R-2474-1-06RESOLUTION NO. 2474-1-06(R) ' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AUTHORIZING THE CITY MANAGER TO DELEGATE SIGNATORY AUTHORITY TO THE DIRECTOR OF ENGINEERING FOR THE PURPOSES OF EXECUTING, APPROVING, AND ACCEPTING RESPONSIBILITY FOR STORM WATER POLLUTION PREVENTION PLANS (SWPPP) FOR ALL CONSTRUCTION PROJECTS, FOR WHICH THE CITY OF ALLEN IS OWNER; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Title 30, Rule 305.44(a) of the Texas Administrative Code requires that Stoma Water Pollution Prevention Plan documents, m an application to the State of Texas, shall be executed by either a principal executive officer or a ranking elected official; and, WHEREAS, neither elected officials or the City Manager are afforded direct knowledge or daily operational supervision of construction -related activity; and, WHEREAS, Title 30, Rule 305.128(a) of the Texas Administrative Code makes provision for a written authorization of a delegate for these matters; and, WHEREAS, the City Council is of the opinion that the Director of Engineering is capable and qualified to accept responsibility for such affairs on behalf of the City of Allen, being a licensed professional engineer in the State of Texas and having direct involvement and immediate supervision for construction projects on behalf of ' the City of Allen, Texas. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, THAT: SECTION 1. The Director of Engineering, or his designee, is hereby authorized to execute Storm Water Pollution Prevention Plans (SWPPP) on behalf of the City of Allen, Texas. SECTION 2. This Resolution is hereby approved by the affirmative vote of the majority of the members of the City Council of the City of Allen, Texas, at a regularly scheduled meeting of the City Council. SECTION 3. This Resolution shall become effective immediately from and after its passage DULY PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, ON THIS THE 10'n DAY OF JANUARY, 2006.
