R-2520-5-06RESOLUTION NO. 2520-5-06(R) ' A RESOLUTION OF THE CITY COUNCIL OF TRE CITY OF ALLEN, COLLIN COUNTY, TEXAS, ESTABLISHING WATER VOLUMETRIC CHARGES FOR A PERIOD OF CONSTRAINED WATER SUPPLY; PROVIDING FOR A REPEALING CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. NOW, THEREFORE, BE TT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, THAT: WHEREAS, The City of Allen receives it's treated water supply from the North Texas Municipal Water District (NTMWD) and is a Member City in the NTMWD; and, WHEREAS, the City of Allen has adopted the NTMWD Model Drought Contingency Plan as its City's Drought Contingency Plan; and, WHEREAS, the ongoing drought situation and long range drought forecast show continuation of the drought situation, and, WHEREAS, the NTMWD, by letter dated May 1, 2006, expressed concern that water usage quantities that have been exacerbated by the drought may lead the district to exceed its water rights authorized by the State of Texas; and, WHEREAS, the voluntary water conservation measures on Stages 1 and 2 of the Drought Contingency Plan have not caused significant reduction in water usage; and, WHEREAS, the NTMWD by letter dated May 1, 2006, has announced that effective June 1, 2006, Stage 3 of the Drought Contingency Plan is in effect; and, WHEREAS, the NTMWD, by letter dated May 1, 2006, strongly recommends the implementation of a 25- 50% increase in water rates for usage above 10,000 gallons in order to help stimulate water conservation; and, WHEREAS, by Resolution 2500-3-06(R) dated March 14, 2006, the Allen City Council established a range of water rate increases for periods of constrained water supply. NOW, THEREFORE, BE IT BE RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALLEN. COLLIN COUNTY, TEXAS, THAT: SECTION 1. The water rates for residential, commercial, and irrigation accounts set forth under the 25% (twenty-five percent) column of the rate table in SECTION 3 of Resolution 2500-3-06(R) for Volumetric Charge for periods of constrained water supply are hereby in effect until further action by the City Council. SECTION 2. Should any word, sentence, paragraph, subdivision, clause, phrase or section of this resolution, be adjudged or held to be void or unconstitutional, the same shall not affect the validity of the remaining portions of said resolution which shall remain in full force and effect. SECTION 3. All prim resolutions of the City of Allen, Collin County, Texas, in conflict with the provisions of this resolution, and the same are hereby, repealed; provided, however that all other provisions of said ' resolutions not in conflict with the provisions of this resolution shall remain in full force and effect. SECTION 4. This resolution shall take effect on June 1, 2006 and shall be used for preparation of utility bills prepared after July 1, 2006 in accordance with its provisions of the Charter of the City of Allen, and its is accordingly so resolved.
