' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN
COUNTY, TEXAS, APPROVING THE TERMS AND CONDITIONS OF AN
INTERLOCAL AGREEMENT BETWEEN THE CITY OF ALLEN, THE CITY OF
PLANO, THE CITY OF FRISCO, THE CITY OF MCKINNEY, AND THE CITY OF
WYLIE AND THE COUNTY OF COLLIN, TEXAS FOR THE DISBURSEMENT OF
THE RECOVERY ACT: EDWARD BYRNE MEMORIAL JUSTICE ASSISTANCE
GRANT (JAG) FORMULA AWARD FUNDS; AUTHORIZING ITS EXECUTION BY
THE CITY MANAGER; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Interlocal Cooperation Act, Chapter 791 of the Texas Government Code,
authorizes governmental entities to contract with each other to perform government functions and
services under the terns thereof; and,
WHEREAS, the City of Allen, the City of Plano, the City of Frisco, the City of McKinney, the City
of Wylie and Collin County have previously agreed that the Plano Police Department would serve as
Fiscal Agent for the JAG Grant; and,
WHEREAS, the funds are ready to be disbursed pursuant to the attached Interlocal Agreement,
which is the subject of this resolution; and,
' WHEREAS, this Agreement is made under the authority by the American Recovery and
Reinvestment Act of 2009 (Public Law 111-5) (the "Recovery Act") and by 42 U.S.C. 375l (a); and,
WHEREAS, each governing body, in performing governmental functions or in paying for the
performance of governmental functions hereunder, shall make that performance or those payments
from current revenues legally available to that party; and,
WHEREAS, each governing body finds that the performance of this Agreement is in the best
interests of all parties, that the undertaking will benefit the public, and that the division of costs fairly
compensates the performing party for the services or functions under this agreement; and,
WHEREAS, the City of Allen, the City of Plano, the City of Frisco, the City of McKinney, the City
of Wylie and Collin County believe it to be in their best interests to reallocate the JAG funds; and,
WHEREAS, upon full review and consideration of the Agreement, and all matters attendant and
related thereto, the City Council is of the opinion that the terms and conditions thereof should be
approved.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALLEN,
COLLIN COUNTY, TEXAS, THAT:
' SECTION 1. The City Council authorizes the City Manager to enter into an Interlocal Agreement between
the City of Allen, City of Plano, City of Frisco, City of McKinney, City of Wylie and the Collin County
Sheriffs Office for the Recovery Act: Edward Byrne Memorial Justice Assistance Grant (JAG) formula
grant.

SECTION 2. This resolution shall take effect immediately from and after its passage in accordance with
the provisions of the Charter of the City of Allen, and it is accordingly so resolved.
