A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, TEXAS,
AMENDING RESOLUTION NO. 4000-5-23 ADOPTED MAY 23, 2023,
AUTHORIZING THE NOMINATION OF STRIKE PHOTONICS INC AS A
DOUBLE JUMBO ENTERPRISE PROJECT PURSUANT TO CHAPTER 2303,
SUBCHAPTER F OF THE TEXAS ENTERPRISE ZONE ACT, TEXAS
GOVERNMENT CODE (“ACT”) TO ACKNOWLEDGE THAT THE DOUBLE
JUMBO NOMINATION COUNTS AS TWO AGAINST THE CITY’S TOTAL
NUMBER OF SIX (6) DESIGNATIONS ALLOWED PER BIENNIUM; FINDING
AND DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION IS
PASSED WAS NOTICED AND IS OPEN TO THE PUBLIC AS REQUIRED BY
LAW; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Allen, Texas (“City”) previously passed Ordinance No. 3365-2-16 electing to
participate in the Texas Enterprise Zone Program, and the local incentives offered under this resolution are the
same on this date as those outlined in Ordinance 3365-2-16; and,
WHEREAS, on May 23, 2023, the City Council previously passed Resolution No. 4000-5-23(R) electing to
nominate Strike Photonics Inc as a Double Jumbo Enterprise Project Pursuant to Chapter 2303, subchapter F
of the Texas Enterprise Zone Act, Texas Government Code (“Act”); and,
WHEREAS, the Office of the Governor Economic Development and Tourism (“EDC”) through the Economic
Development Bank (“Bank”) will consider Strike Photonics Inc as a Double Jumbo Enterprise Project pursuant
to a nomination and an application made by the City; and,
WHEREAS, a Double Jumbo nomination counts as the use of two designations against the City’s total number
of six designations allowed per biennium; and,
WHEREAS, the City desires to amend Resolution No. 4000-5-23 to acknowledge that a Double Jumbo
nomination counts as the use of two designations against the City’s total number of six designations allowed
per biennium;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALLEN,
COLLIN COUNTY, TEXAS, THAT:
SECTION 1. Resolution 4000-5-23 is hereby amended to add the following Recital to read as follows:
“WHEREAS, A Double Jumbo nomination counts as the use of two designations against the City’s total
number of six designations allowed per biennium; and,”
SECTION 2. The findings of the City and its actions approving this resolution taken at the council meeting are
hereby approved and adopted.
SECTION 3. Resolution No. 4000-5-23 shall remain in force and effect as the date of its adoption on May 23,
2023.
SECTION 4. This Resolution shall take effect immediately upon its passage.
