Min - City Council - 1979 - 04/05 - RegularCITY COUNCIL April 5, 1979 Present: Mayor M.B. Pierson Councilmen: Charles Chandler, Glenn Andrew, A.C. Brooks, Jr. and H.R. Daugherty Absent: Joe Farmer Motion Andrew Second Brooks to approve minutes of the previous meeting. Motion carried 4 For 0 against. Mary Kest came before the council in reference to a problem that she had bad with the Water and Sewer Department and the time element involved in correcting a sewer lea' She had several questions involving the operation of this department, which Mayor Pierson answered for her. Del Morton presented a packet of material to the council containing sample subdivision and pro rata ordinances from other cities, along with some ideas that the developers had of what they hoped the subdivision ordinance would contain, so that they, the developers, would have definite guidelines from the beginning of a development project, such as fees, definitions, application and desiga procedures and eaforcemeat provisions. Mr. Boyd Williams, T.P. & L., also submitted a proposed change of terminology is the section having to do with the utilities. A Public Hearing was to have been held on the proposed closing of a portion of McDermott between Ash and Cedar; however, a motion was made by Andrew Second by Brooks to table the hearing until April 19, based on the fact that the school had not let the council know their feelings about the amount of money involved is moving the utility lines in that area. Motion carried unanimously. Tom Reeder, Dept. of Human Resources, returned to the council, at their request. In the previous meeting, he had requested assistance for this aew agency is this area. Motion Brooks that $100 be donated and that they endorse the organization and project, and felt that other organizations which were looking for service projects, would be interested, but should he not get further assistance, be could return at a later date. Motion seceaded by Chandler and carried usaalmously. As the vehicle and traffic ordinances had been codified, so that they might be more effectively used, a motion was made by Brooks Second by Andrew to adopt ordianace , the Vehicle and Traffic Cade, for the City of Allen. Motion carried 4 for 0 against. Motion Brooks Secoad Daugherty to appoint the Election Judge, Frank Dugger, and his clerks, C.D. Whitaker, Margaret McBride, and Ernest Roberts, the coavassiag committee for absentee voters. Motion carried unanimously. Motion Brooks Second Andrew to appoint Olen Swaner as Municipal Court Judge. Motion carried 4 for 0 against. As cutllaed by the Charter, this is a two year term, with April being the anniversary date for this appointment. The names of David Morgan, Dick Erickson, Dick Strauss were submitted for the unexpired term of Rem Womack on the Planning and Zoning Commissiea. Motion Chandler Second Andrew to appoint Dick Erickson. Motion carried unanimously. The term of office for this appoistment�expires July of 1980. i3$' The Mayor began the appointment of a committee to review the Subdivision Ordisance, drawn by Sam Wyse, by appointing Daugherty and Chandler from the council, Joe Moseley and Roger Powell from Planning & Zoning, with Del Morton to be the consultant from the developers. Two from the community at large will be selected by the mayor. Bids were opened for the old Chevy pick up and the 51 panel truck. Only ase bid was received for the pick up, that being from Gary Smith for $37.50. Two bids were received for the panel truck; Danay Hooper, for $307.85 sad Cady Sberman for $125.00. Motion Daugherty to accept the bid from Gary Smith for the pick up and refect the bid on the panel truck and place it in the auction. Second by Andrew. Motion carried unanimously. Discussion followed concerning moving Council meetings, Corporation Court and P & Z meetings from City Hall to the school facilities. City Manager, Jos McCarty recommended that the Rountree Library be considered, as it seemed more suitable. Motion Andrew Second Daugherty that these be moved to the school facilities. Jon McCarty reviewed House Bills #'s 983 and 1235 to which the council expressed opposition to their passage and desired lettere be directed to reflect this feeling. M.H. Bass with Murray Development Corporation, came before the council in regard to the City's participation in the development of Exchange Parkway. As his cost estimates involved 3 lease of paving rather than the required 2 lames, he will return at a later date with a nor proposal. CoA. Richards and George Betyola, Minister of the Church of Jesus Christ, requested a variance to LR zoning at 304 R. McDermott; however, according to zoning requirements, a church must be located on 2 acres of Land. Motion Andrew Second Daugherty to set Public Hearing for April 19. Motion carried ussaimously. Walter Curtis, Tax Assessor, brought to the council's attention the effects House Bill 1060 would have on the City, should this bill pass the Senate. As this would have a drastic financial impact on tax revenues and our ability to sell bonds, the csumcil requested that a letter be sent objecting to this bill.
