RESOLUTION NO. 1987-9-01(R)
' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN
COUNTY, TEXAS, AUTHORIZING THE CITY MANAGER TO EXECUTE A FIRE
LANE AND MUTUAL ACCESS EASEMENT FOR EXCHANGE HEIGHTS, LTD.,
ALONG THE EASTERN EDGE OF FIRE STATION NO. 2, FURTHER DESCRIBED
IN EXHIBITS "A" AND "B" ATTACHED HERETO; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City of Allen believes in the need to provide mutual access easements and fire lanes on property
as it is developed; and,
WHEREAS, the City of Allen also believes that it is important to limit the number of curb cuts and driveways onto
streets and thoroughfares.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALLEN,
COLLIN COUNTY, TEXAS, THAT:
SECTION 1: The City Manager is authorized to execute a mutual access and fire lane easement to Exchange
Heights, Ltd, being further described in Exhibits "A" and 'B" attached hereto and made a part hereof for all
purposes.
SECTION 2: This Resolution shall become effective immediately from and after its passage.

' Field Note Description
FIRE LANE AND MUTUAL ACCESS EASEMENT
Being a 1,380 square foot tract of land situated in the Peter Fisher Survey, Abstract No. 324, in
the City of Allen, Collin County, Texas, and being part of Tract 5A, Block A, Fountain Park
East, Installment 3, an addition to the City of Allen according to plat filed for record in Volume
C, Page 246, of the Official Land Records, Collin County, Texas, and being more particularly "
described as follows:
BEGINNING at the northeast comer of said Tract 5A, same being in the south right-of-way line
of Exchange Parkway (a 110 -foot right-of-way);
THENCE, S.0001719"W-, 57.50 feet along the common line between said Lot 5A and Lot 5 of
said Fountain Park East, Installment 3 Addition, to a point for comer;
THENCE, N.89"42'41 "W., 24.00 feet to a point for corner;
THENCE, N.00-1 719"E., 57.50 feet to a point for comer in the said south line of Exchange
Parkway;
' THENCE, S.89"42'41"E., 24.00 feet along the said south line of Exchange Parkway to the
POINT OF BEGINNING and containing 1,380 square feet or 0.0317 acres of land.

FIRE LANE AND MUTUAL ACCESS EASEMENT

6 KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF COLLIN
THAT CITY OF ALLEN, hereinafter called "Grantor, for and in consideration of good
and valuable consideration, the receipt and sufficiency of which is hereby aclmowledged, does
hereby grant, bargain, sell and convey to the EXCHANGE HEIGHTS, LTD., hereinafter called
"Grantee," the Fre Lane easement and right of ingress and egress upon and across the real
property located in Collin County, Texas, as more particularly described in Exhibit "A" which is
attached hereto and incorporated herein by reference as if fully set forth herein for the purpose of
and with the unrestricted right for ingress and egress within the easement granted. The easement
granted hereby shall be for public use.
This Easement may be assigned in whole or in party.
