AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN
COUNTY, TEXAS, AMENDING COMPREHENSIVE ZONING ORDINANCE NO.
1425-5-96, AS PREVIOUSLY AMENDED, TO AMEND SECTION 2.10 TO DELETE
THE CURRENT DEFINITION OF HOTEL/MOTEL AND BY ADDING A NEW
DEFINITION FOR HOTEL; BY AMENDING EXHIBIT "B" SCHEDULED USES, BY
REMOVING HOTEL USES FROM ALL ZONING DISTRICTS WHERE
CURRENTLY ALLOWED AND BY ADDING FULL SERVICE HOTEL, LIMITED
SERVICE HOTEL AND SUITE HOTEL AS ALLOWED USES ONLY BY SPECIFIC
USE PERMIT IN "CC" CORRIDOR COMMERCIAL DISTRICT, "O" OFFICE
DISTRICT, "LP' LIGHT INDUSTRIAL, DISTRICT, "CBD" CENTRAL BUSINESS
DISTRICT, AND IN A "PD" PLANNED DEVELOPMENT DISTRICT WHEN SO
ALLOWED BY THE GRANTING ORDINANCE; BY ADDING SECTION 3.13
DEVELOPMENT STANDARDS FOR HOTELS; PROVIDE A SAVINGS CLAUSE;
PROVIDE A REPEALING; PROVIDING A SEVERABILITY CLAUSE; PROVIDING
A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND
DOLLARS ($2,000) FOR EACH OFFENSE; AND PROVIDING FOR AN EFFECTIVE
' DATE.
WHEREAS, the Planning and Zoning Commission of the City of Allen, and the governing body of the City
of Allen, in compliance with the laws of the State of Texas and the ordinances of the City of Allen, have given
the requisite notices by publication and otherwise, and after holding due hearings and affording a full and fair
hearing to all the property owners generally and to all persons interested and situated in the affected area, and
in the vicinity thereof, and in the exercise of its legislative discretion, have concluded that Zoning Ordinance
No. 1425-5-96 of the City of Allen, as previously amended, should be amended.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN,
COLLIN COUNTY, TEXAS:
SECTION 1. That the Comprehensive Zoning Ordinance No. 1425-5-96, of the City of Allen, Texas, as
previously amended, be amended in part, to amend Section 2.10 to delete the current definition of Hotel and
by adding a new definition for a Hotel to read as follows:
"2.10 DEFINITIONS.
69. Hotel - A building offering overnight or temporary lodging accommodations for travelers
or guestrooms for compensation on a daily rate to the general public and providing
additional services, such as restaurants, meeting rooms, maid service and recreational
' facilities. A Hotel may be either a full-service hotel, a limited service hotel, or a suite
Hotel, each as more particularly described in Section 3.13A of this ordinance.
SECTION 2. That the Comprehensive Zoning Ordinance No. 1425-5-96, of the City of Allen, Texas, as
previously amended, be amended in part, to add Section 3.13 Supplemental Development Standards to read as
' follows:
"3.13 DEVELOPMENT STANDARDS. The following standards shall apply in all zoning districts
except as otherwise provided herein.
A. HOTELS
Building Design. The following requirements apply to foil -service Hotels, limited
service Hotels and suite Hotels:

a.
Accessibility. A guest room shall be accessible only from an internal
hallway and the internal hallway shall be accessible primarily from a
central lobby area contained within the Hotel.
b.
Exterior Walls. Each exterior walls regardless of the number of stories,
excluding doors, windows and window units shall be composed of:
(1) at least seventy-five percent (75%) primary masonry materials
such as brick, stone, hand -laid tile (laid unit -by -unit), or veneer of
such materials having the appearance of hand -laid units;
(2) not more than twenty-five percent (25%) secondary masonry,
materials that is exterior insulation and finish systems composed of

natural aggregates and synthetic binders having a minimum applied
thickness of 314 inches, exposed aggregate, glass block or
decorative concrete masonry units other than flat -gray block; and
(3) not more than ten percent (10%) non -masonry materials.
2. Site Facilities.
a.
Number of Rooms. A full-service Hotel and a suite Hotel shall have at
least 100 guest rooms.
b.
Meeting Rooms. A full-service Hotel shall have at least 4,000 square feet
of meeting room space. A limited service Hotel shall have meeting rooms
of at least 700 square feet in area. The meeting rooms shall be equipped
with a sink and a coffee bar.
C.
Swimming Pools. All Hotels shall have a swimming pool of at least 800
square feet of surface area.
d.
Restaurants and Food Service. A full-service Hotel shall have full food and
beverage service. Suite and limited service Hotels shall have either full or
limited food and beverage service.
1) Full Food and Beverage Service: is defined as providing three meals

per day, and have on-site, a restaurant with table service provided
primarily by waitpersons, seating for at least thirty customers, and full
mew service offering multiple entrees with on-site food preparation

