R-3002-3-11RESOLUTION NO. 3002-3-11(R) ' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, APPROVING THE COLLIN COUNTY MULTI - JURISDICTIONAL LOCAL MITIGATION STRATEGY ATTACHED AS EXHIBIT "A"; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A REPEALING CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Allen, with the assistance from the North Central Texas Council of Governments (NCTCOG) has gathered information and prepared the Collin County Multi -Jurisdictional Local Mitigation Strategy; and, WHEREAS, the Collin County Multi -Jurisdictional -Local Mitigation Strategy has been prepared in accordance with FEMA requirements at 44 C.F.R. 201.6; and, WHEREAS, the City of Allen is a local unit of goverra ent that has afforded the citizens an opportunity to comment and provide input in the Plan and the actions in the Plan; and, WHEREAS, the City Council of the City of Allen has reviewed the Plan and affirms that the Plan will be updated in accordance to the plan maintenance process described. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, THAT: ' SECTION 1. The Collin County Multi -Jurisdictional Local Mitigation Strategy is approved in its entirety, incorporating both local and multi jurisdictional elements. SECTION 2. The City of Allen will pursue available funding opportunities for implementation of the proposals designated therein, and will, upon receipt of such funding or other necessary resources, seek to implement the actions contained in the mitigation strategies. SECTION 3. The City of Allen will continue to participate in the multi jurisdictional mitigation planning process, including reporting of progress as required by FEMA and the Governor's Division of Emergency Management. SECTION 4. Should any word, sentence, paragraph, subdivision, clause, phrase or section of this resolution, be adjudged or held to be void or unconstitutional, the same shall not affect the validity of the remaining portions of said resolution which shall remain in full force and effect. SECTION 5. All prior resolutions of the City of Allen, Collin County, Texas, in conflict with the provisions of this resolution, and the same are hereby repealed; provided, however, that all other provisions of said resolutions not in conflict with the provisions of this resolution shall remain in full force and effect. SECTION 6. This resolution shall take effect immediately from and after its passage in accordance with the provisions of the Charter of the City of Allen, and it is accordingly so resolved. 1 DULY PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, ON THIS THE 22 No DAY OF MARCH, 2011.
