' AN ORDINANCE OF TDE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN
COUNTY, TEXAS, AFFECTING PARTICIPATION OF CITY EMPLOYEES IN
THE TEXAS MUNICIPAL RETIREMENT SYSTEM GRANTING THE
ADDITIONAL RIGHTS AUTHORIZED BY SECTION 854.202(g) OF TITLE 8,
TEXAS GOVERNMENT CODE, AS AMENDED; PROVIDING FOR A REPEALING
CLAUSE; PROVIDING FOR A SEVERABILITY CLAUSE; AND PROVIDING AN
EFFECTIVE DATE OF SAID ORDINANCE.
WHEREAS, the City Council of the City of Allen is a participant in the Texas Municipal Retirement System;
and,
WHEREAS, the City Council has held a public hearing in accordance with State law to determine the
advisability of adopting the twenty (20) year retirement option as provided in Texas Municipal Retirement
System Act; and,
WHEREAS, the City Council has prepared and considered an actuarial analysis of member retirement
annuities based on twenty (20) years of service; and,
WHEREAS, the City Council deems it desirable for the benefit of its employees and the public service to its
citizens to adopt such twenty (20) year retirement plan.
' NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ALLEN, COLLIN COUNTY, TEXAS:
SECTION 1. That pursuant to the provisions of Section 854.202(8) of Subtitle G of Title 8, Texas
Government Code, as amended, which Subtitle shall herein be referred to as the "TMRS Act", the City of
Allen, Texas hereby adopts the following provisions affecting participation of its employees in the Texas
Municipal Retirement System (herein referred to as the "System"):
Section 1-A. Any employee of the City who is a member of the System is eligible to retire and receive a
service retirement annuity if the member has at least twenty (20) years of credited service in the System
performed for one or more municipalities that have adopted a like provision under Section 854.202(8) of
the Texas Municipal Retirement System Act.
Section I -B. The rights and privilege hereinabove authorized shall be in addition to the plan provisions
previously authorized heretofore adopted and in force as of the effective date of this ordinance pursuant to
the Texas Municipal Retirement System Act.
SECTION 2. If any article, paragraph or subdivision, clause or provision of this ordinance shall be adjudged
invalid or held unconstitutional, the same shall not affect the validity of this ordinance as a whole or any part or
provision thereof, other than the pan so decided to be invalid or unconstitutional.
SECTION 3. That all provisions of ordinances of the City of Allen, Texas, in conflict with the provisions of
this ordinance be, and the same are hereby, repealed, and all other provisions not in conflict with the provisions
of this ordinance shall remain in full force and effect.
SECTION 4. This ordinance shall take effect immediately from and after its passage, as the law and charter
in such cases provide.
