SPECIAL SESSION

Councilmen: Joe Farmer, Charles Chandler, Glean Andrew, H.C. Brooks, Jr.
and H.R. Dougherty
Motion Farmer Second Chandler to approve minutes of previous meeting. Motion
carried 5 for 0 against.
They -mayor reported on an item from the previous meeting concerning the approval
of Green Meadows Estates final plat. As the developer bad agreed to flair the
culverts per the request of the city engineer, the final plat has been signed.
As the school and city had determined that the most desirable location for a
middle school and park site, was a 28 acre site owned by a Joseph Reddick, the
school beard had resolved to prepare acquisition of the property by condemnation.
As the council was in agreement to this purchase, a motion wan made by Andres
Seconded by Chandler to resolve that our city attorney be instructed to prepare
for condemnation of the property in question. Motion carried on this resolution
5 for 0 against.
Charles Crouch, engineer for the Fountain Park East development, presented the
preliminary plat of Phase I again for council's consideration, proposing front
entry garages except for those joining Fountain Park and Walden Park. The mayor
allowed those wishing to speak for or against to speak. Many spoke against this
proposal, mainly because of no alleys, front entries, and the garlage problems
created by the emission of alleys, parking "Isms, safety of children, and the
feeling that this would lower the value of their existing hoes. Mr. Petty of
the Hillside Association felt that the council was using a double standard, as
they had been told by council at a previous meeting that they did not have the
power to require a builder to construct rear entry homes. The mayor stated that
their powers had not changed, that they were dealing with a plat this time and
deed restrictions by the developer were the guidelines forrear entry hoses.
After each councilman expressed his opinion concerning the plat, with most
stating that they wanted to see continuity of alleys in that neighborhood. Mr.
Merton then said that even though our ordinances do not require alleys is a
subdivision, he would put another row of alleys for a buffer. Joe Farmer then
proposed that Mr. Norton modify the plat by adding alleys to the lots from High
Meadow south to Rivererest and would have underground utilities,(Mr. Morton had
agreed to the underground utilities) and those lots from High Meadow north would
have easements only. This proposal would mean that only 69 lots would not have
an alley. Chandler agreed to this, Andrew disagreed as he rented alleys in all
arms with strict continuity. Brooks felt that if Morton added the additional
alley for a buffer and underground utilities, it wasn't his place to tell him
whether to build front or rear entry. Daugherty felt that even tho they dida!t
have the right, he heard the voice of the people and would vote against the plat
as drawn and as proposed with amendments. A motion was then made by Daugherty
to accept with the stipulation that it include alleys, undergraud utilities
and rear entry garages, for the sake of continuance neighborhoods. NOtion died
for lack of a second.
A notion was thea made by Andrew to approve plat as presented contingent upon
inclusion of alleys in all areas and include underground utilities. Motion died
for lack of a second.
A motion was then made by Farmer that they approve the plat subject to developer
agreeing to pot alleys in all areas enclosed by High Meadow on the worth, to Bivercrest
on the south, Allen Heights on the east, and the alley behind Spring Willow and Sandy
Trail on the vest and that the whole development have underground utilites. Second
by Chandler. Motion defeated by 3 against and 2 for.
Motion than made by Brooke that they approve the plat as ameadedby Mr. Morton, with
the additional street vlth am alley for buffer, from High Meadow to Rivercrest, with
alleys behind the cul de sacs and sidewalks fronting the schools and park site. Motion
died for lack of 2nd.
Motion Daugherty to table until next meeting. Second Brooks. Motion carried 3 for
2 against. (Joe a Olen)
Mr. laterman requested permission to begin construction of homes in Fountain Park
3 A 4 before the streets are conpleted. The streets are to be completed by the end
of February and constuction on the houses around February let. All utilities
have been installed and accepted by the city at this time. Motion Brooks to grant
permission for construction to begin, with no occupancy until streets are completed.
Second by Daugherty. Motion carried 5 for 0 against.
The mayor reported that their council committee was still nakiag every effort to
work with the City of Plano, the developer and the property owners along the
Plano/Allen boundary.
Motion Andrew Second Daugherty to approve 1978 audit. Motion carried 5 for 0 against.
Motion Andrew Second Daugherty to pay bills, including draw from Colson Coast for
Capital improvements (15" interceptor sewer line) is the amount of #39102.09,
which will be paid with 1972 revenue bond funds. Motion carried 5 for 0 against.
Motion Daugherty Second Andrew to adjourn. Motion carried 5 for 0 against.
