R-3121-11-12RESOLUTION NO. 3121-11-12(R) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AMENDING THE CITY SCHEDULE OF FEES AND CHARGES BY ADOPTING FEES AND CHARGES AUTHORIZED BY ALLEN LAND DEVELOPMENT CODE SECTION 1.08 "CERTIFICATES OF OCCUPANCY," ARTICLE H "ADMINISTRATION," ARTICLE IH -BUILDING REGULATIONS,^ ARTICLE IV "ZONING REGULATIONS,' ARTICLE VI "SPECIAL ZONING PROVISIONS," SECTION 7.09 `SIGN REGULATIONS," ARTICLE VIII "SUBDIVISION REGULATIONS," AND ARTICLE X "PARKLAND DEDICATION;" PROVDING FOR REPEAL OF CONFLICTING RESOLUTIONS; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 1.08 "Certificates of Occupancy," Section 7.09 "Sign Regulations" and one or more sections in Article B "Administration," Article III "Building Regulations," Article IV "Zoning Regulations," and Article VIII `Subdivision Regulations" of the Allen Land Development Code, as amended, provide for the assessment of fees and charges related to services, inspections, permits, and other purposes services as described in said sections and articles; and, WHEREAS, such fees and charges have previously been adopted by ordinance of the City Council and set forth in various sections and appendices of the Allen Land Development Code; and, WHEREAS, consistent with the practice established for most fees and charges assessed under various ' provisions of the Code of Ordinances of the City of Allen; the City Council has amended the Allen Land Development Code to provide for various fees and charges authorized by the Allen Land Development Code to be adopted and amended by resolution of the City Council; and, WHEREAS, the City Council finds it necessary and in the public interest to adopt this resolution for the purpose of completing the transition of the method for adopting most fees and charges under the Allen Land Development Code as well as provide for the amendment of certain fees and charges necessary to recover a substantial portion of the City's costs related to providing the related services. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, THAT: SECTION 1. The City Council hereby adopts the fees and charges relating to subdivision filings, development permits, zoning, sign permits, and fire code fees set forth in Exhibit "A," attached hereto and incorporated herein by reference, which fees and charges shall become a part of the City's official schedule of fees maintained by the Office of the City Secretary. SECTION 2. The resolutions of the City of Allen, Collin County, Texas, in conflict with the provisions of this resolution are hereby repealed; provided, however, that all other provisions of said resolutions not in conflict with the provisions of this resolution shall remain in full force and effect. SECTION3. General development plan. No fee. B. Residential. For single-family uses: Preliminary plat: $250.00 per plat plus $15.00 per lot. Final plat: $350.00 per plat plus $25.00 per lot. For multifamily uses: Preliminary plat: $250.00 per plat plus $7.50 per unit. Final plat: $350.00 per plat plus $10.00 per unit. Combination plat: $350.00 per plat plus $17.50 per unit. C. Other uses. For commercial, industrial, institutional and other uses not normally platted in lots: Preliminary plat: $150.00 per plat plus $15.00 per acre. Final plat: $200.00 per plat plus $25.00 per acre. Combination plat: $300.00 per plat plus $40.00 per acre. All acreage will be rounded up to the nearest whole acre. D. Amendingplats. $150.00 per plat. ' E. Refiling. When a preliminary plat has been disapproved by the commission, and the subdivider refiles a new design for all or a lesser portion of the preliminary plat within 30 days of such disapproval, no new fee shall be charged for the refiling. When a plat has been withdrawn by the applicant, no new fee shall be charged for refiling if resubmitted within 60 days of the date that the plat is withdrawn. After 60 days fees shall apply as an original submission. 2. PERMIT FEES A. Temporary use permit: $100.00. B. Temporary use permit renewal: $100.00. C. Clearing and grading permit: $50.00. Will require a cash bond of $0.50 per square yard ($2,420.00 per acre) refundable if subdivision construction commences within 180 days from issuance of permit. D. Development permit: $100.00. E. Tree removal permit: $100.00. F. Thirty -day tree removal extension: $50.00. ' 3. OTHER CHARGES A. Park fees. Park fees shall be $645.00 per residential unit. Resolution No. 3121-11-12(R), Page 3 B. Certificate of occupancy for change in occupancy or business use. The fee for a certificate of occupancy for change in occupancy or business use shall be $75.00. ' 4. APPEALS TO TRE BOARD OF ADJUSTMENT, SIGN CONTROL BOARD AND BUILDING & STANDARDS BOARD A. $100.00. 5. ZONING FEES A. Zoning amendments. 1. Residential: $500.00 plus $10.00 per acre. 2. Commercial: $500.00 plus $10.00 per acre. 3. Specific use permit: $350.00 plus $10.00 per acre. 4. Specific use permit (existing structure): $250.00. 5. Planned development: $500.00 plus $10.00 per acre. 6. Public hearing sign fee: $200.00. 7. Temporary use permit of renewal: $100.00. 8. TABC verification for wet/dry location, zoning, and distance separation: $250.00. B. Site plan review. $250.00 per site plan. All acreage will be rounded up to the nearest whole acre. 6. SIGN PERMIT FEES ' In the event the application is not approved, the fee shall be refunded at a rate of 50 percent. A. Fees for a permit to erect, alter, replace or relocate any temporary sign shall be as follows: 1. $100.00 per year, renewable annually. 2. $30.00 for banners, special events, and grand openings. 3. $100.00 per year for model home/model home park signs, renewable annually. B. Fees for a permit to erect, alter, replace or relocate any freestanding or attached wall sign shall be as follows: 1. $100.00 illuminated. 2. $50.00 nonilluminated. C. Fees for a permit to renew any billboard shall be as follows: $200.00 per face, renewable annually. D. Fee for a sign plan for permanent signs in retail, commercial, industrial, and office districts shall be a minimum of $300.00, or 80 percent of the fee if each sign were permitted separately, whichever is greater. E. Fee for all other signs shall be $50.00. 7. FIRE CODE FEES Resolution No. 3121-11-12tR1, Page 4 Permitfees. Fees for each permit required, other regulatory storagelhandling, equipment use or process, shall be charged to perform necessary plan reviews and field inspections. ' Construction permit fees. Permit fees for all new installations of, or modification to, automatic fire extinguishing systems, automatic detection systems, or automatic fire command and control systems shall be as shown in Table 105.8.1. Any company performing work that requires a permit per this code shall register with the fire department prior to any work being done in this city. Registration shall be good for one ' year, or at such time the company's state certificate of registration expires. A copy of state certification (if applicable), a copy of applicant's driver's I icense and annual fees are due at time of registration application.
