Min - City Council - 1979 - 09/20 - Regular39 e REGULAR SESSION City Council September 20, 1979 Present: Mayor M.B. Pierson Councilmen: Joe Farmer, Charles Chandler, Glenn Andrew, Rex Womack, H.R. Daugherty and Richard Chumbley. Meeting called to order by Mayor M.H. Pierson. Motion Chumbley Second Womack to approve the minutes of the September 6th meeting. Motion carried unanimously. Motion Chumbley Second Womack to approve the minutes of the Special Meeting of September 15th. Motion carried unanimously. A Public Hearing was held on a zoning change request on the Edna Holt property. Request was to change from R-16 to LR. Motion Chumbley Second Womack to adopt Ordinance No. 276, an ORDINANCE OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AMENDING THE COMPRE- HENSIVE ZONING ORDINANCE OF THE CITY OF ALLEN, AS HERETOFORE AMENDED, SO AS TO CHANGE THE FOLLOWING -DESCRIBED TRACTS OF LAND FROM "R-16" RESIDENTAIL DISTRICT CLASSIFICATION TO "LR" LOCAL RETAIL DISTRICT CLASSIFICATION, SAID TRACTS OF LAND BEING DESCRIBED AS FOLLOWS: LOTS 2A,lA, AND 5A, BLOCK 2,WHISENANT ADDITION, AND LOTS 2A and 3A, BLOCK 29, OLD DONATION ADDITION TO THE CITY OF ALLEN, TEXAS: PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS FOR EACH OFFENSE: AND DECLARING AN EMERGENCY. Motion carried 7 for 0 against Tom Cravens brought the Final Plat of Oak Hill Addition before the council for the third time. A report was made regarding the repair work by Fox & Jacobs in the Hillside area. Jimmy Eaton reported that after an inspection by himself, Ron Fix and representatives of F & J, that the repair work was found to be 95% complete. After much dis- cussion a motion was made by Farmer Second Daugherty to table their decision one more time. Motion carried 4 for 3 against.(Chumbley, Womack and Pierson) Motion Farmer Second Womack to table the preliminary plat of Fountain Park 5..Motion carried 7 For, 0 against. No one was present to present the plat. Motion Andrew Second Womack to adopt Ord. No. 274, An ORDINANCE OF THE CITY OF ALLEN, TEXAS, AMENDING ARTICLE VI, DIVISION 2, "SPEED REGULATIOM. SECTION 1-46, "SPEED IN SCHOOL ZONES: SIGNS IN SCHOOL ZONES:, OF THE ALLEN VEHICLE AND TRAFFIC CODE, ORDINANCE 259 OF THE CITY OF ALLEN, TEXAS: ESTABLISHING SCHOOL ZONES: ESTABLISHING PRIMA FACIE MAXIMUM SPEED LIMITS AT 20 MILES PER HOUR IN SUCH ZONES DURING CERTAIN TIME PERIODS ON SCHOOL DAYS: DEFINING "SCHOOL DAYS"; MAKING IT UNLAWFUL TO PASS WITHIN SCHOOL ZONES: PROVIDING A PENALTY CLAUSE, A SEVERABILITY CLAUSE AND AN EFFECTIVE DATE. Motion carried unanimously. Motion Chumbley Second Farmer to appoint Dr. A.E. Vita as City Health Officer for 1979-80. Motion carried 7 for 0 against. Motion Daugherty Second Chandler to sign lease with Southern Pacific Railroad for placement of an emergency warning siren. Motion carried 7 for 0 against. Motion Farmer Second Andrew to authorize Ron Fix to advertise for bids on the water line from the Hillside overhead storage tank to Highway 75. Motion carried 7 for 0 against. Motion Daugherty Second Chandler to authorize Ron Fix to seek bids on street repair and construction on the alley between Bonham Drive and Federal, Rivercrest and Oldbridge. Motion carried 7 for 0 against. Motion Farmer Second Chumbley to pay the Engineering Fee in the amount of $4972.80 for Contract No. 790701 "30" and "24" Water Lines out of the 1972 Revenue Bond Funds. Motion carried unanimously. Bob Gass, of Fox and Jacobs, presented two alternatives to the resurfacing of Sunny Slope street, which had been heavily damaged by the heavy truck and equipment traffic during the building program of Fox and Jacobs. An estimate of $49,591 was submitted for an asphalt surface, or $89619 for concrete; which they would hope that the city would participate in, should we require that type of surface. Further research is to be done by our engineer as to the total amount of work to be done and the cost of going all concrete and hopefully including it in with the other street bids. At that point, the City and F & J are to decide how much each can contribute. Motion Daugherty Second Chandler to adjourn into Executive Session. Motion carried unanimously. The Regular Meeting was again called to order. Motion Chumbley Second Farmer to adopt Ord. No. 277, An ORDINANCE OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, APPROVING AND ADOPTING THE BUDGET FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 1979, AND TERMINATING SEPTEMBER 30, 1980. Motion carried 7 for 0 against. Motion Womack Second Andrew to adopt Ord. No. 278, AN ORDINANCE OF THE CITY OF ALLEN, COLLIN COUNTRY TEXAS, SETTING, FIXING, AND ADOPTING THE TAX RATE FOR THE CITY OF ALLEN, TEXAS, FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 1979, AND ENDING SEPTEMBER 30,1980: AND PROVIDING AN EFFECTIV DATE FOR THIS ORDINANCE. Motion carried 7 for 0 against. Motion Farmer Second Andrew to adjourn into Executive Session. Motion carried 7 for 0 against.
