Min - City Council - 1973 - 05/03 - RegularREGULAR MEETING May 3, 1973 City Council, City of Allen Present: Mayor: Frank Dugger Councilmen: Clifford Hart, Johnny Pannell, Johnnie Blankenship & Bob Lowman. Absent: C.D. Whitaker. Motion Bob Lowman Second Johnnie Blankenship that minutes of previous meeting be approved ase read. Motion Carried 4 For 0 Against. Motion Johnny Pannell Second Bob Lowman that Ordinance No. 152 be approved annexing 17.208 acres of land in the rim. Perrin Survey owned by Ziniova Dimitratus also 1.00 acre of land owned by Thomas W. McGarity in the WSm. Perrin Survey. Motion Carried 4 For 0 Against. Motion Bob Lowman Second Clifford Hart that Resoluation be adopted authorizing the law firm of Abernathy & Orr to proceed with condemnation proceedings for the purpose of securing easements over and across property owned by Richard J. Potter, Glen Betts and V.A. Davidson. Motion Carried 4 For o Against. Council discussed the possibility of drawing an Ordinance restricting the drilling for Oil or other minerals inside the Corporate Limits. Council suggested the City Attorney be contacted on this matter. Kent Statler representing Sunnyvale Building Company appeared before Council requesting release for occupancy of seven houses completed by their Company on Valley View Drive in Hillside Village Addition A. The Alleys in this subdivision have not been paved by the Developer. Mr. Statler stated that in his Company's contract with the Developer the alleys were supposed to have been completed by August 1, 1972. Mr. Statler also admitted that his company knew at least 6 months prior to this date that they knew of the City of Allen's policy of withholding services untill all streets, alleys and utilites were completed, there could be no houses occupied in this subdivision untill these services were completed. After discussion, Council unamiously agreed that the City's Ordinance should be upheld and no occupancy would be permitted in this subdivision untill all streets and alleys are completed according to City Specifications. Council agreed to accept dedication of sewer line on property owned by S.M. Whisenant in the W.J. Jackson Survey running South from the Allen Texaco station to the City sewer line behind residences located on the North side of Ola Lane, also to commence proceedings on drafting a pro -rata ordinance on tapping water and sewer lines in the City. Joe Dillard, Chairman of the Library Board, appeared and reccomend that Mary Tod be granted maternity leave from her position as Librarian. Replacement to be paid a salary of $1.75 per hour based on 20 hours per week. Mrs Tod will work 10 hours per week at her regular salary of $2.35 per week. Council agreed to accept this reccomendation. ki _ W.A. Eubanks appeared before Council and presented plat on a subdivision he proposes to open on the East side of FM 2551 approximately one-half mile South of FM 2170. Mr Eubanks asked the possibility of purchasing water from the City of Allen for this project. Council advised that since this was in the City of Lucas he would have to have a release from them before the City would con- sider his plat. Motion Bob Lowman Second Johnnie Blankenship that bills presented be app- roved. Motion Carried 4 For 0 Against. 44 If Jerry King representing the Little League program from the City of Lucas, appeared before Council in regard to this years Little League program. Council agreed on a fee of $95.00 to be paid by Lucas to participate in this years program. This was agreeable to Mr. Ring. Motion Bob Lowman Second Johnnie Blankenship that meeting adjourn.
