' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN
COUNTY, TEXAS, APPROVING THREE LICENSE AGREEMENTS WITH THE
DALLAS AREA RAPID TRANSIT (DART) FOR THE INSTALLATION OF
PAVING, DRAINAGE, AND WATER UTILITY IMPROVEMENTS ACROSS DART
RIGHT-OF-WAY (ROW) IN ASSOCIATION WITH THE ST. MARY DRIVE
(PHASE III) CAPITAL PROJECT; AUTHORIZING THE CITY MANAGER TO
EXECUTE THE LICENSE AGREEMENTS; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, DART owns the railroad tracks that parallel US 75 and bisect the City of Allen; and,
WHEREAS, DART requires a formal license of any crossing or use of its right-of-way (ROW); and,
WHEREAS, the St. Mary Drive (Phase III) Capital Project requires the installation of paving, drainage, and
water utility improvements across the DART ROW.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALLEN,
COLLIN COUNTY, TEXAS, THAT:
SECTION 1. The License Agreements by and between the City of Allen, Texas, and DART are hereby
approved, and the City Manager is authorized to execute the License Agreements on behalf of the City.
' SECTION 2. This resolution shall become effective from and after its passage.

COUNTY, TEXAS, ON THIS THE 13TH DAY OF JUNE, 2006.
