A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN
COUNTY, TEXAS, DETERMINING THE NECESSITY FOR THE ACQUISITION OF
PROPERTY FOR CONSTRUCTION OF A LIBRARY AND CMC AUDITORIUM AS
DESCRIBED IN EXHIBIT "A" ATTACHED HERETO; AUTHORIZING THE CITY
MANAGER AND CITY ATTORNEY TO FILE PROCEEDINGS IN EMINENT
DOMAIN TO ACQUIRE SUCH PROPERTY; AND PROVIDING AN EFFECTIVE
DATE.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALLEN,
COLLIN COUNTY, TEXAS, THAT:
SECTION 1: The City Council of the City of Allen, Texas, hereby finds and determines that a public
necessity exists for the acquisition of the properties described in Exhibit "A" attached hereto and made part
hereof for all purposes, the same as if fully copied herein, for construction of a library and civic auditorium.
SECTION 2: The City Manager and City Attorney, be, and are hereby, authorized on behalf of the City of
Allen to make a good faith offer to the owners to acquire such parcels for the City and to negotiate with and
attempt to agree with the owners on damages and compensation to be paid the owners. If the City Manager or
his designee is unable to acquire the property by agreement with the owners, he is authorized to instruct the City
Attorney to file proceedings in eminent domain against such owners to acquire the necessary properties for the
' project.
SECTION 3: If it is determined that the properties listed in Exhibit "A" are insufficiently described, the
City Attorney is authorized to secure an accurate survey and title commitment in order to secure good fee simple
legal title to the property for the City, and such actions may be taken by the City Attomey without the necessity
of obtaining additional City Council approval.
SECITON 4: This resolution shall take effect immediately from and after its passage, and it is accordingly
resolved.

COUNTY, TEXAS, ON THIS THE 7TH DAY OF DECEMBER, 2000.
