantly paced development and roof tops. B. Dedication of open space to the City -of Allen with commitment for the developer to improve the open space to provide for a passive park with a jogging path. C. Elimination of Garden office use; D. Reduction of Overall Traffic Generation E. Construction of hike and bike trail along Allen Heights and Park Land connecting to Shadow Lake Park consisting of approximately 1.75 miles; F. Construction of approximately 1.5 miles of Allen Heights Drive with an estimated cost of $1,200,000; G. Construction of southern collector road adjacent to Shadow Lakes Park, 1800 linear feet, approximate cost of $250,000; H. Provide regional traffic solutions; I. Provisions of estate housing adjacent to Allen Heights Drive/Park area. Lot sizing ranging from 10,000 to 15,000 square feet; a J. Provisions for linear landscape and screening along Allen Heights, inclusive of a linear hike and bike trail; K. Deed restrictions for tree preservations program subject to City of Allen staff review; L. I. Land Use Categories Neighborhood -Residential A. This land use category is intended for development for development of mixed density residential neighborhoods. It provides for flexibility of specific locations and uses within the neighborhood provided tract design principles and development policies of the City are maintained and provided uses fall within the maximum levels of the control totals and as acceptable density levels to the City. II. Residential Development A. Residential development in allen should continue to be based on the neighborhood concept. In this concept, a residential neighborhood is assumed to be bounded by major arterial streets, and amy consists of a number of properties or subdivisions. Development should occur as follows: retail, commercial or office at the intersections of the major streets, based on economic need to serve the neighborhood, and multi -family units, retirement housing or housing for the elderly in close proximity to the commercial area where services and facilities are conveniently available. School/park facilities should be centrally located to the neighborhood, with residential uses designed around the facilities. Both medium density and high-density uses should be carefully located in groupings along the major thoroughfare and adjacent to commercial or office uses. For each neighborhood, public and semi-public uses such as churches would locate along the major thoroughfares. III. Neighborhood Planning Area A. The property falls within planning area No. 25 and 26, approximately 11 acres being located in Area No. 25, which involves 1.4% of that district and approximately 92 acres in District No. 26 which involves 10.3% of that district. LOW DENSITY RESIDENTIAL DESIGN STANDARDS FOR TRACTS 1 & 3 339 LOTS 1. PURPOSE This district is intended for low density residential uses. Planning techniques will involve traditional single family detached, residential designs with variations of lot sizes ranging from 5,000 S.F. to 15,000 S.F. This district will allow a maximum of 339 units. 2. FRONT YARDS Tract 1 minimum front yard building line 25' Tract 3 minimum front yard building line 20' 3. REAR YARDS There shall be a rear yard having a depth being not less than ten (10) feet. 4. SIDE YARDS A side yard provided whereas a separation of ten (101) feet is always maintained between structures. A side yard adjacent to a side street shall not be less than fifteen (15) feet, even when a side yard is across from a front yard, the side yard shall be fifteen (15) feet. 5. USE REGULATIONS Single family detached units and accessory uses customarily incidental to the use. Churches and church related uses as permitted by specific use permit. 6. HEIGHT REGULATIONS No building shall exceed thirty ( 30 ) feet or two and one- half (2 1/2) stories in height. 7. Maximum Number of Dwelling Units 339 8. MINIMUM DWELLING SIZES Tract One - 80% 1600 S.F., 20% 1800 S.F., Tract Three - 1200 S.F. 9. LOT COVERAGE In no case shall more than fifty-five (55) percent of the total lot area be covered by the combined area of the main buildings and accessory buildings. 10. BUILDING REGULATIONS All main buildings shall have exterior construction of a minimum of 75% brick, tiles, cement, concrete, stone or similar materials. All housing backing to Allen Heights Road will require the back of the unit to be 100% brick. R- SHA►DOW OPEN SPACE REGULATIONS LAKES The proposed planned development will incorporate dedication of open space. Inclusive in that dedication will be the commitment of development of the open space into a passive park development, which involves development of the following amenities. A. 1.75 miles of 8' wide concrete sidewalk jogging path. B. Excavation and selective site clearing to provide for proper pedestrian access and use. C. Lake refurbishing to insure proper water quality and pedestrian enjoyment along with a manageable condition after the completion of improvements. D. Dedication to the City of Allen after completion of improvements. PLANNED DEVELOPMENT REGULATIONS A. Deed Restrictions will be implement subject to staff approval / maintenance, design, repair requirements for open space and Allen Heights screening requirements. B. Allen Heights Drive shall be constructed from the North property line South to existing Bethany Drive (2 lanes, 25' wide). C. Waiver of escrow funds for median improvements of Allen Heights in return for dedication of property for the Community Center. D. Allen Heights Bridges will be constructed to a 3 -lane requirement with City of Allen reimbursement for 26% of costs when funds are available. E. The property swap with the City of Allen Parks Department for the Community Center is subject to approval by the City Council of Allen, Texas and the State of Texas Parks Department. F. The roadway sections adjacent to tract four shall be addressed at the time of final platting and site planning of the report. G. The transfer of approximately two acres of land from Bethany Lakes Park is subject to approval of the State of Texas and the City Council. H. The City is waiving the requirements for escrow of funds for median improvements in consideration for the City of Allen two acre community center acreage. I. This site, which is located on Allen Heights Drive between McDermott Drive and Bethany Road, was originally studied by Barton-Aschman in a report dated November 1986 for the Bass Development Company. The orignal 1986 site plan called for 381 single family units and 291,764 sf of office while the current plan proposed by Douglas Properties is 345 single family units and no office. The Barton-Aschman study followed the procedures outlined in the City's comprehensive plan. The results of that study indicated a maximum Level of Service "C" capacity of 594%. This particular rate occurred on McDermott west of Allen while the second highest rate (52%) occurred on Bethany west of Allen. The folowing table summarizes the generated trip ends from the two site plans.
