' AN ORDINANCE OF THIS CITY OF ALLIIN, COLLIN COUNTY, TEXAS,
AMENDING COMPREHENSIVE ZONING ORDINANCE NO. 1425-5-96, AS
PREVIOUSLY AMENDED, TO AMEND FLOOD PLAIN-PIANNED
DEVELOPMENT NO. 31 (FP -PD NO. 31) BY AMENDING THE LAND USE
PLAN AND INCREASING ITS GEOGRAPHIC LIMITS ON THE FOLLOWING -
DESCRIBED TRACT OF LAND: 22.738 ACRES OF LAND LOCATED IN THE
JOAB BUTLER SURVEY, ABSTRACT NO. 47, ALFRED SLACK SURVEY,
ABSTRACT NO. 854, AND JOSEPH WILCOX SURVEY, ABSTRACT 1017,
CITY OF ALLEN, COELIN COUNTY, TEXAS; PROVIDING FOR EX IIBIT T
LAND USE PLAN; PROVIDING FOR EXHIBIT 7" AREA AND USE
REGULATIONS; PROVIDING FOR EXHIBIT 'K" LEGAL DFSCREMON;
PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF
TWO THOUSAND DOLLARS (52,000.00) FOR EACH OFFENSE; PROVIDING
FOR A SEVERABILITY CLAUSE; AND PROVIDING FOR THE EFFECTIVE
DATE OF SAID ORDINANCE
WHEREAS, the Planning and Zoning Commission of the City of Allen, and the governing body of the
City of Allen, in compliance with the laws of the State of Texas and the ordinances of the City of Allen,
have given the requisite notices by publication and otherwise, and after holding due hearings and
affording full and fair hearing to all the property owners generally and to all persons interested and
' situated in the affected area and in the vicinity thereof, and in the exercise of its legislative discretion,
have concluded that Comprehensive Zoning Ordinance No. 1425-5-96, as previously amended, should
be amended.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN,
TEXAS, THAT -
SECTION 1: Comprehensive Zoning Ordinance No. 1425-5-96 of the City of Allen, Texas, as
previously amended, be and the same is hereby amended by changing the Zoning Map of the City of
Allen to amend Planned Development No. 31 on 22.738 acres of land located in the Joab Butler Survey,
Abstract No. 47, Alfred Slack Survey, Abstract No. 854, and the Joseph Wilcox Survey, Abstract No.
1017, City of Allen, Collin County, Texas, by increasing its geographic limits and changing the land use
plan.
SECTION2 The land use plan attached hereto as Exhibit "I" and the area and use regulations
attached hereto as Exhibit "J" are made a part hereof for all purposes and shall be adhered to in their
entirety.
SECTION 3: The property described in Exhibit "K" attached hereto shall be used in the manner and
for the purposes provided for as approved herein.
SECTION 4: All ordinances of the City of Allen in conflict with the provisions of this ordinance shall
be, and the same are hereby, repealed; provided, however, that all other provisions of said ordinances
not in conflict herewith shall remain in full force and effect.
SECTION 5: Any person, firm, or corporation violating any of the provisions or terms of this
' ordinance shall be subject to the same penalty as provided for in Comprehensive Zoning Ordinance No.
1425-5-96 of the City of Allen, as previously amended and upon conviction shall be punished by a fine
not to exceed the sum of TWo Thousand Dollars ($2,000.00) for each offense.
SECTION & It is hereby declared to be the intention of the City Council that the sections,
paragraphs, sentences, clauses, and phrases of this ordinance are severable; and if any phrase, clause,
sentence or section of this ordinance shall be declared unconstitutional or invalid by any judgment or
decree of a court of competent jurisdiction, such unconstitutionality or invalidity shall not affect any
other remaining phrase, clause, sentence, paragraph or section of this ordinance; and the City Council
hereby declares it would have passed the remaining portions even though it had ]mown the affected parts
would be held unconstitutional.
SECTION 7: This ordinance shall take effect immediately from and after its passage and publication
in accordance with the provisions of the Charter of the City of Allen, and it is accordingly so ordained.

AREA AND USE RESTRICTIONS
' FOR TIE SOUTERVEST AND SOUTHEAST CORNERS
OF MCDERMOTT DRIVE S, SUNCREEK BOULEVARD
The commercial zoning at the southwest and southeast corners of McDermott Drive and Suncreek Boulevard
in Allen, Texas, shall amend and expand PD -31 -and shall be subject to the following restrictions: -------- - -

a. Tract 2-A. The construction of buildings for the operation, or the operation of the following
businesses and activities shall not be allowed: funeral establishments, automobile showrooms, used
car lots, recreational activities involving gambling, pawn shops, outdoor circuses or entertainments,
outdoor meetings, bowling alleys, pool or billiard establishments, flea circuses or flea markets,
amusements parlors, check cashing services, amusement parks, skating rinks, and liquor stores.
b. Tract 1. Allowable uses for the Community Facilities zoning at the southwest quadrant of McDermott
Drive and Suncreek Boulevard are attached as Exhibit "A".
2. Heieht.
a. The height of the buildings on Tract I and Tract 2-A facing Tatum Drive and Suacreek Boulevard shall
be no higher than one (1) story, and the height of the buildings facing McDermott Drive shah be no
higher than two (2) stories.
b. Permitted height of any building within Tract 1 closer than 160 feet to the west right-of-way line of
Suncreek Boulevard shall conform to subparagraph 2(a) above. Buildings more than 160 feet west of
' the right-of-way line of Suncreek Boulevard shall not exceed 36 feet in height except that church
steeples may be constructed to a maximum height of 65 feet.
3. Placement of Buildings. The buildings shall be constructed so the fronts of buildings shall face McDermott
Drive, Tatum Drive, and/or Suncreek Boulevard.
4. Q=1991Wn Materials All building exterior wall construction materials that are exposed shall be
constructed of stone, brick, tiles, glazing, formed glazing, concrete masonry units, East concrete, concrete,
stucco, or similar concrete -based masonry materials, or a mixture of masonry materials.
5. Parking. Puking spaces on Tract 2-A shall be provided by surface parking only with no parking structures
whatsoever permitted on the property. Only concrete parking surfaces shall be used.
6. Screening. All heating, ventilating, air conditioning, and other equipment located on the rooftop of any
building, and all trash or dumpster facilities shall be screened from view on all sides.
7. lafrast m /Pm _ Access. Provisions of Section VII, Paragraph 3 of Ordinance 1285-9-94 shall
not apply to Tracts 1, 2-A, or 2-B as shown on the attached Exhibit 'B".
All the above conditions are in addition to and exceed previously agreed upon restrictions currently in place under
PD -31.
