O-1132-10-92ORDINANCE NO. 1132-10-92 AN ORDINANCE OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AMENDING CHAPTER 4, "BUILDING AND BUILDING REGULATIONS," ARTICLE I, "IN GENERAL " SECTION 4-4, "NEW BUILDING PERMIT FEES," OF THE ALLEN CODE OF ORDINANCES; PROVIDING FOR A SEVERABIIITY CLAUSE, PROVIDING A PENALTY FOR VIOLATION OF THIS ORDINANCE, PROVIDING FOR PUBLICATION OF THE CAPTION; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Building Official has reviewed the current methods of charging fees for the issuance of certain building an relative permits; and, WHEREAS, the Building Official has recommended that those fees be amended; and, WHEREAS, the City Council has reviewed the recommendations of the Building Official and concurs with the proposed permit fees; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN, TEXAS, THAT: SECTION 1: From and after the effective date of this Ordinance, Chapter 4, 'Building and Building Regulations," Article I, "In General," Section 4-4, "New Building Permit Fees," of the Allen Code of Ordinances is hereby amended in the following manner and shall read as follows, to -wit: "Sec. 4-4. New building permit fees. (a) Generally. The following new building fee includes all fees for the building, electrical, plumbing, mechanical, fire protection systems and concrete to be done during the new construction which is included on the plans submitted. Word done after the final inspection has been made for said permit will require additional permits for repairs, alterations, additions or finishing of shell buildings or other specific permits or miscellaneous permits.: (1) Single-family dwelling: Three hundred fifty dollars ($350.00) up to two thousand five hundred (2,500) square feet plus ten cents ($0.10) each additional square foot up to a maximum of six hundred fifty dollars ($650.00). (2) Duplex: Four hundred fifty dollars ($450.00). (3) Townhouse: Two hundred twenty-five dollars ($225.00) for each townhouse dwelling unit; minimum fee five hundred dollars ($500.00). (4) Apartments, multi -family: One hundred dollars ($100.00) each dwelling unit; minimum fee six hundred fifty dollars ($650.00). (5) Shell buildings: Minimum fee six hundred dollars ($600.00). Total sq. ft. Permit Fee 0-10,000 $0.12 per sq. ft. 10,001 - 100,000 $1,200 for the first 10,000 sq. ft. + $.08 for each additional sq. ft. 100,001 - and over $8,400 for the first 100,00 sq. ft. + $.05 for each additional sq. ft. H (7) (8) Completion of shell buildings: Minimum fee three hundred dollars ($300.00). Total sq. ft. 0-25,000 25,001 - 50,000 50,001 - and over Permit Fee $0.05 per sq. ft. $1,250 for the first 25,000 sq. ft. + $.03 for each additional sq. ft. $2,000 for the first 50,000 sq. ft. + $.015 for each additional sq. ft. Finished commercial buildings: Minimum fee four hundred fifty dollars ($450.00). Total sq. ft. 0-10,000 10,001 - 50,000 50,001 - and over Permit Fee $0.16 per sq. ft. $1,600 for the first 10,000 sq. ft. + $.10 for each additional sq. ft. $5,600 for the first 50,000 sq. ft. + $.075 for each additional sq. ft. Additions, alterations, repairs, fire damage: Minimum fee twenty-five dollars ($25.00); ten dollars ($10.00) per thousand dollars ($1,000) or fraction thereof based on actual total market value. Commercial, each ........................... 35.00 (13) Duplicate permit .................................. 3.00 (14) Filing fee appeals ................................. 50.00 (15) Certificate of occupancy ............................ 25.00" SECTION 2: It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable; and if any phrase, clause, sentence or section of this ordinance shall be declared unconstitutional or invalid by any judgment or decree of a court of competent jurisdiction, such unconstitutionality or invalidity shall not affect any other remaining phrase, clause, sentence, paragraph or section of this ordinance; and the City Council hereby declares it would have passed the remaining portions even though it had known the affected parts would be held unconstitutional. SECTION 3: Any person, parties in interest, or corporation who shall violate any of the provisions of this ordinance or fail to comply therewith, or with any of the other requirements thereof, shall be subject to prosecution, and upon conviction, shall be punished by a fine of not more than Two Thousand Dollars ($2,000.00), and each and every day that such violation shall be permitted to exist or continue shall constitute a separate offense. In the event a corporation is a violator of any of the provisions of this ordinance, each officer, agent and employee of such corporation who is responsible for or contributes to such violation in any manner shall be individually and severally liable for the penalties herein prescribe.d Where any person is acting solely as agent for the party in ownership, no penalties under this section shall be assessed against such agent as such. SECTION 4: The caption of this ordinance shall be published two times in a weekly newspaper published in the City of Allen, and shall be effective immediately upon its passage and publication.
