The called - special joint workshop session of the Allen City
Council was called to order by Mayor Pierson at 7:34 p.m, on
Tuesday, July 26, 1983, in the Council Chambers of the Allen
Municipal Annex, 1 Butler Circle.
The called - special joint workshop session of the Allen
Planning & Zoning Commission was called to order by Commissioner
Pendleton at 7:34 p.m. on Thursday, July 26, 1983, in the Council
Chambers of the Allen Municipal Annex, 1 Butler Circle.
This workshop session had been called in order to discuss
the findings and recommendations of the Central Business District
Committee.
City Manager McCarty opened the workshop session by intro-
ducing Mr. Mike Starek, with DeShazo, Starek & Tang, Inc., the
consultant working with the Main Street Study Committee.
City Manager McCarty advised that a packet of information had
been sent to all Council Members and Commissioners. That packet
of information contained the original document and flow sheet
submitted by the Planning and Zoning Commission establishing the
need for a Central Business District; an amended schedule of uses
to include allowable uses for the CBD (Central Business District);
Sheet No. 6 of the planimetric maps showing the general area
considered for the CBD; Sheet No. 6 of the planimetric maps showing
the recommended boundaries for the CBD; a copy of a letter from
City Manager McCarty to legal counsel requesting review of recom-
mendations; a letter from Lewis Nichols, legal counsel, after his
review; and the use regulations recommended for the CBD which
includes all changes suggested by the attorney.

Overview - Charge of Committee (Agenda Item II -A)
Councilman Rodenbaugh spoke before both bodies on the appoint-
ment of the CBD Committee, which consisted of Council Don Rodenbaugh,
Mayor Pro Tem Joe Farmer, Commissioner Gary Koch and Commissioner
Mike Hill, who is no longer on the Commission.
Councilman Rodenbaugh explained the charge of the committee,
the various meetings the committee had and the resulting recommenda-
tions to be made by the committee, which will be presented at this
meeting.
Overview - Study Results
(Agenda Item II -B)
Councilman Rodenbaugh advised of the committee's work to establish
the boundaries of the CBD, the central core of the CBD, what businesses
should be allowed in the CBD, and the actions to be taken to establish
the CBD.
Defining Geographic Area of CBD
(Agenda Item III)
Councilman Rodenbaugh presented a large map showing the location
of the CBD within the city limits of Allen and explained how the
committee determined the boundaries. In comparison, he presented
another map showing the CBD in relation to the extraterritorial
jurisdiction of the City of Allen.
Description of Proposed Amendments (Agenda Item IV)
Mayor Pro Tem Joe Farmer spoke before both bodies regarding the
proposed amendments to the City of Allen's Comprehensive Zoning
Ordinance No. 366-10-81 for the CBD zoning. The amendments proposed
as follows:
1. An amendment to the zoning text to add the Central
Business District Classification.
2. An amendment to the "Schedule of Uses" to add the
Central Business District Classification and
establish allowable uses under that district only.
3. An amendment to the zoning map to change zoning
classifications within the boundaries of the
Central Business District to CBD.
4. An amendment to the zoning text, Section 2.09, Site
Plan Approval, to establish and clarify which types
of development would require site plan approval
through the public hearing process.
Review Performance Requirements
of Use Regulations
(Agenda Item V)
Mayor Pro Tem Joe Farmer reviewed with both bodies the performance
requirements of use regulations as drafted under Section 3.01 (U) "CBD"
Central Business District Regulations, the proposed amendment to the
Zoning Ordinance. That section containing the purpose of the CBD;
general use classifications for retail, retail/service, commercial,
residential and the schedule of uses; height and area regulations;
allowable onstreet parking; offstreet parking required; site plan
approval; performance standards; building regulations and exceptions.
There was considerable discussion among the Council and the
Commission on the proposed portion of Section 2 "General Use Classifi-
cations", which stated in part "It is also the intent of the Central
Business District to not allow . the conversion of existing wood
frame single-family detached dwellings to retail, retail/service,
commercial, or multi -family uses". The discussion centered around
the reasoning behind the elimination of the conversion of existing
wood frame single-family detached dwellings for commercial businesses,
and providing a means for exceptions to that requirement.

Review Performance Requirements
of Use Regulations (cont'd) (Agenda Item V)
The discussion continued on Section (b) of the height and area
regulations as it pertains to existing vacant lots which have not
been developed within the CBD district and the set -back requirements;
the boundaries determined for the CBD and why some areas were
included in the CBD zoning district; the off-street parking
situations; widths of streets in the CBD and the need for dedication
of street right-of-way.

in connection with the planning of the CED, the
thoroughfares within the CBD, using the

The discussion continued on the provisions pertaining to
allowable onstreet parking and offstreet parking required, with
suggested changes be made in the use of the words "right angle
on -street parking" to "head -in parking" and the addition of a
sentence to Section 4 (Allowable Onstreet Parking) to read
"Exceptions are on designated major thoroughfares as specified
in the Thoroughfare Plan".
Procedural Requirements (Agenda Item VI)
City Manager McCarty spoke before both bodies regarding
the adoption procedures for the Central Business District zoning
amendments. Mr. McCarty advised that a joint public hearing
could be held by the Council and the Commission for this zoning
amendment, similar to the meeting held when the Comprehensive
Zoning Ordinance was adopted.
Notification of the public hearings would be through the
use of the 1982 Tax Roll, with notification going out to all
property owners in the City of Allen. This would simplify
matters rather than trying to contact all property owners within
200' of the CBD.
Mr. McCarty advised of the required number of days for mailing
out the public hearing notices and when the public hearings could
be held.

(Agenda Item VII)
MOTION: Upon a motion made by Councilman Rodenbaugh and seconded
by Mayor Pro Tem Farmer, the Council voted 4 - 0 to
set the public hearing date for Tuesday, September 4, 1983,
for the proposed amendments to the Comprehensive Zoning
Ordinance No. 366-10-81 and zoning map for the Central
Business District Zoning. The motion carried.
MOTION: Upon a motion made by Commissioner Koch and seconded
by Commissioner Wolfe, the Commission voted 4 - 0 to
set the public hearing date for Tuesday, September 4, 1983,
for the proposed amendments to the Comprehensive Zoning
Ordinance No. 366-10-81 and zoning map for the Central
Business District Zoning. The motion carried.

Adjournment (Agenda Item VIII)
MOTION: Upon a motion made by Councilman Rodenbaugh and seconded
by Mayor Pro Tem Farmer, the Council voted 4 - 0 to
adjourn the called - special joint workshop session at
10:25 p.m. on Tuesday, July 26, 1983. The motion carried.

Commissioner Larsen, the Commission voted 4 - 0 to adjourn
