AN ORDINANCE OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS,
v PROVIDING FOR CERTAIN ADMINISTRATIVE DEPARTMENTS;
AUTHORIZING THE CITY MANAGER TO ESTABLISH AND CHANGE
DIVISIONS WITHIN DEPARTMENTS AND TO ASSIGN THEIR WORK;
REPEALING ORDINANCE NOS. 427-1-83 AND 1336-5-95; PROVIDING A
SEVERABHITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE
WHEREAS, Section 2.06 of the Allen City Charter empowers the City Council to establish, consolidate,
or abolish administrative departments and distribute the work of divisions; and
WHEREAS, Section 3.05 of the Charter requires the City Council, after hearing recommendations from
the city manager, to provide by ordinance for necessary organizational arrangements to carry out
properly its public safety, public works, recreation, library, finance, and other service and administrative
functions; and,
WHIItFAS, by Resolution No. 1611-7-98(R), the Allen City Council adopted governance policies to
guide the City Council and staff in providing effective leadership and efficient administration of city
government; and,
WHEREAS, Council/Staff Linkage Policy 4.1 (CSL 4.1) establishes that "all council authority, with the
exception of that given the city attorney, municipal judge, or city secretary, is delegated to the city
manager so that all authority and accountability of staff, as far as the Council is concerned, is considered
to be the authority and accountability of the city manager"; and,
WHEREAS, CSL 4.1 further defines that "the city manager is authorized to establish all further policies,
make all decisions, take all actions, and develop all activities as long as they are consistent with any
reasonable interpretation of the Council's policies on Ends and Executive Limitations"; and,
WHEREAS, Executive Limitations Policy 3.9 (EL 3.9) states that "the city manager may not let the
Council be unaware of material external and internal changes, particularly changes in the assumption
upon which any Council policy has been previously established"; and,
WHEREAS, the Acting City Manager has advised the Council that certain organizational structures,
reporting relationships, and work assignments should be changed in order to achieve the Council's Ends
Policies;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN,
TEXAS, THAT:
SECTION 1: There shall be established the following departments reporting to the city manager, in
order to carry out the service and administrative functions of the city: police, fire, parks and recreation,
library, public works, finance, city manager, personnel, planning and community development.
SECTION 2- The city manager is delegated authority to establish, consolidate, divide, or abolish
divisions within these departments that he or she determines are necessary to accomplish the Council's
Ends Policies and to assign the work of these departments and divisions.
SECTION 3: From and after the effective date of this ordinance, Ordinance Nos. 427-1-83 and 1336-
1-95 are hereby repealed.
SECTION 4: All ordinances of the City of Allen in conflict with the provisions of this ordinance be,
and the same are hereby repealed; provided, however, that all other provisions of said ordinances not
in conflict herewith shall remain in full force and effect.

SECTION 5: It is hereby declared to be the intention of the City Council that the sections,
paragraphs, sentences, clauses, and phrases of this ordinance are severable; and if any phrase, clause,
sentence or section of this ordinance shall be declared unconstitutional or invalid by any judgment or
decree of a court of competent jurisdiction, such unconstitutionality or invalidity shall not affect any
other remaining phrase, clause, sentence, paragraph or section of this ordinance; and the City Council
hereby declares it would have passed the remaining portions even though it had known the affected parts
would be held unconstitutional.
SECTION & This ordinance shall take effect immediately from and after its passage and publication
in accordance with the provisions of the Charter of the City of Allen, and it is accordingly so ordained.
