' AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN
COUNTY, TEXAS, AMENDING THE CODE OF ORDINANCES BY ADDING
SECTIONS 3-22 THROUGH 3-28 OF CHAPTER 3, "ANIMALS AND FOWL" TO
CREATE AN ANIMAL SHELTER ADVISORY COMMITTEE; PROVIDING FOR
APPOINTMENT, REMOVAL AND TERMS OF OFFICE AS MEMBERS; PROVIDING
FOR MEETINGS AND DUTIES OF THE COMMITTEE ORDAINING OTHER
MATTERS; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City operates an animal shelter within its city limits, and is required by Sec. 823.005, Health
and Safety Code, V.T.C.A., to appoint an Animal Shelter Advisory Committee to assist the City in complying
with Chapter 823 of the Health and Safety Code; and,
WHEREAS, upon full consideration of the above, it is of the opinion of the City Council that the creation of an
Animal Shelter Advisory Committee is in the best interest of the City and its citizens.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN,
COLLIN COUNTY, TEXAS, THAT:
SECTION 1. The Code of Ordinances of the City of Allen, Collin County, Texas, is hereby amended by
amending Chapter 3, Animals and Fowl, to add Sections 3-22 through 3-28 providing for an Animal Shelter
' Advisory Committee which shall read as follows:
Sec. 3-22. Animal Shelter Advisory Committee, Purpose.
An Animal Shelter Advisory Committee is hereby created to assist the city and its animal control unit in
compliance with state regulations concerning the operation of animal shelters. The committee shall be advisory in
nature and shall not have any responsibility or authority over any board, commission, public official or employee
of the city.
Sec. 3-23. Members.
The Animal Shelter Advisory Committee shall consist of five (5) members appointed by the city council as
follows:
One (1) licensed veterinarian;
One (1) municipal official;
One (1) person whose duties include the daily operation of an animal shelter and is employed by the City
of Allen as Animal Control Supervisor;
One (1) representative from an arm al welfare organization; and
One (1) person who resides in the city.

Sec. 3-24. Terms; vacancies.
The terms of office of each member of the Animal Shelter Advisory Committee shall be two (2) years with
staggered appointments so that no more than two (2) members'terms shall expire in any one (1) year. The city
council shall fill any and all vacancies on the committee excluding Animal Control Supervisor.
Sec. 3-25. Officers.
The city council shall appoint a chairperson for a one (1) year term. In addition, the committee shall have a
vice — chairperson and a secretary who are elected by its members for one (1) year terms. The secretary of the
committee shall keep a record of all proceedings of the committee. The City of Allen Animal Control
Supervisor shall serve as permanent secretary.
Sec. 3-26. Meetings; quorum.
The Animal Shelter Advisory Committee shall meet three (3) times a year. A simple majority of the
committee shall constitute a quorum. A vote of the simple majority of the quorum shall be required for any
action taken by the committee.
Sec. 3-27. Removal of Members.
All members of the committee are subject to removal in accordance with the city council's current policy with
regard to required attendance at city board, commission and committee meetings. In addition, the members of
the committee may be removed at any time by the city council with or without cause.
Sec. 3-28. Duties.
The committee shall have the following duties:
(1) To assist the Animal Control Unit of the city in complying with requirements of Chapter 823,
Health and Safety Code, V.T.C.A. and other applicable state and local laws, by submitting
recommendations to the animal control unit.
SECTION 2. Should any word, sentence, paragraph, subdivision, clause, phrase, or section of this
ordinance, or of the Code of Ordinances, as amended hereby, be adjudged or held to be void or
unconstitutional, the same shall not affect the validity of the remaining portions of said ordinance or the Code
of Ordinances, as amended hereby, which shall remain in full force and effect.
SECTION 3. This Ordinance shall take effect immediately upon its passage and approval by the City, as
the law and charter in such cases provide; and it is accordingly so ordained.
