' AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN
COUNTY, TEXAS, AMENDING THE CODE OF ORDINANCES, BY AMENDING
CHAPTER 2, ARTICLE VH ADMINISTRATIVE DEPARTMENTS, BY ADDING
DIVISION 12, SECTION 2-211 CREATING THE DEPARTMENT OF BUILDING
AND CODE COMPLIANCE, AND ESTABLISHING DUTIES AND
RESPONSIBILITIES; BY AMENDING SECTION 2-191 RENAMING THE
PLANNING DEPARTMENT TO THE PLANNING AND DEVELOPMENT
DEPARTMENT AND ESTABLISHING DUTIES AND RESPONSIBILITIES;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING A REPEALING CLAUSE;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the amendments provided herein to reorganize two current departments including Community
Development and Planning shall have a monetary savings to the 1999-2000 fiscal year budget by eliminating
one (1) FFE position; and,
WHEREAS, the City Council, upon full consideration of the matter, is of the opinion that the amendments
provided herein and hereinafter set forth is proper and should be approved and adopted.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN,
COLLIN COUNTY, TEXAS:
' SECTION 1. That Chapter 2, Article VII Administrative Departments, Division 12, Section 2-211
Building and Code Compliance Department of the Code of Ordinances of the City of Allen, Collin County,
Texas, be and the same is hereby amended in part to add Division 12 Building and Code Compliance
Department, to read as follows:
"DIVISION 12. BUILDING AND CODE COMPLIANCE DEPARTMENT.
Sec. 2-211. Building and Code Compliance Department created.
There is hereby created a Building and Code Compliance Department to perform
the following municipal operations: code enforcement, health inspections, residential and
commercial plan review, permitting, building and sign inspections, zoning enforcement,
assigning addresses to all City properties, and work with the City's Building and Standards
Commission, and such other municipal operations as may be added with the growth of the
City upon recommendation of the City Manager, with the approval of the City Council.
The Chief Building Official shall supervise and be responsible for the functions and
operations of the Building and Code Compliance Department. The director, shall, with the
approval of the City Manager, appoint and remove employees of said department and shall
perform such other duties as may be required of the director by the City Manager. The
Chief Building Official shall be appointed by the City Manager for an indefinite term."
' SECTION 2: That Chapter 2, Article VII Administrative Departments, Division 10, Section 2-191
Planning Department of the Code of Ordinances of the City of Allen, Collin County, Texas, be and the
same is hereby amended in part to amend in its entirety, to read as follows:
"DIVISION 10. PLANNING AND DEVELOPMENT DEPARTMENT.
' Sec. 2-191. Planning and Development Department created.
There is hereby created a Planning and Development Department to perform the
following municipal operations: current planning (zoning administration; platting), long-term
planning (strategic planting, census, Comprehensive Plan), site plan review, Capital
Improvement Program, GIS development, tree permits, annexation, 911 addressing, grant
development and administration, work with the City's Board of Adjustment, Sign Control
Board and Planning and Zoning Commission, and such other municipal operations as may be
added with the growth of the City upon recommendation of the City Manager, with the
approval of the City Council. The Planning and Development Director shall supervise and be
responsible for the functions and operations of the Planning and Development Department.
The director, shall, with the approval of the City Manager, appoint and remove employees of
said department and shall perform such other duties as may be required of the director by the
City Manager. The Planning and Development Director shall be appointed by the City
Manager for an indefinite term."

SECTION 3. That should any word, sentence, paragraph, subdivision, clause, phrase or section of this
ordinance, or of the Code of Ordinances, as amended hereby, be adjudged or held to be void or
unconstitutional, the same shall not affect the validity of the remaining portions of said ordinance or the
Code of Ordinances, as amended hereby, which shall remain in full force and effect.
SECTION 4. That all ordinances of the City of Allen, Collin County, Teras, in conflict with the
provisions of this ordinance be, and the same are hereby, repealed; provided, however, that all other
provisions of said ordinances not in conflict with the provisions of this ordinance shall remain in full force
and effect.
SECTION 5. This ordinance shall take effect immediately from and after its passage, and publication in
accordance with its provisions of the Charter of the City of Allen, and it is accordingly so ordained.
