' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN
COUNTY, TEXAS, APPROVING THE PROPOSAL TO SELL CERTAIN RIGHT-OF-
WAY BY THE TEXAS DEPARTMENT OF TRANSPORTATION TO THE ALLEN
ECONOMIC DEVELOPMENT CORPORATION; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the State of Texas is the owner of certain right-of-way adjacent to US Highway 75 described
in Exhibit'A' attached hereto and made a part hereof; and,
WHEREAS, the State of Texas has determined that said right-of-way is surplus and no longer needed for
the construction, maintenance and operation of US Highway 75 and desires to sell the same to the abutting
landowners; and,
WHEREAS, City Staff has made an independent determination that said right-of-way is no longer needed
for use by the citizens as a road for other public purposes, including but not limited to, public transportation;
and,
WHEREAS, the City Council approves of the State's proposal to sell the subject right-of-way described in
Exhibit'A' to the Allen Economic Development Corporation, the abutting landowner.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALLEN,
' COLLIN COUNTY, TEXAS, THAT:
SECTION 1: The recitals and determinations set forth above are hereby adopted and incorporated herein.
SECTION 2: The City of Allen hereby approves of the State's proposal to sell the right-of-way to the Allen
Economic Development Corporation, the abutting landowner.
SECTION 3: The City Secretary shall forwand a certified copy of this Resolution to Terry L. May, P.E.,
Dallas District Right -of -Way Administrator, Texas Department of Transportation, P.O. Box 133067, Dallas,
Texas 75313-3067.
SECTION 4: This Resolution shall become effective from and after its passage.

Being a 0.1535 acre tract of land in the Michael See Survey, Abstract No. 543, and the
William Peron Survey, Abstract No. 708, City of Allen, Collin County, Texas, and being
all of a called Tract #2 as described to Judgement of the Court as recorded in Volume
512, Page 457, Deed Records of Collin County, Texas, and being a part of a called
30.529 acre truer as conveyed from David B. Yarbrough to the State of Texas as recorded
in Volume 509, Page 225, Deed Records of Collin County, Texas, and being more
particularly described as follows:
Commencing at a'h" imn rod found with a cap stamped "Wier & Assoc. Inc." in the
westerly right-of-way line of U.S. Highway No. 75, and the southerly right-of-way line of
Venture Drive, being the most easterly northeast comer of Lot 3, Block A, Millenium
Office Park, as recorded in Cabinet K, Page 856, Plat Records of Collin County, Texas;
Thence S 14"03'00" W along the said westerly right-of-way line of said U.S. highway
No. 75 and the easterly line of said Lot 3, 51.14 feet to a'A" imn rod set with a cap
stamped "Wier & Assoc. Inc." for an angle point in said westerly right-of-way, line of
U.S. Highway No. 75, also being an angle point in the said westerly line of the
Yarbrough Tract;
Thence S 88°47'26" W continuing along said westerly right-of-way line of U.S.
Highway No. 75 and said westerly line of the Yarbrough Tract, 3 1. 10 feet to a'H' imn
rod set with a cap stamped "Wier & Assoc. Inc." in the proposed new westerly right-of-
way line of U.S. Highway No. 75 for the Place of Beginning,
1.) Thence S 14°03'00" W along the proposed new westerly right-of-way line of U.S.
Highway No. 75, 124.96 feet to an "X" in concrete found for a comer in the said
westerly line of the Yarbrough Tract, same being the said westerly rightof-way line
of U.S. Highway No. 75, also being in said easterly line of Lot 3;
2.) Thence N 36°17'49" W along said westerly line of Ywbmugh Tract, said westerly
Right-ef-way line of U.S. Highway No. 75, and the said easterly line of Lot 3, 105.21
feet to a 4Y' men rod set with a cap stamped "Wier & Assoc. Inc." for a comer being
an angle point in the said easterly line of Lot 3, and being an angle point in the said
westerly right-of-way line of U.S. Highway No. 75, also being the most westerly
southwest comer of said Tract #2;

of-way line of U.S. Highway No. 75, and the said westerly line of Tract S2, 34.48 feet
to a W iron rod found with a cap stamped "Wier & Assoc. Inc." for a comer being
the northwest comer of said Tract #2 and an angle point in said easterly line of Lot 3,
and said westerly right-of-way line of U.S. Highway No. 75;
4.) Thence N 88"47'26" E along said easterly hne of Lot 3, said westerly line of Tract N2
and the said westerly right-of-way line of U.S. Highway No. 75, 94.32 feet to the
