Home My WebLink AboutR-1927-3-01RESOLUTION NO. 1927-3-01(R) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, APPROVING THE TERMS AND CONDITIONS OF AN INTERLOCAL COOPERATION AGREEMENT BY AND BETWEEN THE CITY OF ALLEN, TEXAS, AND TARRANT COUNTY, TEXAS, PROVIDING FOR A COOPERATIVE PURCHASING PROGRAM FOR GOODS AND SERVICES; DESIGNATING THE CITY MANAGER, OR HIS DESIGNEE, AS OFFICIAL REPRESENTATIVE OF THE CITY IN MATTERS RELATING TO THE PROGRAM; AND AUTHORIZING THE CITY MANAGER, OR HIS DESIGNEE, TO EXECUTE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council has been presented a proposed hderlocal Cooperation Agreement by and between the City of Allen, Texas, and Tarrant County, Texas, a copy of which is attached hereto as Exhibit "A" and incorporated herein by reference (herein called "Agreement'); and, WHEREAS, upon full review and consideration of the Agreement and all matters attendant and related thereto, the City Council is of the opinion that the terms and conditions thereof should be approved and that the City Manager, or his designee, shall be authorized to execute it on behalf of the City of Allen. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, THAT: ' SECTION 1: The terms and conditions of the Agreement, having been reviewed by the City Council of the City of Allen and found to be acceptable and in the best interests of the City of Allen and its citizens, are hereby in all things approved. SECTION 2: The City Manager, or his designee, of the City of Allen, under the direction of the City Council of the City of Allen, is hereby designated as the official representative to act for the City in all matters relating to the Cooperative Purchasing Program including the designation of specific contracts to which the City desires to participate. SECTION 3: The City Manager, or his designee, is hereby authorized to execute the Agreement and all other documents to connection therewith on behalf of the City of Allen, substantially according to the terms and conditions set forth in this Agreement. SECTION 4: This resolution shall become effective from and after its passage. APPROVED: Stephen MAYOR ATTEST: Judf Mo n, CMC/AAE, CITY SECRETARY g�;cc;;�- STATE OF TEXAS COUNTIES OF COLLIN AND TARRANT INTERLOCAL COOPERATION AGREEMENT This hnerlocal Cooperation Agreement ("Agreement') is by and between the City of Allen, Texas ("Allen'), and Tarrant County, Texas, acting by and through their authorized officers. Pursuant to the authority granted by the "Texas Interlocal Cooperation Act," Chapter 791 Texas Government Code providing for the cooperation between local governmental bodies, the parties hereto, in consideration of the premises and mutual promises contained herein, agree as follows: RECITALS: WHEREAS, the contract is made under the authority of Sections 791.001- 791.029 of the Texas Government Code; and, WHEREAS, the parties, in performing governmental functions or in paying for the performance of governmental functions hereunder shall make that performance or those payments from current revenues legally available to that party; and, WHEREAS, the governing bodies of each party find that the subject of this contract is necessary for the benefit of the public and that each party has the legal authority to perform and to provide the governmental function or service which is the subject matter of this contract; furthermore, the governing bodies find that the performance of this contract is in the common interest of both parties; and that the division of cost fairly compensates the performing party for the services performed under this contract. Allen hereby makes, constitutes and appoints Tan -ant County its true and lawful purchasing agent for the purpose of various commodities using Annual Contracts (Bids). Tarrant County will maintain a listing of Annual Contracts which me available for local entities to use. To utilize one or more of these contracts, local entities must request authorization in writing to Tarrant County. Upon receipt to request, Tarrant County will send a form letter to the appropriate vendor(s) for their approval and signature. Upon receipt of authorizing letter from the vendor(s), Tarrant County will forward a copy of the letter and appropriate Annual Contract to the requesting entity. Allen agrees that Tarrant County shall serve as the purchasing agent for selected items, and agrees that the bidding shall be conducted by Tarrant County according to its bidding procedures and in accordance with applicable State statutes. II. Allen agrees that all specifications for selected items shall be as determined by Tarrant County. Allen agrees to pay the supplier for all goods, equipment and products pursuant to this Agreement. The successful bidder or bidders shall bill Allen directly for all items purchased, and Allen shall be responsible for vendor's compliance with all conditions of delivery and quality of the purchased items. IV. The Allen City Manager or designee is authorized to act on behalf of Allen in all matters relating to this Interlocal Cooperation Agreement. V.
