O-1336-5-95ORDINANCE NO. 1336-5-95 AN ORDINANCE OF THE CITY OF ALLEN, TEXAS, ESTABLISHING ADMINISTRATIVE DEPARTMENTS OF THE CITY ORGANIZATION, TO BE KNOWN AS THE POLICE DEPARTMENT, THE FIRE DEPARTMENT, THE PUBLIC LIBRARY DEPARTMENT, THE PARKS AND RECREATION DEPARTMENT, THE PUBLIC WORKS DEPARTMENT, THE FINANCE DEPARTMENT AND THE ADMINISTRATION DEPARTMENT; CREATING POSITIONS WITHIN EACH DEPARTMENT AS DIRECTORS OF THEIR RESPECTIVE DEPARTMENTS; COMBINING CERTAIN ON-GOING FUNCTIONS AND OPERATIONS OF THE CITY WITHIN EACH DEPARTMENT; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 3.05 of the Allen City Charter empowers the city council to provide for necessary organizational arrangements, to properly carry out its public safety, public works, recreation, library, finance and other service and administrative functions; and, WHEREAS, Section 3.06 of the Charter provides that at the head of each department there shall be a director having supervision and control of the department, subject to the city manager; and, WHEREAS, on May 6, 1995 a majority of voters in the City of Allen approved an amendment to the Charter which deleted sections specifically creating certain administrative departments so that such departments would be established by ordinance; and, WHEREAS, the city manager has recommended that those departments continue in their present structure and function until the needs of the citizens, the city council or the organization indicate otherwise; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS THAT: SECTION 1: There shall be established and maintained a police department to preserve order within the city and to secure the residents of said city from violence and the property therein from injury or loss. The chief of police shall be the chief administrative officer of the police department. The chief shall, with the approval of the city manager, appoint and remove the employees of said department and shall perform such duties as may be required of the chief by the city manager. The chief shall be appointed by the city manager for an indefinite term. SECTION 2: There shall be established and maintained a fire department to protect the city and the property of its citizens from destruction by fire and conflagration, and to provide emergency medical services. The fire chief shall be the chief administrative officer of the fire department. The fire chief shall, with the approval of the city manager, appoint and remove the employees of said department and shall perform such other duties as may be required of the fire chief by the city manager. The fire chief shall be appointed by the city manager for an indefinite term. SECTION 3: There is hereby created a public library department to provide citizens with sources of knowledge, information and enhanced quality of life. The public library shall cooperate with any other governmental authority or any person, firm or corporation under such terms as the city council may prescribe for the establishment and maintenance of a free public library. The library director shall be a qualified librarian and shall supervise and be responsible for the functions and operations of the library department. The director shall, with the approval of the city manager, appoint and remove the employees of said department and shall perform such other duties as may be required of the director by the city manager. The library director will be appointed by the city manager for an indefinite term. SECTION 4: There is hereby created a parks and recreation department to provide public gardens, recreation grounds and other open space for the pleasure and exercise of citizens. The parks and recreation director shall supervise the recreation programs, and shall be responsible for the operation and maintenance of city parks and park land. The director shall, with the approval of the city manager, appoint and remove the employees of said department and shall perform such other duties as may be required of the director by the city manager. The parks and recreation director will be appointed by the city manager for an indefinite term. SECTION 5: There is hereby created a public works department to perform the following municipal operations: engineering, constructing, paving, maintaining storm sewers and drainage systems; maintaining and operating the water distribution and waste systems; inspecting of public utility operations, maintaining and repairing of all public buildings; operating and maintaining municipal garage and automotive equipment; and such other municipal operations as may be added with the growth of the city upon recommendation of the city manager, with the approval of the city council. The public works director shall supervise and be responsible for the functions and operations of the public works department. The director shall, with the approval of the city manager, appoint and remove the employees of said department and shall perform such other duties as may be required of the director by the city manager. The public works director shall be appointed by the city manager for an indefinite term. SECTION 6: There is hereby created a finance department to manage the money resources of the City of Allen. The finance director shall supervise the accounting, payroll, investments, accounts receivable, accounts payable, utility billing and other operations of the finance department. The director shall, with the approval of the city manager, appoint and remove the employees of said department and shall perform such other duties as may be required of the director by the city manager. The finance director shall be appointed by the city manager for an indefinite term. SECTION 7: There is hereby created an administration department to supervise and coordinate the various functions and operations performed by other departments of the administrative service of the City of Allen, and to provide administrative support services to those departments or to citizens as required by the city manager. The city manager shall be the head of the administration department. SECTION 8: This ordinance shall take effect upon publication.
