Daugherty Glenn Andrew Ward Paxton Absent: Rex Womack City Staff: (arrived at 6:16 p.m.) Jon McCarty, City Manager Marty Hendrix, City Secretary Newly Elected Council Member Don Rodenbaugh The Called - Special Session of the Allen City Council was called to order by Mayor Pierson at 6:04 p.m. on Thursday, April 8, 1982, at Rountree Elementary School, 800 E. Main Street. Appointment of Recount Committee and Setting Date and Time for Recount of Ballots for Place No. 6 in the City Council Election held on April 3, 1982 (Supplemental Agenda Item - Emergency) Mayor Pierson advised all present of the application from Rex Womack, dated April 6, 1982, for a recount of all ballots cast for Place No. 6 in the City Council Election held on April 3, 1982. Mr. Womack's request for a recount was based upon Article 9.38a of the Texas Election Laws, subdivision 1(b), whereby a recount can be requested if there are less than 1,000 ballots cast on manually counted paper ballots. City Secretary Marty Hendrix advised the Council of the recount procedure requirements contained in the Texas Election Laws, Article 9.38a, Subdivisions 7, 8 and 9. Mayor Pierson advised of the dates for holding the recount and notification of the recount to the opposing candidates. The Council briefly discussed suggested individuals to serve on a recount committee. The Mayor opened the floor for nominations.. Councilman Andrew nominated Dr. John Horn, Mr. Ed Lynge, and Mr. Tom Reeder. i TAP, Councilman Daugherty nominated Willette Rossen. MOTION: Upon a motion made by Councilman Daugherty and seconded by Councilman McClure, the Council voted 5 - 0 that the nominations cease. The motion carried. In the order of their nominations, Mayor Pierson polled the votes of the Council Members for each nominee, with Dr. John Horn receiving five (5) votes, Mr. Ed Lynge receiving five (5) votes, Tom Reeder receiving two (2) votes and Willette Rossen receiving three (3) votes. 121 City Secretary Marty Hendrix advised the Council they had before them a copy of the Election Returns for the City Council Election held on Saturday, April 3, 1982, showing a cumulative total of the votes cast, along with a Register of Official Ballots for ballots issued in the election. There were 888 votes cast in the election (29 in absentee voting and 859 at the regular polling place). Rick Alexander It was also the consensus of the Council that if neither Kevin Tinsley Mr. Rossen nor Mr. Reeder could serve on the committee, then the Mayor could poll the Council by telephone to select another individual to serve on the committee. The Council discussed the setting of the date and time for the recount, which would be held at the Allen City Hall. Due to the limited space in the City Secretary's Office, it was suggested that it be held in the City Manager's Office. MOTION: Upon a motion made by Councilman Paxton and seconded by Councilman Daugherty, the Council voted 5 - 0 to set the date for Monday, April 12, 1982 at 1:00 p.m. Mayor Pierson advised all present that the recount com- mittee would consist of Dr. John Horn, Mr. Ed Lynge, Willette Rossen or Tom Reeder. The recount of the ballots for Place No. 6 would commence on Monday, April 12, 1982 at 1:00 p.m. in the Allen City Hall. Canvass of Election Returns from City Council Election - April 3, 1982 (Agenda Item II) Mayor Pierson advised that the canvass of the results of the City Council Election held on April 3, 1982 would be exclusive of Place No. 6 due to the request for the recount. City Secretary Marty Hendrix advised the Council they had before them a copy of the Election Returns for the City Council Election held on Saturday, April 3, 1982, showing a cumulative total of the votes cast, along with a Register of Official Ballots for ballots issued in the election. Rodenbaugh 484 Tom Johnson 121 Glenn Andrew 278 Resolution No. 386-4-82(R): Order Declaring Results of City Council Election for Mayor, Place No. 2 and Place No. 4 (Agenda Item III) MOTION: Upon a motion made by Councilman Paxton and seconded by Councilman Andrew, the Council voted 6 - 0 to adopt Resolution 386-4-82(R), declaring the results of the election, being Mickey Pierson for Mayor, Jim McClure for Councilman - Place No. 2 and Donald P. Rodenbaugh for Councilman - Place No. 4. The motion carried. (Mayor Pro Tem Farmer had arrived at the meeting.) Oaths -of -Office to Re-elected Mayor and Councilman and Newly Elected Councilman (Agenda item IV) City Secretary Marty Hendrix administered the Oath -of -Office to the re-elected Mayor, Mickey Pierson, re-elected Councilman to Place No. 2, Jim McClure, and the newly elected Councilman to r Place No. 4, Donald P. Rodenbaugh. The City Secretary presented Certificates of Election to each of the above individuals. Don Rodenbaugh took his chair on the Council. Election of Mayor Pro Tem (Agenda Item V) Due to the request for recount for Place No. 6 on the City Council, it was the consensus of the City Council to hold the election of the Mayor Pro Tem until such time as all members of the City Council are inducted. SI ALLEN CITY COUNCIL April 8, 1982 Page 4 Oath -of -Office to Jack Decatur, Place No. 2 on the Planning & Zoning Commission (Agenda Item VII) The City Secretary, Marty Hendrix, administered the Oath -of - Office to newly appointed member to Place No. 2 on the Planning and Zoning Commission, being Jack Decatur. t General Discussion Mayor Pierson suggested that the results of the recount be canvassed by the Council at the upcoming City Council Meeting to be held on Thursday, April 15, 1982, rather than holding a called - special meeting. The rest of the Council concurred with Mayor Pierson's suggestion. Adjournment MOTION: Upon a motion made by Councilman Daugherty and seconded by Councilman McClure, the Council voted 6 - 0 to adjourn the called - special session at 6:24 p.m. The motion carried. 1982.