2) Limited Food and Beverage Service: is defined as providing food and
beverage service for fewer than three meals per day
' 3. Parking and Circulation. The following requirements apply to all Hotels:
a. In addition to required parking for any additional component of the Hotel
such as meeting rooms and restaurants, parking shall be provided at the
ratio of 1.25 parking spaces per guest room for full service hotels and 1.0
space per guest room for limited service and suite hotels
b. An attached, covered, drive-through area adjacent to the Hotel lobby or
main desk shall be provided for the temporary parking of vehicles during
guest registration or check-out.
C. All parking areas shall be illuminated by lighting standards having a
minimum illumination intensity of 2.0 foot-candles measured at ground
level.
4. Screening. In addition to any other screening and landscaping requirements
imposed by the Code of Ordinances and the Comprehensive Zoning Ordinance, all
Hotels shall provide screening of ground -mounted dish antennas, satellite earth
stations, parabolic or spherical antennas, and any other device or assemblage of
devices designed to transmit and/or receive signals to or from orbiting satellites,
HVAC (other than HVAC equipment serving an individual unit), mechanical
equipment and auxiliary power equipment by means of a masonry screening wall or
a wrought -iron (tubular steel) fence with a living screen, either of which shall be of
sufficient height to block visibility of the equipment from view from the street.
5. Site Access. Primary access to the site shall be from freeway access roads, major
arterials, or internal service roads serving commercial development. Secondary
access shall be from streets classified as major collectors, arterials, freeway access
roads, or internal service roads serving commercial development."
SECTION 3. That the Comprehensive Zoning Ordinance No. 1425-5-96, of the City of Allen, Texas, as
previously amended, be amended in part, to amend Section 3.03(A)(11) and (15) to read as follows:
"3.03 VEHICLE PARKING:
A. Puking Requirements:
(11) Hotel - 1.25 spaces per guest room for full service hotels and 1.0 space
per guest room for limited service and suite hotels.

SECTION 4. That Exhibit "B" Schedule Uses attached to the Comprehensive Zoning Ordinance of the City
of Allen, Texas be and the same is hereby amended in part, by removing Hotel/Motel uses from all zoning
districts where currently allowed and by adding full service Hotel, limited service Hotel and suite Hotel as
allowed only by specific use permit in "CC" Corridor Commercial, "O" Office District, "Ll" Light Industrial
District, "CBD" Central Business District, and in a "PD" Planned Development Districts when so allowed by
the granting ordinance.
SECTION 5. That all ordinances of the City of Allen in conflict with the provisions of this ordinance shall
be, and the same are hereby, repealed; provided, however, that all other provisions of said ordinances not in
conflict herewith shall remain in full force and effect.
SECTION 6. An offense committed before the effective date of this ordinance is governed by prior law and
the provisions of the Comprehensive Zoning Ordinance, as amended, in effect when the offense was
committed and the former law is continued in effect for this purpose.
SECTION 7. That should any word, sentence, paragraph, subdivision, clause, phrase or section of this
ordinance, or of the Comprehensive Zoning Ordinance, as amended hereby, be adjudged or held to be void or
unconstitutional, the same shall not affect the validity of the remaining portions of said ordinance or the
Comprehensive Zoning Ordinance, as amended hereby, which shall remain in full force and effect.
SECTION 8. That any person, firm or corporation violating any of the provisions or terms of this ordinance
shall be subject to the same penalty as provided for in Comprehensive Zoning Ordinance No. 1425-5-96 of the
City of Allen, as previously amended, and upon conviction shall be punished by a fine not to exceed the sum
of Two Thousand Dollars ($2,000) for each offense.
' SECTION 9. That tris ordinance shall take effect immediately from and after its passage and publication in
accordance with the provisions of the Charter of the City of Allen, and it is accordingly so ordained.
