AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN
COUNTY, TEXAS, ANNEXING 20.4877 ACRES LOCATED IN THE GRIZZEL
KENNEDY SURVEY, ABSTRACT NO. 499, COLLIN COUNTY, TEXAS, AND
MORE PARTICULARLY DESCRIBED IN EXHIBIT "A" ATTACHED HERETO;
AND EXTENDING THE BOUNDARY LIMITS OF THE CITY SO AS TO
INCLUDE SAID PROPERTY WITHIN THE CITY LIMITS AND GRANTING TO
ALL INHABITANTS AND OWNERS OF SAID PROPERTY ALL OF THE
RIGHTS AND PRIVILEGES OF OTHER CITIZENS AND BINDING ALL
INHABITANTS THEREIN BY ALL THE ORDINANCES, ACTS, RESOLUTIONS
AND REGULATIONS OF SAID CITY; ADOPTING A SERVICE PLAN FOR THE
EXTENSION OF MUNICIPAL SERVICES ATTACHED HERETO AS EXHIBIT
"B"; PROVIDING A SEVERABHdTY CLAUSE; AND PROVIDING FOR THE
EFFECTIVE DATE OF SAID ORDINANCE.
WHEREAS, the City Council of the City of Allen has heretofore received petitions signed by the owners
of all of the property hereinafter described, requesting the annexation of said land into the corporate limits
of the City of Allen; and,
' WHEREAS, the City Council of the City of Allen finds that such petition is in writing, describes the area
by metes and bounds, is duly acknowledged as required for deeds by each and every person or
corporation having an interest in said land, has been properly filed with the City and fully complies with
all the requirements of law; and,
WHEREAS, after notices were duly published, public hearings on the proposed annexation were held by
the City Council of Allen on April 6 and April 20, 2000, all in strict compliance with Local Government
Code, Chapter 43; and,
WHEREAS, the following described land is adjacent and contiguous to the present city limits of the City
of Allen and within its extraterritorial jurisdiction, and the members of the City Council of the City of
Allen have concluded that said area should be annexed and made a part of the City of Allen, Texas.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN,
COLLIN COUNTY, TEXAS:
SECTION 1: That the following described territory be, and the same is hereby, annexed by the City
of Allen, Texas, and the same shall hereafter be included within the territorial limits of the said City, and
the inhabitants thereof shall hereafter be entitled to all rights and privileges of other citizens of the City
and shall be bound by the ordinances, acts, resolutions and regulations of said City of Allen, Texas, said
property being described in Exhibit "A" attached hereto and made a part hereof, the same as if copied in
full herein.

SECTION 2: In accordance with Local Government Code §43.056, approved hereby and attached
hereto as Exhibit 'B" and made a part hereof for all purposes, is the Service Plan providing for municipal
services in the newly annexed area.
SECTION 3: It is not the intention of the City of Allen to annex any territory not legally subject to
being annexed by the City, and should any portion of the described area not be subject to legal annexation
by the City of Allen, such fact shall not prevent the City from annexing such territory which is subject to
legal annexation by the City, and it is the intention of the City of Allen to annex only such territory as
may be legally annexed by it within the described area.
SECTION 4: This ordinance shall take effect from and after its passage.

BEING a tract of land situated in the Grizzle Kennedy Survey, Abstract No. 499, Collin
County, Texas, and being more-particulafly described as follows:
BEGINNING at the intersection of the centerline of Old Custer Road (a 90 -foot right-of-
way) and the projected south right-of-way line of Hedgcoxe Road (a 11D-footright-of-way
line);
THENCE S 88" 57' 14" W, along the south right-of-way line of said Hedgcoxe Road, a
distance of 358.99 feet to a point for comer;
THENCE N 00'22' 13" E, along the projected east right-of-way line of New Custer Road
(a variable -width- right-of-way); a distance of 326.19 feet to the beginning of a curve to
the right having a central angle of 400 19' 56", a radius of 1090.92, and a tangent
distance of 400.65 feet, with a chord bearing and distance of N 200 32' 11" E, 752.17
feet;
THENCE along said curve to the right and continuing along the east right-of-way line of
New Custer Road, an arc distance of 767.93 feet to the end of said curve;
THENCE N 48'55'01 " E, continuing along the east right-of-way line of New Custer Road,
a distance of 198.17 feet to a point for comer;
THENCE N 710 05'55" E, continuing along the east right-of-way line of New Custer Road,
a distance of 75.58 feet to an angle point;
THENCE N 42'58'05" E, continuing -along -the east right-of-way line of New Custer Road,
a distance of 87.86 feet to a point for comer;
THENCE N 890 10' 21" E,- leaving the east right-of-way line of New Custer Road, a
distance of 347.56 feet to a -point for corner; said point being in the centerline of Old
Custer Road;
THENCE S 000 33'59" E, along the centerline of Old Custer Road, a distance of 351.42
feet to the beginning of a curve to the right; said curve having a central angle of 52° 29'

SERVICE PLAN FOR ANNEXED AREA
Acreage Anaexed: 20.4877 Acres
Survey, Abstract & County: Grizzell Kennedy Survey, Abstract No. 499, Collin County,
Texas.
In accordance with Section 43.056 of the TEXAS LOCAL GOVERNMENT CODE, municipal services
to the property described above will be famished by or on behalf of the City of Allen, Texas, at the same
level as is provided similarly developed areas of the city as follows:
A. Services Available on the Effective Date of Annexation:
1. Police Service, including patrol, responses to calls, and other routine police services.
2. Fire Services including fire protection and emergency ambulance services.
3. Enforcement of the city's environmental health ordinances and regulations, including but not
limited to weed and brush ordinances, junked and abandoned vehicle ordinances, and animal
control ordinances.
4. Enforcement of building, plumbing, electrical, gas, heating and air conditioning, and all other
construction codes and inspectional services.
5. Enforcement of zoning, subdivision, sign and other ordinances.
6. Pak and recreational services, facilities, playgrounds and swimming pools.
7. Solid waste collection shall be provided through and in accordance with the terms of the city's
contract with a designated solid waste collection agency to the property in accordance with
existing city policies on the effective date of the annexation unless the property owners choose
to maintain private collection services.
8. Street maintenance and street lighting.
B. Water Services
Water service is available to the property at the time of annexation on the same basis and at the
same rates as similarly situated tracts within the City.
C. Wastewater Service
Wastewater collection services are available to the property at the time of annexation on the same
basis and at the same rates as similarly situated tracts within the City.

' D. Capital Improvements
1. Any capital improvements required to serve the annexed area will be substantially
completed within 2 1k years of the effective date of the ordinance, provided that if the
capital improvements are not substantially completed within such time, this Plan may be
amended to extend the period if the construction is proceeding with all deliberate speed.
2. Property within the annexed area is subject to adopted Impact Fees in a manner not
inconsistent with Chapter 395 of the TEXAS LOCAL GOVERNMENT CODE.
This Service Plan is valid for a period of ten (10) years beginning on the 116 day of May, 2000.
